I had the same thing from Northampton on 8th May but the next step was a letter from Bodmin Court saying that the AQ was not needed and the case was to be small track and the hearing date was 13th July. Probably the same thing will happen for you Jan PS My bundle went off today, I think it looks quite good, many, many thanks:D :D to MimiJ, Lat and all others that have helped me to this stage.xxxxx
  3. Hi Pete, thanks for that. I see you posted at 1.43 this morning, you must be as daft as I am (or you're a shift worker) my last post (no bugle playing please) was, I think, around 3.30:cool: . Praps I should get a life:razz:. Yes, I could do with some help, but the sort I want I cant have ie someone at the end of a phone line to reassure me. The bundle has to go today and I'm sure there is something I've messed up. The first letters to A&L showed a different amount to that claimed because I had originally all of the monthly overdraft fee. By the time I claimed on MCOL I had changed that to deducting the £5 standing fee from the amount charged which amounted a difference of about £150 overall, so the claim was less. Trouble is I didn't notify A&L of this so I'm afraid the Judge may throw it out because of the difference. Wragge (sols) have an up to date charges s/sheet but I havent pointed out the reason and dont know if I should write a letter explaining this to them and A&L or let sleeping dogs lie. Any thoughts anyone. (twitch twitch) Jan

Mimi, I'm sooooooo dopey, the reason I couldn'd find the link is because I'm looking at my saved version, I didn't think to look at the up-to-date one. but then I am pushing 708) so praps I'm not so bad after all lol.   6. Hi Lat, The small claims track hearing for my friends case (I'm doing it for her) is Friday 13th July so the bundle has to be in by this Friday. I thought I was on track having done all my homework (or so I thought ) and getting lots of help from this site, but I've just started to panic as having started to print the relevant cases some of them are very long ie Murray v Leisureplay, about 80 pages. Do I have to send the whole lot or just the synopsis as in Bankfodders cases library? If anyone can answer this ASAP I'd be really grateful as I need to be sure about all aspects and hotfoot it to the post office by Tuesday. Jan

  8. Thanks Lat, I've sorted it with the court, they forgot to ask me for the fee!!!. The bank is A&L and the sols Wragge and co: I'm sending them my index and a letter asking for settlement. Jan
  9. forgot to say the clerk admitted that she had omitted to mention the £100 fee but has put a note on my file that I phoned about it and will pay in due course. Jan
  10. Thanks for that, I've just phoned the court, the clerk was most helpful, it is the final hearing, so it's all systems go for the 13th July I'm going to send my index and a letter inviting Wragge to settle before I start the printathon. Many thanks Jan
  11. I dont have any A&L t&c or int & charges but am badly in need of some for pre 2001. I've tried copying a set of 1998 t&cs but they wont fully copy, hope you can help as my bundle has to be in by 28th june. Is it imperative that you have the right ones or will later editions do? Jan Jan
  12. Hi Mimi, there is something I'm worried about. This claim is for a friend and is from 2001 til 2005 when A&L closed the account. She doesn't have the original T&Cs or interest and charges docs. I've followed the links you gave me and have copied 2000-2002 but 1998 wont copy and I cant find any earlier ones, I think it's now too late for a SAR so do you think it will matter that I dont have the relevant ones. Surely it wont be thrown out because of that (she said more in hope than knowledge) Jan

Hi Lat, The letter I've had from the court (after the one saying that no AQ is needed) says "District Judge Griggs has considered the statements of case and AQs filed and allocated the claim to small claims track. The hearing of this case will take place at 11:00 an the 6th July (later letter changing it to Friday 13th eek!!!) 2007 at Bodmin and should take no more than 15 mins. The court must be informed immediately if the case is settled by agreement before the hearing date. Each party shall deliver to every other party and to the court office copies of all documents (including any experts' reports) on which he intends to rely at the hearing no later than 14 days before the hearing. The original documents shall be brought to the hearing. No mention of any fee and before I read this post I didn't give it another thought. I've got as far as knowing what's going into the bundle but not yet printing it. My next move (I think) is to send a copy of the index to Wragge & Co, complete with CAG sticker so they know I mean business, but now I'm a bit worried about the fee for the non-existent AQ. Does the above letter from court mean it's a preview or the actual case. Hope you can help with this. Jan

Hi Mimi, I'm just reading your threads from the beginning (you've already given me a lot of help and support) and I had to stop here and post as your thread is almost an exact copy of my experience, right down to helping a relative and how it makes one even more twitchy. It's very comforting to see where you are now and it makes me feel a whole lot better. I'm just looking at your index and would like to look at the BBC NEWS Article "Bank Retreats on Overdraft Fees" I've googled it, looked on BBC NEWS ONLINE and and the CAG site and cant find it anywhere. I've copied the T&Cs but I see in your index you have related charges and interest rates, I have found these on the A&L website but I believe they are the current ones, does this matter or do I need ones for the relevant period? Also the cases I am using in the defence i.e Dunlop v New Garage do I need to find and submit the whole case or just references to it.   17. Hi Clare, I am in the Plymouth area but although I requested Plymouth they have given me Bodmin on Friday the 13th July:eek: :eek: just put back a week by the court from the 6th. The strange thing is that when they sent the first date the letter said that no AQ was required, the case was allocated to the small claims track and should take no more than 15 mins. I havent completed my bundle yet, Mimi has been VERY helpful but I'm still a bit confused, I guess I must read everything another 6 or 7 times. What worries me is I dont have a copy of terms and conditions from 2001 to 2005 the dates of the claim, I dont suppose you have a copy you can send me, I've tried the link to the archive but it's showing no results. It must be something I'm doing as it says there are 6 billion pages and I cant believe there's nothing in all those pages about the A&L!!! Jan

  19. Hi MimiJane, firstly am I doing the right thing by joining in on this? I hope so. I am preparing a case for a friend (she has no computer) and have reached the Court date stage. This is closer than is comfortable (July 7th) as I keep putting off sending anything in as I'm still unsure of what to do despite downloading the bundle and reading it many times. For example, should I print 3 copies of the whole bundle and of the Commisions Report and other relevant cases as this amounts to about 500 pages times 3? surely this cant be right, it must be me being thick:D Especially as the letter from the court (they didn't request an AQ) says they expect the case to last no longer than 15 mins. The Judge must be a fast reader lol. I think that your index would be a GREAT help to me may I pm you with my email address please? Hope you can help Jan:-? :-? :-?
  20. Just to say thanks for that info Lat, this claim is for my Son's girlfriend. DG havent filed their AQ, the Judge wrote and gave notice of judgement on the 16th of April if they havent filed by then, that was yesterday. Today came a letter from DG upping their offer but disputing the amount because of a couple of refunds they had made. I had already accounted for them so am going to reply that if they include those amounts she will accept which will be for the full amount plus costs. To Katteh. If you look at my first posts you will see what a shivering wreck I was about all of this, now I've started another 6 claims for various people, it's amazing how many folk the banks are ripping off. Many many thanks to in particular Lat and Nettyg but also to anyone else who answered my threads. I couldn't have done it without you. Dickydido (Jan)
  21. Thanks for that Janus, similar thoughts to my own. I think I will just submit my claim on MCOL deducting the £5s from the breakdown but including the increased O/D fee and see wht happens, I guess you're right that the worst should be that they disagree then it's up to the Judge if A&L dont settle.   23. Thats what I think but I'm not sure and I dont want to get it wrong and find that due to claiming for it erroneously something goes wrong. I'm hoping that another A&L customer has had the same problem and reads this and can tell me what they did.
