Thank you for your letter dated 19th August 2009 the contents of which are noted. In your letter you make reference to requiring my signed authorisation before you comply. If it is for Data Protection purposes then I can happily supply you with documentation to substantiate my identity to you. However, please note that, to date, you have happily sent statements and correspondence containing extensive sensitive private information to my address. I have to ask - if you are concerned that you are corresponding with the correct person why has it taken so long to raise this.? As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998: 7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data My CCA request was made on 12th June 2009 and the 12+2 days for your compliance expired on 3rd July 2009. I note that there is no provision that removes the requirements of the act to provide this information on time, even if you are unsure of my identity I look forward to receiving the documentation requested Regards

  5. Thanks johnnymitch. I like the sound of the letter. Can't understand why they have decided to correspond with my wife when I have been writing to them. Also they still have the wrong account number. Just putting another letter together.
  6. Had another reply today. I'll type what they have to say. "Thank you for yor letter dated 15th August 2009 concerning the above account." (they still have the wrong account number) "After reviewing the contents of your letter, we can confirm that it does not contain a legitimate signature for verification. Please may we respectfully ask that you resubmit your request and ensure that the letter contains a valid signature. We trust this clarifies the matters." The managed loan was taken in joint names and I have been putting my name on all correspondence yet they decided to write to my wife this time. I've read on the forum not to sign anything but where do I go from here ? Thanks in advance.

  8. Im not an expert but we were in a similar situation and contacted CCCS. They arranged an affordable repayment and creditors were contacted by them offering pro rata payments. They don't charge either.
  9. I bought it off the internet. Thought I'd made all payments but on checking bank statements I have not.
  10. Cabot have wrote to me today with a copy of agreement. Will someone take a look to see if it's enforceable ? One thing I have noticed is where Hitachi have signed has been blanked out and written over. Also received a letter from Hitachi Capital saying outstanding balance is £898.07 but Cabots outstanding balance is £1006.43. The debt is now owned by Cabot. If agreement is enforceable is it worthwhile offering F&F settlement or adding the debt to CCCS DMP ? I've also attached copy of statement. I can't understand it. Sorry for being a numpty but how do I add an image ? I've edited them on Photobucket.
  11. Sent off CCA request to dlc and got the usual letter saying they are not obliged to provide a copy bla bla bla. Today I received this letter. Can someone take a look and advise me what if anything I need to do next ? Thanks.
  12. Mum is going to make her payment next week even if we've had no reply from CCA follow up letter. Just starting to prepare a letter requesting interest to be frozen. Can someone take a look at this and add or remove as they think ? I'm not very good at writing letters. Thanks. "Although the alleged debt on the above account is legally unenforceable I feel morally obliged to make payment. However I will only do so if interest is stopped and all unfair charges deducted from the account. I propose to pay £100 a month until the account is cleared. I trust you will carefully consider the above request. Yours sincerely "
  13. Not sure Freddie but someone will be able to advise you. I sent off the standard bank charges reclaim form.
  14. Thanks for the reply. I've sent off follow up letter to CCA request so will wait and see what reply we get if any and then try to negotiate payments later.
  15. I think we have decided what to do. Mum is not sleeping with worry so she is going to pay what she can afford and we are going to make the difference up to the minimum payment. What's the chances of getting the interest frozen if we do this bearing in mind they have no CCA?
  16. Spoke to EON today and the original debt from them was £856.26. This is the same balance that CapQuest started from. The debt is still owned by EON and is now being collected by SRJ. I asked EON if they would consider a F&F offer but they require the full balance of £558.92. Puzzling thing for me is if the balance to be collected by DCA is the same as original balance and no charges have been added by DCA, how does DCA make their money?
  17. Not sure what total bill was. It was originally being collected by Capquest. Original balance was £860. Been paying £15 a month since October 2007. For some reason debt transferred to SRJ towards end of 2008.
  18. Not spoke or written to them. Just been paying them through CCCS. Is there a template letter on the forum to send? I'm rubbish at writing letters. Thanks.
  19. Try has I might mum is going to pay this debt. Her way of thinking is "I've had the money so I must pay it". What are the chances of getting the interest frozen? If there is a possibility of this what do I need to put in a letter? Thanks again.
  20. We moved away from the area so they are collecting through DCA. Thanks for the replies.
  21. Just received this CCA from Eversheds. Would someone please take a look to see if it's enforceable? Thanks.
