Barclays Bank Mortgage prisoner - the computer says no.
Paul Walton replied to Paul Walton's topic in Barclays Bank
She won't budge until she gets the money, i.e. the £25k, he has had a letter from her solicitors saying to pay up by the end of May or we will force the sale even if it results in bankruptcy again. Common sense would think Barclays would see how ridiculous the situation is, but no. He would be paying less a month, due to the high rate he is stuck on ! he can raise the £25k (Via pension and pay a chunk of tax) Could the FOS help? It really is crazy -
This is a crazy one I'm trying to help a friend out with. I don't have all the details, but here goes. 12 years ago, my friend, let's call him Bill, was bankrupt. At the time, his house was in negative equity. His wife ran off with another woman, leaving him with two young girls. At the time, Bill did not get a clean break agreement, the logic being he did not have the money, and he had nothing left anyway! 12 years later, Bill wanted to get a better rate in his sole name, but the bank said no, you don't earn enough ( never missed a payment in 12 years!) They have some sort of court order saying she is not liable if Bill does not pay the mortgage. Bill, as crazy as this sounds, in a situation where Barclays is refusing to put the mortgage in his sole name, his ex is saying if you don't take me off the mortgage, I will force you to sell the house, pay me my remaining £25k ( she despite not supporting their children for 12 years got half his pension - another story) How can he force Barclays to take her name off and see how bonkers this situation is. £97k mortgage value circa £350k

I'm try to help out a friend. Over 40 years ago she fell pregnant ( as it was called then) Anyway the 'gentleman' concerned did a runner and lived overseas. Sue me if you want to, a real charmer. Now the lady in question is ill, her daughter now in her 40's with her own children. The 'gentleman' in question has now moved back to the UK and has a very expensive property. Couple of questions: 1. Can the mother still chase him for never paying a penny? 2. Can a charge be registered against the property ? 3. What if the mother dies before it's completed - can it form part of her estate? It's a nasty one indeed.

Is a consumable product covered the same?
Paul Walton replied to Paul Walton's topic in General Retail
Thanks for that, i have pointed that out to them. TS next step? -
I purchased a polishing pad for detailing my car. About £20, so a quality product you can get 5 for about £10 at Halford - but they don't last. My email to the retailer: This pad slipped away from the backing pad, it was used once and I’m not a new comer to using it. I have sent one email to you without a reply. Do you want me to send the faulty product back. I will have an exchange or refund as the product is clearly not of merchantable quality. The reply: Unfortunately with pads, due to them being a consumable and the number of factors involved with the potential for them to delaminate we do not offer any warranty with them The best option in this situation is to get in touch with Flex directly and if they deem the pad faulty then we can offer a replacement as we would then get a replacement from them I thought the onus was on the retailer, not the manufacturer? Seems a bit harsh you can use it and it unless after one go?

Previous Foster 'Carer' not saved money for the children.
Paul Walton replied to Paul Walton's topic in General Legal Issues
Just a quick update. I have escalated the complaint to the LA stage 2. They don't have a policy as such that says you must save money, but it's encouraged. they will be reviewing their policies. That does not help the children, i also understand there is a fostering ombudsman service i will try if all else fails. -
Previous Foster 'Carer' not saved money for the children.
Paul Walton replied to Paul Walton's topic in General Legal Issues
Hi Ethel, Sorry for the delay - yes, my typo ! I have the children via an agency. Money is saved for the children, before I get the allowance. Even with LA children they should save a certain amount for the children in care. I believe this is compulsory. I have requested help from social services, and informed the IRO ( Independant review officer) I have been informed they have, in the past chased Foster Carers for savings. Just seems very unfair, they have just spent all the money. -
I have two long term foster children with me. The previous 'carers' should have not opened saving accounts for the children, this has never happened. As a result they are 4 years in the system with no savings. I have reported this to the social workers who are looking into this. They are obliged to do this whether local authority or private agency. Questions: The Local Authority have 'Corparate parental responsibility' for the children, so they should have checked this was happening? Can I chase them? Can I contact the previous carers on behalf of the children and ask for payment ? I view this as at best immoral and worse, well words fail me. Stealing from venerable children?

Well, what a kerfuffle! My experience with legal issues are let the legal people do their job. I'm sure your solicitor would advise against not posting on here. I posted my problem and received good, free advice. My problem was resolved. I'm more than happy to support my case with evidence and supporting documentation. As always, there is more to add and two sides to every story.

Help need with a solicitor complaint.
Paul Walton replied to Paul Walton's topic in General Consumer Issues
I instructed a law firm to carry out a review for, Continued Health Care Funding (CHC) for my mum, who is in a care home paying £5000 per month. Cost £2100, when I received a copy of the report certain 'domains' were, in my opinion wrong. They said mum would walk round collecting cups and saucers, She can't walk!! And that she could eat - she can't feed herself. There was more, but you get the picture. Today, I have had an NHS CHC review, and they 'scored' my mum much higher in most of the domains. . The NHS done a proper job, and scored accordingly. The opposite of what I expected. It's been less than a month since the law firm did the independent review, mums condition has not changed. I think this is what's happened, I have been charged £2100, they appointed a nurse who made a few calls, and maybe a zoom call and pocketed a nice chunk of the fee for her time. The information given was wrong and when I raised concerns, the report had been done people paid and they don't want to do revisit it. I have asked a refund because the report was not fit for purpose, but I'm fuming because I think i've been ripped off. I suspect the solicitor will not just say 'yeah ok our appointed nurse done a happy job here's your refund. Any advice would really be appreciated. Cheers, Paul -

I would have done the same as you, in your position. Thanks so much for your help, I've sent the advice to Mark and he is very relieved. I wish on a personal level there was a solution for Care Home fees, that situation is causing me some stress, sadlyhadr to sell mums house to pay towards the fees - awful illness.
-
All very valid points, I will be speaking with him this week and explain the situation. I think one off the most stressful things for him, and anyone in this position is not knowing what can happen, what they can and can't do. It's been a real eye opener for me!! thank you all once again. cheers, Paul

Many thanks for that, knowing Mark, as I do I think he will take this advise. It does sound to me that there is very little they can do to him. I was amazed even got such a huge credit line when he could never afford to pay it back once he hit the £75k. I have asked him for the lenders etc and will post the details once i get them. Again thank you all, cheers, Paul
