  1. Hi All, finally got a full and final in the post this morning. Talk bout last minute! Thanks everyone for your help, I couldn't have done it without the CAG members - now Im off out to spend some money!!!
  2. Does anyone know if there's anyway I can refer the court to this programme, I've got my court case Tomorrow (Friday), so none of this was in my original court bundle which was submitted weeks ago.
  3. Ive got my court case with Barclays this Friday, pity its too late to submit the programme in my court bundle.
  4. Well, I wrote to Barclays last week to point out their non-compliance in sending their court bundle, and I've emailed Krista Campbell directly, but they're still not responding in any way. I think they may want to go all the way cos the case is this Friday!
  5. 3 days and counting - I've just confirmed with the court that Barclays haven't sent any documents to them either. GaryH - I dont think I can claim any costs because I get income support (Im a full time carer) so the court waived my costs.
  6. Thanks for all your input lads, I've followed GuidoT#s advice and sent the letter he linked to. Hopfully it'll prompt a response, but they've only got 4 days left now.
  7. no, I havent had their court bundle. I haven't rang them cos I didn't want them to think I was 'waivering' which of course Im not - just not looking forward to appearing at court if it should come to that. Still, one way or the other I suppose it'll all be sorted pretty soon!!! Well done on your settlement - it must be time for a drink!
  8. I take it yours was a settlement offer? Apparantly my case is to be heard with a whole load of others next Friday. It looks as though the court as put aside a whole day to hear bank charge cases.
  9. Well, its taken a while but Im only just over a week away from my day in court. OK, I admit Im really nervous about it, but at least things will finally get sorted one way or the other. Wish me luck...
  10. Hi All Ive read the other posts and the guide but they dont seem to answer these particular questions. The court sent me a N150 rather than the N149 AQ, I think that this is a more detailed questionaire than the standard N149. Thanks

I have just received an AQ from the court and I’m unsure about a couple of the questions, can anyone help with the following bits: It asks if I’ve sent a copy of the completed AQ to the other party. Should I send it and if I don’t will the court? Location of the trial. I assume I can just put my local court but is being a full time carer justification enough? It asks how long I think the final hearing will take in days, hours and minutes. Any ideas what I should put. Thanks in advance for any help you can offer
  12. I've gone through the process described on this site and sent off all the appropriate letters etc. without much joy from Barclays. They did at one point offer me a miserley £90 in full and final settlement from a claim of £1090. Anyway Im going to take my N1 and shedule to the court tomorrow to start the proceedings. As Im a full time carer and so on a very low income I will be entitled to have the charges waived. My only question is on the N1 form should I still claim for court costs (wont the court want these - as they are in effect paying my fees) or should I leave the court costs off my claim altogether.
  13. Hi Lilly Yes, Barclays will do anything to delay the process. I must admit me and Barclays seemed to get into some sort of letter writing competition at one point. Looking back on it, it was all unnecessary, if I were you Id establish your timetable now and stick to it, don't let Barclays deflect you with pitiful offers etc.
  14. I sent my first letter on 20th September and their reply was dated the 26th September. The letter was a standard one thanking me for taking the time to write and giving a date by which time they would respond to my request.
  15. Hi Lilly it sometimes takes a week or so for the delivery to show up on the royal mail tracking site. In fact Ive got a letter going back to September that's still not showing, but I know it was received because Ive had a reply. I dont bother with recorded delivery anymore, I just get proof of posting which is free.

I was just wondering, has anyone actually submitted a 1974 Act complaint to the OFT on the grounds that a bank is not a 'fit and proper person’ to hold a consumer credit licence under the Consumer Credit Act 1974, because of their illegal charges. I've seen this refered to quite a few times but I couldn't find anyone that had actually done it.

  19. Hi all, I’ve recently sent the initial letter to Barclays requesting a refund of the £1090 charges. I sent the letter on 20th September, and I’ve just had a response dated 26th September saying the following: Dear Mr Pritchard We are sorry you have had to contact us about the level of service you have received from Barclays. Thank you for taking the time and trouble to do so. We are looking into your concerns and will let you have an answer or update as quickly as possible, but no later than 19th October 2006. In the meantime if you wish to discuss this matter further please call us on ……. Blah Blah Blah My question is should I wait until Barclays deadline has passed or should I stick to my own deadline as in my initial letter? Any advice on what should be my next move would be much appreciated
  20. I’m looking for some help or advice with a problem I’ve been having with Powergen. It’s a bit of a long story but ill shorten it as much as I can: Powergen supplied both electricity and gas with my bills being paid by monthly direct debit. After my mother had a serious road traffic accident, I moved her in with me and I had to give up work to act as a full time carer. This meant a fall in salary of over £20k. I contacted Powergen customer services to explain my situation and request the installation of pre-payment meters. I understood that I would be paying more for the energy I would use but I wanted to avoid any possibility of going into debt. Customer services agreed that this was a sensible course of action and the pre-payment meters were installed shortly afterwards. For the 12 months that I used the pre-payment meters I maintained an ongoing credit balance on both meters of around £30. I was very surprised in early 2006, to be informed that I owed Powergen in excess of £190, even though each of my pre-payment meters showed a credit balance of around £30. After conversations with customer services it transpired that one of the meters had been incorrectly setup. I was very disappointed that I had (through no fault of my own) fallen into debt. However I agreed that I would pay off the debt at the rate of £10 per month (despite a suggestion from customer services that I should pay only £1 per month). Over the next few months I received several letters showing my account balance ranging anywhere from a £3 credit to a debit of £157. None of these amounts tallied in any way with my online statements available through the Powergen website, or the amounts showing on the meters. At this point I had had enough of Powergen and arranged to change supplier. I also set up a standing order to continue to pay Powergen the agreed £10 per month to pay off the outstanding amount. I continued to receive demands for payment and threats of legal action despite our agreement of £10 per month, the last of which was dated 18th September 2006. My last call to customer services was on 22nd September 2006. The reason for the call was to request once again that they stop demanding payment and threatening legal action given that we had agreed terms for payment to be made. Customer services have denied all knowledge of any agreement, they also claim they have no record of many of the conversations that I have had with them in the past. The lady finished our conversation stating that she intended to pass this account over to a debt collection agency. I requested to speak to the manager and was passed over, the manager has now once again agreed to the £10 per month. Well as you can imagine I’m really pi**ed off with them. I’m not sure what I want Powergen to do (if anything) Im just so furious that I really feel the need to vent some anger. Any help or advice complaining would be much appreciated – Ive got nowhere with their customer services – maybe a letter direct to the CE? Or should I just drop it?
