  1. Been to see mum today and there's no way she will change banks. She's also getting very worried about missing a payment and is seriously thinking about making the next payment and just continuing paying. Is there anything I can show her on this forum that might make her change her mind. She still can't grasp that if NatWest have no agreement the debt is unenforceable.
  2. I have an outstanding EON energy bill for £558 which is being collected by SRJ through the CCCS. I'm paying £15 a month to SRJ. I'm thinking of making an offer to settle this account but have no idea what a reasonable offer would be. Can anyone give me an idea? Thanks in advance.

  5. Thanks for the advice so far but here's an update. Mum didn't pay August payment and today September statement arrived showing £12 late payment charge and two months payments owing to be paid by 1st September. What is our next step please ?

  7. Just been checking through there letters and the cheeky b***ards have swapped the account numbers and repied to me using old current a/c number. Letter to them ready for posting.
  8. Finally paid this account up and sent off S.A.R. Adding up total charges on the account they have charged £1337.89. Charges range from FBS telephone cost £10 to FBS letter cost £150. Any idea what FBS means ? Do I proceed with charges reclaim same as bank charge reclaim ? Thanks in advance.

  11. After paying MCS for the last few months decided to send them a CCA request. Got no reply to the first letter so after 12+2 days sent follow up letter. Had a reply today. Got no scanner so this is what they have to say. "We thank you for your recent letter,the contents of which we note. In response to your rights under the Consumer Credit Act, section 78 of the consumer Credit Act 1974 does not apply to current accounts. The current account is not a regulated agreement because it provides no credit. The overdraft agreement provides the credit and this sits separately from the current account agreement. Credit agreements normally have to comply with Part V of the Consumer Credit Act 1974. Part V covers the form and content of agreements,signing of agreements and duty to supply copies of unexecuted agreements. However, current account overdrafts are given a specific exemption from all the Part V formality requirements by section 74(1) (b) of the act. This exemption applies only when the OFT grant a Determination under section 74 (3) and this was given for overdrafts on 21 December 1989. The consequences for this is that there is no executed agreement for a current account overdraft and so section 78 does not apply. We trust this provides you with the information you have requested.. We now require you to submit your proposals for repayment of the remaining balance within 14 days. Yours sincerely," I had an overdraft and a HSBC credit card and was struggling to make repayments on both. After taking advice from branch staff they told me my best option was a managed loan. I took this out and paid off overdraft and credit card. This letter makes no sense to me. Can an expert please give me some advice ? Thanks in advance.
  12. I've sent off 3 CCA request and had very little or no response. 1. Metropolitan Collection Services. They inform me they have requested a copy from their client, HSBC managed loan. Sent me copy of statements ! 2. Direct Legal & Collections. Egg credit card Same thing again. "Offered to supply a true copy of the document which will comply with section 77-79 of the Consumer Credit Act 1974". Will update me in 21 days of developments. 3. Eversheds. Northern Rock loan. No reply at all. The 12+2 days have passed. Do I now send this http://www.consumerforums.com/resources/templates-library/86-debt-collectors/571-failiure-to-provide-a-copy-of-the-agreement-within-the-prescribed-timescale I have a DMP with CCCS. Shall I continue to pay these creditors through the CCCS or stop paying. Thanks in advance.
  13. One more question if that's ok. Her next payment is due on 01/08/09. If she just ignores this what will happen ? She can't believe it can be so simple yet she listens to the adverts on the radio offering to make you debt free.
  14. Thanks once again for your excellent advice. I will speak to mum over the weekend and try to convince her she has paid enough to the banks over her life time. If she agrees not to pay any more money to the thieving so and so's will I have to write to the bank and if so what do I need to cover in my letter ?
  15. Thanks for that good news, but mum insists on making the payment back. Don't know why but who am I to argue. Is there a template letter available to send asking them to stop charging interest ? This is what's breaking the bank.
  16. We have had a reply from NatWest. Haven't got a scanner so will type it out. " Dear Mrs XXXXXXX Re account number XXXXXXX I write with reference to your recent request under section 78 (1) to supply copies of the original agreement set out under the Consumer Credit Act. We regret to advise that the agreement has been misfiled and despite searching our records we have been unable to locate it. Regrettably we are unable to comply with your request made under section 78 (1) of the CCA and return your £1 you paid. Notwithstanding this the agreement remains valid, and we expect you to continue to meet your obligations under the agreement. We should point out that if you cease to make future payments as they fall due we will report the default to the Credit Reference Agencies. Section 78 (6) 'Unenforceable' only prevents us from pursuing recovery of the debt through the courts. I trust this clarifies the matter for you. Yours sincerely Miss H Bennett Team Manager Cards Customer Services " They also sent her a letter that is sent out when a new credit card is issued but no new card, and a copy of Credit Card Agreement regulated by the Consumer Credit Act 1974. Also a copy of her June statement. Do we have any course of action after this letter ? Thanks in advance.
  17. Just an update. Sent CCA off and it was received on 16/06/09. We've had no reply so what is my next step please ?
  18. I sent a CCA request to dlc regarding an Egg Credit Card account. Got their reply this morning. I don't have a scanner so will copy it out word for word. Dear Mr XXXXX Account number XXXXXX-Egg Banking Plc Thank you for you letter dated 12 June 2009 regarding the above account. I can confirm and advise the following :- 1. I acknowledge receipt of your payment of £1 in association with your request for documents under section 77-79 of the Consumer Credit Act 1974. 2. This account has been assigned to Hillesden Securities T/A direct legal & collections to collect on our clients behalf. 3. Your request under the Consumer Credit Act 1974 would normally be made directly to the client that legally owns the account, in this case Egg Banking Plc, however, we will put a request in to Egg Banking Plc on your behalf for the documentation required. 4. If we are unable to forward a copy of the original agreement, we will be able to supply a true copy of the document which will comply with section 77-79 of the Consumer Credit Act 1974. Should you require anything further at this point please contact me accordingly. I will update you on developments in 21 days if there are no developments beforehand.   22. That was my thoughts but she just wants to keep on paying it. The trouble is minimum payment is about £100 and they are charging £90 + interest.
  23. Hi Scott. Thanks for the prompt reply. Shes had the card for over twenty years and never been late with a payment. No charges at all.
