    to cut a long story short! i sent SAR 20/01/07 received statements but they are incomplete sent Letter3 in templates ie after 40 days still no word, T4FF has tried to help but now i am stuck 1- do i file with CC N1 using template in CAG OR 2- complain to FOS if so how? can anyone help me this is the first time this has happened and it is very confusing to which track is best. thanks for your time and help!   7. yes , it can make interesting reading and can remind you to close any inactive account, but to make sure you can always write to them to get confirmation. good luck

Hi t4ff firstly hope you can help point 1 - account closed! but have a copy of last statement with account number! sent general SAR request letter dated 20th Jan 07 statements arrived with covering letter dated 24/02/07 statement 1 in bundle states balance carried forward XXXXX opening balance XXXX all debit balances i would have thought if it was the first statement opening balance would be £0.00 after looking on the site i sent the letter posted below Bank of Scotland Card Services Pitreavie Business Park Dunfermline Fife KY99 4BS LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 Dear Sir/Madam Account: xxxxxxx I am in receipt of the documents that you have supplied in response to my Data Protection Act information request dated 20th January 2007. The disclosure of personal data is incomplete in that at least the following documents are missing. 1) You have failed to provide a complete list of transactions and charges, I was under the impression that I have held the account for longer than that the first dated statement of May 2005, I believe it was opened approximately 12 months earlier. 2) You have provided no notes, or documents relating to instances of manual intervention. This is not an exhaustive list by any means; it is just an example of some of the information I am missing. Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998. The time for compliance with my request has now expired. If you do not comply fully with my Subject Access Request within 7 days, I shall apply to the County Court for an order to enforce compliance, together with damages at the discretion of the court. Yours faithfully, dated 27th feb and posted 2nd March i am not sure of next step as i have not come across this before as my other claims have been compliant. Hi jwhite these are the letters i sent GE Money PO Box 848 Liverpool L71 2XX 23rd February 2007 Dear Sir / Madam ACCOUNT NUMBERS: XXXXXXXXX I am writing to complain about the data entry you have added to my credit file showing that I have made a late payment / missed payment. I wish entry to be removed as I notified you that the payment had missed due to switching banks and payment was made promptly by cheque. I have been a customer of GE Money since 2002 and my account has run smoothly until this little hiccup therefore I think it is unfair that you have put this black mark against my credit file. I request that you remove this mark as a gesture of goodwill as you have done with the charges. For your records I enclose a copy reference of the credit reference taken from Experian I have also added a note on my credit file stating this “mishap” was due to switching banks and not due to anything else. Please note I will take my complaint to the Financial Ombudsman if I do not receive a satisfactory response. I look forward to your response. this is a copy of the letter i sent to ge money HSBC i just phoned first with my original complaint, and then replied to their response, and then follwed that up with another letter this week this is the letter i sent to them HSBC Bank Plc Harry Weston Road Binley Coventry CV3 2TQ 5th March 07 Dear Mrs Bailey Ref: - XXXXXXXAC Thank you, for your letter dated 13th February 2007 regarding my complaint regarding adverse data held against my husband and my name, I have recently checked with both Experian and Equifax regarding adverse data held and it still shows to date that the account XXXXXX has still having adverse data against my husband and my name. My initial complaint was that ALL adverse data was to be removed against ALL accounts held with you and as of date this still has yet to happen. Therefore I will give you a further 7 days to amend this data before I take this complaint further to the ombudsman as I have already given you 21days to comply with your response to my previous letter. I have enclosed a copy or your response and a copy of my original letter for your records. For your information I have added a notice of correction to my files held with Experian and Equifax stating the adverse data was due to excessive penalty charges, which you have refunded.   10. yes there is a way to check go to creditexpert.co.uk or Equifax.co.uk you can have a free 30 day trial, also you can add notice of correction (all explained on site) it work for me with HSBC & GE Money supported with a letter i have just checked my file and they have ammened data just wait for A & L though if it is a true default you may need further advice my was just stating (late payments) missed payments but it worked, i used some info on this site in my letters will post them later if i can do it hope this helps Vicmar _______________________________ tip my scales if useful

PLEASE PLEASE READ THE FAQ section this will answer most of your questions and please read some threads to get the jist of timescales and procedures, make sure you also follow the steps by step pathways and stick to timescales it does work but you have to be pateint about it. Hi sent for DPA letter 20th jan received copies today but i think they are incomplete i have checked my credit record but i can't find this particular account number listed just that, the earliest statement if from may 2005 with a debit balance with a credit payment indicating there must be some more earlier statements , the covering letter attached states "i refer to your communication and enclosed a copy of your statement" i believe there is a letter regarding non compliance can i use it in this circumstance please advise Vicmar:confused:

  18. advice please just won claim with A&L but just noticed they are about to add £75, charges over draft and already claimed from my account £68.00 failed d/d again not processing money quick enough , iam about to send "thank you" for cheque will i be alright to request these back, £75 is to be added on 3/3/07 i also want my credit file ammending they have not defaulted but have but black mark (non-payment / failed payment notices stand at 2) against both my hubbies and my name caused by charges any help would be grateful (i lodged this similar complaint with HSBC and they stated they will ammend still waiting) i have though, but a notice of correction on my file to see if this helps any good advice please Vicmar
  19. yes on paper good bank but very very slow at updating accounts , they take debits & charges before credits , this way the create more of a debit balance this is how we ended up being charged all the time!! it you want real time banking HSBC are the best at this but again their charges are high (just reclaimed £3600) back from them hopes this is of help vicmar
  20. hi just stick to the timescale , you will probably end up filing a MCOL i have just received refund of just short of £2000 after starting 8 weeks ago ,(charges accumulated over 10 mths (across 3 accounts) ) send everything to the same address i used bootle, with a copy of your schedule good luck ,make sure you down load your statements Vicmar if this has been help please tip my scales
  21. well after pondering i have decided to send a letter of compliant regarding the credit file entry stating that the payment was not late and the error was due to switching banks etc lets see what happens !
  22. GOOD NEWS!!!! ALLIANCE & LEICESTER PAID UP TODAY :D :D although they say they have review my claim they have in this instance they have decided to pay! but..... as we do not accept the terms etc ... we will be contacting us shortly regarding its future operation! i am right in thinking this is a threat to close our accounts, though i thought they where no longer allowed to do this as it is classed a "fight back"??
