  1. Hi I am trying to reclaim my cousins bank charges (i have already done mine with another bank) but I dont understand there charges. They have sent her all the statements and a second letter with a list of charges on it. They are: O/Draft Excess Fee Account Charge O/Draft Interest What of these charges can she claim back, its only the O/Draft Excess Fee or is this list all the charges that she can claim back. I posted a question in the forum last week regarding my court case: Question: I have got my court date for 13 March 2007 at the local county court in Reading, the claim is for £2490.00 plus the interest at 8%, do you think I should carry on with my claim as I have gone this far. I am not claiming any late payment fee etc. Answer: You've already paid your court fee and allocation fee. There is no trial fee for small claims. Although the further costs you could incur would be for your bundle. Your options are: 1. Withdraw now. - You lose your court fees and a/q fees already paid and they could seek their costs pre -allocation. 2. Withdraw on condition they will pay your fees and not seek any costs from you. 3.Try negotiating a lower settlement eg half of your claim + Costs 4. Pursue the full amount to court. If you lost you would lose the court fees that you have already paid. You would not be liable for their pre-allocation fees but would have to pay their travelling expenses etc. Well since then I sent a letter to Halifax with a settlement offer and Halifax have appointed a solicitors called: DLA Pipers so I sent them an email yesterday and attached my letter to them. They have now came back with a reply, stating that Halifax will not accept the offer but will drop there charges if I reply by the 16th Feb 2007. They also state that as it was a joint mortgage and I only put the claim in my name that it will fail in court. I put my names on my bank charges and managed to get these back. We had joint authority on all our bank accounts etc. the funds were credited to a joint account. What do you think my best option would be, are they trying to scare me or should i continue with this. I still haven't heard anything to say that it has been taken out of the small claims court. Also they state this web site and attached a copy of the posts regarding stopping action on ERC.   3. Yes the court paper says the case and allocation questionnaires filed have been allocated to the small claims track on 13 March 2007 at 11.30 in Reading County Court, it states the case should take no longer than 1hour 30 mins.

Hi I have issued my N1 and Allocation Questionaire and have a court date in March, I have been looking for a letter to approach the Halifax before going to court but I have been unsuccessful, does any one have a copy of a letter that they used or let me know what template to use.   9. Hi i have been trying to compose a letter to Halifax regarding refunding my ERF but I'm not sure what to write. Is there anyone who has written to their mortgage company after the AQ has been submitted and a court date been set. Any help would be gratefully appriciated. Lynnette
  10. Hi my nephew wants to reclaim his bank charges but most of his charges are made up of interest as the account has been closed and he hasn't been able to pay back the amount he owes. It also has snowballed so far that he is drowning as monthly interest keeps being added. I cant understand the interest spreadsheet or even get into it.   12. Thanks for your reply Zootscoot. I have a Notice of Allocation to the Small Claims Track (Hearing). It also states that each aprty shall deliver to every other party and to the court office copies of all documents (including any experts' report) on which he intends to rely at the hearing no later than 14 days before the hearing. Does that mean I have to send the court bundle? Again thanks for your help. Lynnette
  13. Hi I haven't posted for a while but thought I would update on my process. I completed my N1 a while ago and Halifax are defending the claim. I completed the AQ on 28 December and I have received a court date for the 5 March 2007. Not sure what I do now. Do I sit and wait for the date or should i contact Halifax and try to get them to pay up before going to court. Really nervous of the prospect of going to court. But nothing ventured, nothing gained. Any comments would be helpful. Thanks Lynnette
  14. Hi I am helping my sister claim her bank charges. We have gone through MCOL and barclays submitted a defence on the 23/11/06, as yet she has not received anything from the court. Is this normal or should I contact the court and see whats going on. When I did my claim it was with Halifax and as soon as the court papers were served they paid up. Barclays seem to be a bit more difficult. I hope I haven't left it to late. Any help would be great. Lynnette

Morning all, I have also WON I received two letter this morning from Halifax with their usual script just waiting for the 3rd now, this one was acknowledged on the 27th so it should be any day now. I'm so excited. I really thought that it was going to take longer for me so if anyone is feeling that way hang on in there. Good things come to those who wait.   19. Well done Mo All 3 of my claims have been acknowledged on the 23rd, 24th and 27th but not heard anything as yet. I've got a horrid feeling that it's not going to be as easy for me as nothing ever is. Again well done and enjoy it. Lynnette

  21. Hi Mine was also sent back by the courts but that was because I forgot to sign them - now thats stupid. I did 3 different claims addressed 1 to Halifax and 2 to HBSO both were passed by the courts. Hope this helps Lynnette

  23. Thanks for your replies. I phoned the court and they told me none of my claims have been acknowledged. Would it be a good idea to call Halifax and ask them if they have received the court papers or should I just leave it. I really dont want anymore delays. Thanks Lynnette
  24. Hi I have processed 3 claims to the local County Court, the Halifax have until 27 November to reply. How do I know when they reply, do I get a letter from the courts, do I have to phone the courts or do Halifax write to me??? Just getting a little impatient any comments/replies would be great.
