  1. You can't claim those back as when you requested the text messaging service you will have agreed to pay the fee. When I first agreed to it, it was free. They then introduced the fee and I never got around to cancelling it. Maybe this happened to you??

  4. No - go for all of it, it is YOUR money afterall!!! I was offered a smaller amount than I claimed and I refected it. A week later after my LBA was sent I was offered the full amount. PS If this has been useful click the scales of justice below my name on the left
  5. This happened to me too. I wrote back accepting as part payment and that I wanted the rest. I then sent my LBA and they sent another letter offering me the full amount (just under £3000).   6. FD paid up to me in late December. In January I recieved £300 worth of charges. I am closing my account this month (already been using parachute account and just waiting for all DD's and SO's to be set up correctly). Once it is closed I will then pursue the £300 they owe me. Then they won't be able to do anything nasty!
  7. You'll need to send a prelim letter with a spreadsheet detailing charges owed. After 14 days if they haven't replied you then send the LBA. There are templates for both the prelim letter and the LBA letter on here. I got all my money back within 5 weeks - a very similar amount to you. They paid up after the LBA! It was all very simple. Don't worry you WILL get yours too.
  8. Hi I successfully claimed back lots of lovely money back in December. I opened a new account with Smile and transferred all my DD's and SO's in January. All companies have recieved and acknowledged my change of bank details and I can see their name in my list on my smile account. All that is apart from good old First Direct! I still have a loan with them and a joint account with which my rent & bills are paid from (will be changing that sgortly too!). They took money from my FD sole account to pay the DD to my joint account on 01/02. There was none in there so went into my overdraft. They then tried to take my loan repayment on 01/02. There wasn't enough overdraft available so on they issued me with a Default Notice on 01/02. No telephone call, just a letter arriving on my mat yesterday. I rang today telling them about the change of bank account and explaining that they knew of the changes to my payments and bank details. The woman I spoke to said there was nothing she could do and thatr it 'probably' would'nt matter anyway and would register as a '1' on my credit rating. I believe this is unreasonable as I informed them of the changes to be made and they have completely disregarded them - and now I am to pay. I am a first time buyer looking for a mortgage and this will count against me won't it? Is there anything I can do?????
  9. I gave them 14 days to respond. It depends on how long you stated in your letter to them. You have to stick to what you said.
  10. Mine crossed in the post two. Write and accept as part settlement and say you still want the rest. Remind them of the LBA and the deadline for that (stick to the original deadline you set). I'd start you o/h's as a seperate claim. But I don't know what others think! I hope you find this helpful.

  12. You can claim back overdraft fees and excess overdraft fees - I did successfully. The first charge is the charge for going overdrawn and then the second charge is for any subsequent times you go overdrawn. One month I was charged an excess o/d fee of £119.00! I too claimed for two accounts - sole and joint. I claimed them seperately, but always sent the correspondance together in one envelope. I hope this helps.
  13. I suppose my account was 'in dispute', however they stopped my card and I couldn't do a thing about it. If you've got your new account with Smile all will be fine though. Apparently they can't ask you to pay back your whole overdraft at once anyway.
  14. That happened to me and they stopped my maestro card! They denied it was anything to do with my letters regarding my claim. Don't be intimidated by them. I was so worried at first, but like you I had a new account with Smile and soon got all my money back from FD.

  16. I successfully claimed back my money from FD and it all landed in my account just before Christmas. However I was charged hideous amounts during December and thid totals a couple of hundred quid. I'd like that back too as it wasn't included in my original claim. What should I do? Start the whole process again or does anyone have any ideas as to what to put in a letter? (I'm not good at 'official' stuff.) Cheers in advance.
  17. They asked for my cards back!! It was a bit of a problem it being the run up to Christmas. (I spoke to them and they claimed this had nothing to do with my letters or claim. They said that my overdraft had been escalating and it didn't look as if I had plans to start paying it off.) I had opened an account with Smile tho and lived off the od while waiting for my claim to come through. I got all my money back just before Christmas and it cleared all my od with FD and more. Am moving it all over and closing my account with them asap. Fingers up to them!!! Don't worry keep in there.
  18. All in all I think I got my money back in about 5 weeks!! Only got as far as the LBA stage and it was all fairly painless.
  19. Thanks! I'll definately be donating as soon as the money hits my account. I'm really pleased that I decided to take the plunge and go for it and I couldn't have done it without this site and your help. I have passed on the website and info to lots of my friends and colleagues too! I sent the letter off today accepting their offer. I like the idea of getting this months charges back too.
  20. YIPPEEEEEEEE. I received a letter from FD yesterday offering me the full amount I'm claiming for!!!! There isn't even a confidentiality statement on the acceptance. They haven't included charges I will be charged this month - but hey who cares. I'm over £3000 better off!!
  21. I have sent my second LBA letter (after having readjusting my claim.) On another note did anyone see the Money programme on BBC2 last night? It was very good. I think the banks are going to start getting even busier!
  22. A lot of posters say wait until and if your claim gets to the small courts stage. I haven't claimed my interest - it looked too complicated and Maths isn't my strongest subject!
