  3. you have a long road ahead but keep replying to the letters as they come one by one and eventually you will get there. I sued LLoyds TSB on behalf of my son and although they huffed and puffed they paid up in the end. Took us about two and half months all in all but got there eventually 3 days before the court case was scheduled.
  4. In answer to my question- yes We have case settled on 28th June and payment into my son's account on that day. A bit of a saga but worth it especially to those of you that have a lot of money at stake. Just keep answering all the letters on time and you will get there in the end.
  5. the sum of £325 was paid into my son's account on Wednesday 28th June. I only remembered on Friday morning (30th June)that the court case is on Monday 3rd July. Phoned the Court in Milton Keynes and told them we didn't want to proceed because LLoyds had settled. The lady said that they would have to have it in writing and din't think the case could be stopped for Monday. Got my son to fax a letter through to the court with a statement showing the money paid in. I will have to ring them tomorrow and hope that they can pulll the case before the judge sees it. How do I make a domnation to the site?

    Smila v Lloyds

My son went into Lloyds at Oxford for his review. I suggested that he tells them he is a poor student and that he is trying to keep his head above water but things are difficult on a student loan. Also suggested he say something on the lines of he is at a good university (Oxford) and that one day when he is making a lot of money he could very well invest with Lloyds TSB. The person conducting the review was very sympathetic and offered to increase his overdraft. She also commended him for trying to reduce his overdraft by transferring it to a LLoyds TSB credit card with 0% interest for 9 months. They parted on the best of terms and she said she would let Martinuae Johnson know that he had attended the review so that they could pay the money in ASAP. Is this the end of the story we wonder?

    Smila v Lloyds

I think they want you to have the account review before they put the money into your account. My son rang his branch yesterday to say that he is away at uni so can't come in to the branch till 10th July which is 1 week after the court hearing and they said just pop into your local branch where you are at uni. He's going to do that tomorrow. I bet they won't know what to do with him when he turns up though. The local banks don't seem to know what is going on. Has anybody else found that to be the case?

    Smila v Lloyds

have a look at Hill V Lloyds TSB. I have been going through the process on behalf of my son Matt. I was encouraged to cross out the confidentiality clause by members of this site and ask for another £30 because they had charged him again since we started the claim They wrote back straight away and said yes alright. We haven't got the money yet though- they hang it out for as long as they can hoping you will miss a deadline or just give up. I'd be interested to know what happens with you.
  10. The saga continues Had a letter from LLoyds saying Thank you for signing and returning your letter on 7th June 2006. We are pleased that you are willing to settle your claim in the terms set out in that letter. Please note that ther refund of the amount of your claim can not be paid until the .....branch confirm that you have attended an account interview. Please contact ........... on 01525 853234 to arrange the necessary review. In the meantime please can you write to the Court, as the claimant in this matter, to confirm that the case has been settled. The Court needs to be made awae that there is no longer any need for the proceeding to continue so that the hearing date can be vacated. Please can you also send us a copy of the letter to the Court for our file. Thank you for your assistance in this matter Yours Faithfully I wrote back Dear Sir Thank you for your letter which I received today about my claim against Lloyds TSB bank I have telephoned Lloyds TSB in ...... and requested to speak to ................. on two occasions. The first time I was informed that she had left the branch and I explained to the person answering the phone why I had phoned. They informed me that they knew nothing about the issue. Today I phoned again at your request and asked to speak to ........... and was again told that she had left the branch. I have been asked to phone back again on Monday to speak to another person. As you will appreciate I am a student and find it costly to make phone calls from a payphone or from my mobile especially when no one at Lloyds seems to know why I am phoning. Can I suggest that you ask them to phone me - they have my mobile phone number. Meanwhile I would remind you that the Court hearing is on 3rd July and I have no intention of writing to the court to confirm that the case has been settled until the payment of £325 is in my account. I look forward to hearing from Lloyds at their convenience. Yours Sincerely What a cheek. They are actually expecting me to let the Court know that everything is fine and my son hasn't even had a penny yet.
  11. I think I've done that already. How can I check?
  12. After reading your last post I became very brave and crossed out the confidentiality clause and asked for another £30 from them for another bank charge that they added after we claimed. Had a letter back from solicitors Martinasu and Johnson saying OK we'll give you the extra £30 and another agreement with no confidentiality clause to sign- so here goes we are signing this time and hope to get the money soon and then it's definately 5% in it for this site. Sorry it's not a bigger claim for my son and the site's sake.
  13. My son has received the exact same letter with the 5 conditions. It is so tempting to just sign them. We are in a real quandry. Are you sure people have had their money even if they didn't sign them He rang the bank on Friday to have a review of his case but the perosn they said he had to ask for had left and noone knew anything about it. So at least he's rung for his review.
  14. Ross I have been advised by the moderator of this site not to sign the confidentiality clause but to cross it out. Did you sign it and have you actually got the money into your account yet. My son rang up to discuss his account yesterday and LLoyds didn't know anything about it. They asked him to fax a copy of the letter that he had received from the solicitor to them. Did you have the same experience?
