Could anybody offer any advice or experience on the following, I'd be most grateful; Made bankrupt 10 years ago by a creditor, at the same time the marriage fell apart, we had a joint interest only mortgage, the house was not repossessed because of a bit of negative equity. We divorced 6 years ago and I have not lived in the house for 10 years. I paid child maintenance, the ex paid the small mortgage. Fast forward to now and I have kept my affairs in order and I want to buy my own house. I have discovered that there are 4k of mortgage arrears, and the mortgage company have trashed my credit rating with experian. I received my credit report the other day and everything is in order apart from the mortgage. I have sought legal advice and because the ex would almost certainly not be able to get another mortgage in order to remove me ( I want no financial gain, after all she has paid the mortgage for 10 years) the only way will be spending upwards of 5k to get a financial order that would finally sort this mess out. My gripe is that as the mortgage company cannot pursue me for any arrears or shortfall if repossessed what is the point of them blackening my name with experian, they have nothing to gain from doing this, they are preventing me from moving my life forward and getting back on my feet again. My ex is happy to sit in the house forever she has nothing to lose, but I feel I am completely stuck and the bankruptcy has not enabled me to make a fresh start in life, my past financial affairs are still holding me back. Any thoughts on this are most welcome Thanks
  4. Yes there is quite a bit of equity in it probably about 80k - 100k . The thing is isn't this cca thing just a way of avoiding/delaying paying. What I need to know is what about the long term. Can I perhaps still negotiate a monthly arrangement. I owe the money I know that because I borrowed it ! I'm thinking about going to CAB, is that a good idea. Regards C
  5. Thanks everyone. I have a house but my wife and kids live there and I rent my own place since we split up. My wife and I have a joint mortgage on that property. Yes I work. And yes this is one of a long list of debts, in fact I've thought of going bankrupt myself to get out of this mess. Ive basically put everything that they said in my first post. Kind Regards C
  6. I owe Northern Rock over £11,000, the debt has gone from debt collection company to debt collection company. Now I have a company , connaught collections, that is saying they are now in a position to present a Bankruptcy Petition against me, and will liquidate my assets. I really can't afford to pay this money back, I know I have been foolish by burying my head in the sand, but I could really do with help on this. Thanks Ceborame
  7. Thank you for your prompt reply. I shall draft a letter today, regarding SAR and inform them that any money payments will now be stopped as I dispute the charges. I will stop the D/D's tomorrow. I will assume this is the correct procedure ?? Many thanks
  8. I have made arrangements with 2 DCA's - Lowell & Brian Carter. One is for about £1500 from Barclaycard The other is a visa from EGG for approx £4000 I pay Lowell £44/month and Brian Carter £50/month Firstly these amounts are really stretching me and I want to reduce them, how do I do this please ? Or better still as these are both credit cards I obviously received charges prior to them going to debt recovery, can I suspend all activity and challenge the amounts ? This will allow me to stop paying for the time being, and then re negotiate a more managable monthly amount with them. The next Direct Debits for both is 21st Feb, shall I stop these ? Any thoughts or advice would be much appreciated.
  9. The DPA request has long since expired, I am about to send my first letter demanding repayment. Do I now use the spreadsheet to calculate how much I want to be refunded ? I am worried about this comment in the spreadsheet thread. "Do not use until filing claim!!! If you send the bank a letter before you have given them time to pay up demanding 8% APR they will know that you do not know what you are doing and this will more than likely end up with you NOT getting your money back". C

  11. well Ive been down this road a few times !! Nat West position is they don't accept same day cash cover, why? I do not know (well actually it's so they can charge you !) . Also why it costs £76 to not pay 2 D/D's is not quite clear, but I belive it to be unlawful. regards ceborame

'With reference to your previous communication, regarding more information on my request for details of manual intervention on any/both of my current accounts. Quote ‘manual intervention by any member of your staff or any other person. I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you.’ Basically this is where a member of staff has had to intervene in my banking affairs with you , which has given rise to costs. Also ‘If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.’ This communication is for information you requested and is not an amendment to my previous communication. I would like to remind you that you have 40 days to comply with my request. The request was dated 12th March 2006' Thanks anyone who replies it is appreciated

  14. Thanks alan I received my statements today, and I've got the highlighter at work ! I think I'll write to them about the manual intervention. Can you believe this, the post office had a misshap with the packaging, and re packaged all my statements, in a CLEAR bag !!! my address , name, account number, balance, sort code all there for the world to see !! We are able to go back 7 years with regards to ordering statements on all of your accounts. I have been in touch with the Leicester Contact Service Centre who have actioned this reqest for you. Unfortunately the most we can go back in terms of years , to order statements on accounts is only seven years. I have also been in touch with our Group Legal Team, and I have faxed over your request with regards to manual intervention. However if you could contact me on 0845 301 9495 or either by post regarding this, as I am not sure what it is you are asking the bank to provide. I look forward to hearing from you, and I will do my utmost best to resolve this matter for you.' Anyone care to comment ????? Just checked my accounts online, they have taken £5 from both my accounts yesterday on the 7th April. Argh that means they taken £5 from my main account TWICE. BLOODY IDIOTS !!!

  18. I intend this post to be about my attempts at, getting NatWest to refund my bank charges.I will update as and when its necessary. I have sent the DPA request to my Nat West Branch for both my personal current accounts I have with them, I didn't send any money but I asked for copies to go back 10 years. About 10 days ago they took £5 (for copies of statements) from what I shall call my main account, and I have yet to receive anything. PS my other account is pretty dormant but has had charges.
  19. Of all the fees, charges and interest that nat west charges its customers, where do I stand on asking them to refund the following: 1 Advantage gold monthly fee £10 2 overdraft interest 3 un arranged borrowing fee 4 card mis use 5 refferal charge 6 unpaid items regards ceborame

  22. Iv'e been reading through a lot of posts and I'm a bit concerned that I should have included some payment for the info. Should I start again, this time enclosing £10? Also, I'm making a claim for refund of charges on 2 nat west accounts, do I need 2 x £10 or is just 1 payment ok ? regards ceborame
  23. if natwest have changed the policy and are trying to claw in the money-asap, what can be done then. does the whole idea of being able to claim back charges etc change. would it also be true that unless you sign an agreement accepting this they legally cannot just change the policy on your account. you must sign a contract. there is no contract between the bank and you,except for the one you sign. QUOTE:you must have an offer and aggreement.this forms the contract. i certainly didn t agree to any of the changes like card misuse.
  24. yes natwest charge me on the day also. examples include paid referral, card misuse, paying guaranteed cheques. they also charge at the end of the month too, unarranged borrowing fee ceborame
  25. Now this is embarrasing! 2 weeks ago Lloyds TSB wouldn't even offer me any form of account, not even one to just pay my wages into. We went in and spoke to a customer accounts manager, and applied with their help ! their reason was the credit score and the fact we already had an operating account with nat west. Mick
