  1. Received no credit to my account despite the promises above, so I wrote to them. Have just received a cheque from M&S Bank for £75. Accept, or letter before action? Your suggestions would be very much appreciated. Why have they not sent £125 as promised above?
  2. I wrote to M&S to tell them their £20 gesture was insulting and that, if I didn't receive a sensible offer I would send a letter before action. Just received a letter from M&S saying "sorry we've caused you upset". Other details extracted from letter.... As the breach of data occurred before 25 May 2018, article 17 of GDPR isn't applicable. "The ICO has contacted us to confirm they're aware of this breach and that we should deal with the matter internally....." "As your data was sent to another data subject, it wouldn't be appropriate for us to confirm their name to you." "The third party who received your information from us incorrectly notified us of the breach. They returned the documentation sent to them in error, at our request." "I've applied a further credit of £105 to your M&S Credit card account........and brings your total compensation for this matter to £125" ".....if you chose, you could use £20 as payment for Cifas Protective Registration for 2 years". What do you guys think?

  4. Called CAP 1 today and requested payment details and they referred me to Frederickson. Guess I'll have to call them even though they're not the OC because the debt is enforceable?

  6. Thank you dx. I have been paying this debt off at £5 per month on a DMP since 2012 but now I am going it alone. But I don't have their bank details. Can I not expect CAP 1 to continue accepting this amount or should I send (another) I & E as per your link in the previous post.
  7. I am just about to send a letter requesting bank payment details so that I may continue to pay this debt as it appears enforceable. Does anyone think I should do otherwise?
  8. No, I haven't received anything from M&S regarding the CCA request, which incidentally was sent to Cabot. Cabot replied stating they "have requested the relevant details, which will include a copy of the credit agreement, statement of account and original and varied terms and conditions from the original lender". This reply was dated 26 March 2018. I then received the M&S letter dated 30 April, but no copy of what they sent.

  11. Thank you dx. I am not in a position to pay this debt and so will have to negotiate a monthly payment. I have no details of where my cheques were being paid (Frederikson?) and so will have to make a call.

  13. Thank you, I understand. Have sar'd Twinpier. I'm unclear, though, what the next step is in the case of an overdraft that's being handled by a DCA. Should I CCA the OC, ignoring the DCA?
  14. Thank you for your reply dx. Have read the link. Have informed DMP we have stopped payments. Will CCA all DCA's for credit/store cards, SAR DCA's and OC's for overdrafts (using original reference no.s), and pay HMRC direct. Does this sound correct?
  15. Hi My partner and I got into a lot of debt after we became self employed in 2004. When things got bad we kept the company from going under by using personal credit cards. Credit was easy to come by; we had one credit card (MBNA) with a 20k limit, as well as several others. Following a heart attack in 2006 I had a Critical Illness insurance payout, and used much of the 47k to pay off some of the larger debts. However, when the credit crunch of 2008 occurred, business suffered and the debts piled up again. We took out a DMP in 2012, costing £50 month in fees and paying our creditors £5pm, and £20pm to HMRC for Tax Credit over payments. Total monthly bill £150. I have been reading the CAG debt forums recently and this has given me the confidence to cease paying the DMP company and have a go at dealing with our debt myself. I have SAR'd the DMP and hope you can help me going forward.
  16. Tom Hickey called me today at 11.35. Said he would be sending me a settlement letter, but his settlement figure fell short of my expectations. He hadn't included the £100 AQ fee or updated 8% interest to today. I asked him to do this and he did. Made a difference of £160. I strongly recommend anybody calling B's for a settlement to have a figure in front of them that they are expecting to receive when they phone. If I hadn't, I would have accepted a lower figure and that would be such a shame after 7 months of waiting. Anyway, received fax at 12.00, signed & faxed back acceptance at 12.30 (after deleting confidentiality clause), just checked my account & it is £2738.98 better off than it was first thing this morning! Which means I've won! Can a mod put me in the successful claims list please? Thank you one and all for your fantastic help on this amazing site. Will be donating, naturally.
  17. Called Krysta @ B's today to seek a settlement. She has given me the name Thomas Hickey as my contact. He is due to call me back as I haven't had a settlement letter. The court case is one week today.

  21. Hello everyone, its nice to be back. Got v.ill the day after my last post and have been recuperating ever since. Now, back into battle! Have spent the best part of the last 12 hours putting my Court bundle together, it makes 114 pages in all. Been reading some threads where people are just not bothering with bundle because no one is ending up in court, but I'm not going to chance it. Any thoughts on this? Should we still be bothering spending such a huge amount of time and effort on a court bundle if no-one is going to read it?
  22. Hi all, just returned from two weeks hols and have received my court date and time, 10.00 on 8 May 2007 at Oxford County Court. Copies of all documents (including any experts' report) on which I intend to rely at the hearing must be delivered to every other party and to the court office no later than 12 March. I guess this means my bundle!
