  2. Just got my P.O. and SAR request sent back. Apparently Egg cannot accept cheques etc unless they are specifically made out to them so I have to resend it with the payee name filled in on the Postal Order. Wonder if I can insist they stick to original 40 days? Think I will print letter and include my CCA request too. Thats a pretty poor delaying tactic...All other companies accepted them...

  4. Right checked through all my statements so just got to decide which court I will go through, what interest rate to claim and what I am claiming for. Also got to wait for 2004-2006 statements from the joint acct. OLD Mortgage Acct\Other accts I didnt ask for info Firstly my mortgage acct shows no charges etc - I think I may have to write another SAR requesting information on all other accts they hold with me except these three as I know my mortgage also had an arrears acct. Plus I had a preference acct, a BOS loan and there are transactions on my old BOS acct showing transfers to and from a couple of other accts. Some of this will be past Scottish 5 years\English 6 years but as I only recently became aware of this I may try claiming older charges, but better get prelims out for these first! OLD BOS ACCT There are charges dating through 1999 -2002. There were £50 in '99, £455 in 2000(all over 6 yrs), £420 in 2001 (£60 of these over 5 yrs), and £180 from 2002. After all the charges in 2000 I received a partial refund of £200. Joint BOS Acct So far still waiting for last 2 years statements but charges on this till then are £378. I know we have incurred more charges in the last 2 years, and lots of charges and interest since November when our acct was frozen when we were going for divorce. They kept taking money out of my husbands bank acct to take it back under our £1000 overdraft but didnt take into acct charges to be added that month so lots of charges plus interest every month. I thought our interest and charges would have been stopped when the solicitor got the acct frozen and so did husband. We havent paid off the overdraft as our marriage is rocky and the money they have taken from my husbands acct more than covers the overdraft, and thats not including all our charges prior to this I am claiming back. I have printed off my online statements (Dates back to Nov 2005), but havent had a change to enter all charges from them in yet. Not sure how to do the interest as all interest charged in last year is clearly stated and reclaimable, but prior to this, hardly got charged interest as we increased our overdraft in 2005 from £100 to £1000. Will have to have a play around with the spreadsheets and ask if still stuck! Had hoped to get the prelims and charges done on the old acct and sent off today but as some pre-date 5/6 years and I got a refund, will have to think about whether to split claim pre 6 years and within 6 years, just go for the whole lot, and how to deal with the refund previously received. Then just decide, which spreadsheet, which interest rate, and whether compounded interest or not.

  6. I'm just away to send off my LBA - if the weather improves! Still got to draft it up and get my interest rate as am claiming compounded interest (Put wrong % in prelim!) - anyone else doing this? Also, got to decide whether to claim in Scotland or England. If I go through Scottish courts can they still try and move the claim to the english courts?
  7. Just noticed I should have sent my LBA off - will see if I can get a chance to print it and send today or tomorrow. Just depends on these storms and rain as I dont want to take the little ones out in this weather...
  8. Just out of curiosity - I am in Scotland so if I go through the small claims I gather they cant transfer me down to England cos its a different system - is that correct?! Will help me decide in 3 or 4 weeks whether to go MCOL or Small claims...but am willing to go whichever route will be more hassle for Citi!
  9. You can also claim through Englands MCOL system. You need an address in England or Wales for postal correspondance. Also you must be prepared to go down to the court if it gets that far - it very rarely does though but it IS something you have to consider. The plus side of this is that it will be handled quicker (1 claim rather than 5).
  10. Received an envelope with Statements today - see they are for the 3 accts but doesnt look like this years are in there so perhaps they come from a different office. Will have a look this afternoon once I get the youngest down and see whats missing. Saw one acct had charges in '99 so will have to check totals and decide what I am going to do and how I will play things...

  12. Hiya, I just got a letter saying my statements will be sent separately on day 41 since receipt of SAR so I am waiting with my hilighter at the ready. I have 1 Halifax and 3 BOS as well as my mums halifax and my husbands BOS and BOS Visa so I am hoping to reclaim a fair amount of cash from them over all the accounts! I tried sending 2 emails to speed up the process but it didnt work for me but I know Aaronsdad (Think thats correct spelling) has some useful email addresses in his thread so you can keep chasing them up - maybe if you bug them enough you will get your statements quicker than I got mine! I am in Scotland so once I get all my statements and total up charges I will then decide whether to claim through England or Scotland on each acct - will depend on totals etc as Scotland is £750\£1500 max so we have to split our claims up here for larger amounts! But yeah there are lots of us claiming against Halifax, and getting what rightfully ours - OUR money. If you enter comments in other people threads you pretty soon have people keeping an eye on your thread and helping you out through each stage, or just asking you for an update.   13. I'm dealing with Welcome too. My loans are paid off and were originally taken through a company called Macadam Finance in Aberdeen. I kept getting top up loans with them and one time I paid over a third of the loan off two months after I took it and received no reduction in insurance OR interest. They dont list any insurance on the only loan agreement I kept but I remember when I went into their office they had a few bits of info cellotaped to a desk! Plus they followed that 1974 rule for early payment so I dont think I got any refunds when I paid one loan off with another. Was needing the money at the time and my credit rating was shot to hell although I think it was mainly cos of my mums stuff and the fact I had never had a credit card etc. I sent my SAR and CCA request (Enclosed £15 as am not sure how many agreements I had) last week to the local branch so am just waiting a response back then will ask Nightmareforbanks and anyone else on the forum if I have any kind of case. They forced you to take their insurance but will be curious to see if its mentioned anywhere as may be stuffed on that part if its not mentioned?! But yeaI dont think companies that charge THAT amount of interest should get away with the rule they use for early settlement. Good luck to everyone and I hope companies like this can stop getting away with exploiting the poor or people not so great with their finances.
  14. You can amend the LBA to say you refuse it as settlement but will however accept as part payment of your claim. Or you can just refuse and say you want full payment or nothing! Hope that makes sense...

Hiya if you dont have your statements then if I was you I'd get your SAR typed off with the £10 fee and sent off cos they are not the quickest for getting your statements together and once sent you will have plenty of time while you wait brushing up on your knowledge! And of course welcome to the site!

My 40 days was up yesterday. i have sent them 2 emails over the time and today received a letter saying that statements will be sent under seperate cover, and they dont record manual intervention. Am expecting them within the week so yes they can take ages. Your date should be 40 days after they received your SAR request (Allow 2 days for posting). I think unless you send a SAR quoting the DPA then its up to them how long they take! Might be wrong though...
  18. Sorry I feel the same and I am just in process of getting my license. If I make that many mistakes in such a short space of time I will seriously cconsider taking more lessons. I have two young babies and would hate to think I would be putting them, or any other road user at risk. If he\she drives for a living then I sympathise. I knew someone who did this and the company were always clock watching and giving drivers into trouble for taking too long when the problem was due to the road conditions or traffic. He got several points on his license trying to keep his job before he realised it wasnt worth it and went and found another job.
  19. As far as I know you tell the Debt agency that the debt is in dispute due to charges and they are not allowed to follow up on it. Busy with the little ones at moment but have a look through the threads and you will find more info on this..... Good luck!
  20. Just noticed I havent started a thread for my mums acct. Anyway posted the SAR 11/09/06. No statements yet. I sent mine off too on same day and received letters today saying that my statements will be sent under separate cover and that they dont record instances of manual intervention. I am guessing my mum got the same but as she is not speaking to me at moment! I have had to ask my sister to get the docs for me and to check if she also received the same letter.

Emailed Nicola Inett yesterday to chase this up as 40 days was up yesterday and then received a letter today dated 24th from them saying that statements will arrive under separate cover, they are under no obligation ro record manual intervention so cannot assist further on that front so time to get the hilighter at the ready I think!

  23. Probably been asked before but how do I go about getting copies of telecons made between me and Egg - in particular the ones when I originally took out the loans. Am curious to see if they gave me the option of not taking PPI but still getting the loans. I cant see I would have taken it if I had been given the option not to. I knew I was trying to get pregnant (I miscarriage before my 2 daughters were born) and had no intention of returning to work. Plus I also knew I was due to be paid off but that I would be re-employed by the new company.
