Hi Karne I already had that bit from Alan, on your thread bookmarked and I've copied it nearly word for word. I have also E-mailed my trainee solicitor (who incidentally called me 'he' all the way through the written defence!!!), and informed her that the AQ will be at the court tomorrow unless they settle. I told her what I'd put on the form so she will hopefully be aware that it's similar to yours, and others, and that WE KNOW WHAT WE ARE DOING and will not back down. Thak you so much for your continued help and support:)

Mine hasn't been closed - they think I still owe them money so they won't close it. They threaten this to people, but I personally have not come across a case where they have followed through. It seems to be more us closing our accounts ourselves, and moving on to pastures new. Once we have a parachute running of course!

Total and interest is all that is needed at this stage. Use the spreadsheet from the library to calculate your interest. Then you can send in the spreadsheet when they want your 'particularisation' of claim. This has been enough in all the cases I have come across. Good luck -

If you find you are refused try Natwest STEP - no credit checks! It's easy online too - just go to: NatWest - Current accounts - Step account There are others with similar accounts and no checks but I chose this one and I have no complaints - quite the opposite in fact. Good luck

I've been doing a lot of thinking and this has only just occurred to me. When I wrote to the judge in July I told him I agreed to the set-aside but his response was to insist that Abbey/DLA make a full application. They did this on Wednesday. Now, did he do this to have a look at their argument in light of the information I provided in my letter (Whizzkid and NeilP being the main cases), and is he therefore thinking about NOT allowing the set-aside? Otherwise, why insist on a full application for a full set-aside hearing when I have already told him I agree to the set-aside? Any thoughts anyone?

Only just come upon this thread as I have been away and you wouldn't believe evrything that can happen in a week! I think as more people are discovering the site it's becoming increasingly difficult for the mods to get round everybody as often as they used to. Don't get down about this. We are all here to help and you seem to be doing just fine. Karnevil is never too far away and she gives lots of sound advice.

In the 1980 Limitation Act there is a 6 year limit. I believe the relevant section is: An action to recover any sum recoverable by virtue of any enactment shall not be brought after the expiration of six years from the date on which the case of action accrued. However, there are people challenging this is they have their account information going back longer than 6 years.
