  7. Your reply before you sent the L.B.A.was nearly word for word like the one i recieved but they have offered a "goodwill"payment of £25.00. Which of course i will e-mail back thanking them in part payment and not accepting the "conditions"they quote. Keep plugging with the l.b.a. stuff i think your next step is to file a "moneyclaim"as you have given them the"28"days. Check the library/Threads to makesure. Lancsman. Hi what a strange name,welcome .you need to have a look at F.A.Q.and send a data protection act request letter detailing all your charges and wether their was "manual intervention"their is a letter in the "library"for this. do look round first before jumping inand putting your foot in.If you do it right you should get what is lawfully yours back. best of luck

Hi Sue This fiasco with the "ice cream sellers" is quite "normal"for them hence my naming them thus,as they appear to be selling ice cream instead of chasing up cases and (With names like Sechiari it's either ice cream or pizza!)making sure letters that are recieved and signed for,are actually sent on to the person dealing with "your case". When the judge ordered the stay what reason did he give?"to allow the parties to reach an ammicable settlement". Have you sent all correspondence you have recieved from the ice cream people and all you have sent to them,to the court? (Whilst the stay was on) To prove to the judge you have been attempting an "amicable settlement"(this proves on your side that you have been co-operating,also if you have sent things recorded delivery and kept the stubs you can go on "Royal mails website to see A.when it was recieved.B.Who signed for it.(Using the code letters and numbers on the stub). I would say you now wait for the court to give you a date for the "preliminary hearing" (15 minutes!) or they might give it more timei.e. proper hearing. Once you have the date write to the ice cream men telling them that as a matter of courtesy just in case they haven't recieved notification from the court the date and time is ******* whereapon you look forward to hearing their defence in front Judge *****. I have a copy of a letter i sent to them which was used to "comply with the court order"You can us bits of it if you wish.I'l p.m. it to you if you want. Use everything ive said here at your own discretion bearing in mind i "won" before the court date (day before)they paid up in full.....

  13. Agree with zootscoot and welshman you are obliged to take settlement if offered and it will be usually right on the mark of what you are claiming or more... You can write to Ms Marjorie Wilson @The Office Of Fair Trading.2-6 Salisbury Way.London.(don,t know the postcode!) to tell them of the shoddy way you have been treated by your bank AND their is a letter in templates for your M.P.
  14. Would have thought send to Lloyds with claim reference number and note to say you have filed against them. Although check the F.A.Q.might be better to wait till Lloyds solicitor,s reply to your cliam saying they will defend,which they will.(i,e,who is representing Lloyds,as it could be at the moment 1 of 2 addresses). Then you can hit them with all the right answers instead of writing twice,as lloyds don,t seem to tell Sechiarri clark and mitchell anything! Once your actual local court is appointed send them copies of everything you send and everything lloyds send you. (When i asked the clark they said it would help if i sent everything) Do check the questions though because its all been done before chuck.Send everything registered and actually check its got to the right person. best of luck

  16. Tee hee CONGRATS AGAIN do believe Lloyds have been on telly today bout charges don,t know what was said the poor dears!!!!! Sent a donation and letter to court apologising for Lloyds misuse of the judicial system. Have to see who else to write to apart from m.p.know theres a letter .keep at em...

Once it got past the moneyclaim stage and a solicitor was appointed by Lloyds,they wrote to me asking for details of "each and every alleged charge,each and every date,how i came to such a total,how i calculated interest" I told them practically from the start when they levied another charge on us that i would be claiming that.. When the judge ordered a stay "to enable the parties to reach an ammicable settlement".i got the 2cd letter from the ice cream sellers i re-iterated the following, I sent them further details(dates and ammounts) of other charges that i was eventually going to claim; "Starement number**/**th june2006.£**.**not included in Original List i would be submitting these under the same legislation and to save any further cost or embarassment.please forward these details to your client for their consideration also". I kept this information in any further communication with them and got this as part of the settlement." if you use this i hope it works for you.Ifit got to court i have no idea how you would stand putting this "further claim in"without going through the moneyclaim again but would have thought thejudge would consider it so as to not waste any more "court time and money". best of luck.grind em down to their toenails....

Lloyds are rediculous but i think with me they "found"the missing letter and recieved the fax,found that if they went to court they,d have egg on their face and settled up at the very last minute 3.0pm day before court..... I think Lloyds are the nastiess ones stick to your guns and timescales youl get satisfaction...

As far as i,m aware thats the way to do it,especially the copy to the ice cream sellers,do be sure they recieve and file it with your "stuff" I.E ring to confirm they have it (when i last rang they hadn,t got it,even though they signed for it AND Royal Mail said they,d got it!!)they are "awfully busy"selling ice cream!so things DO get mislaid....

  22. Agree with moorda Lloyds arent settling untill you are on the "courts doorstep"they may well foul up someday just hope whoever they foul up on gives em just cause to regret it! When you write to the Ice creamsellers be sure to check that they have not only recieved the letter but it is actually in your file they do lose stuffwhilst selling ice cream!!
