A&L won't go to court, they can't justify the charges. However, they won't pay up until you issue a claim, either through MCOL or at your local court. As always read these forums they are an amazing font of knowledge and very empowering.
  7. Luck does'nt come into it. If they had dismissed my claim, I would have re-issued and paid the higher charge or split it into two claims. After all it is my money!
  8. Send everything registered post. They will deny having received it otherwise. When it comes to the LBA (and everything thereafter) use the Narborough address, not Bootle. A&L's internal communication is not that good, creaking under the weight of claims no doubt.

How many times did you get the computer produced letter, I used to know the wording by heart, charging you £25 for a failed item and you rang up the poor call centre worker who told you it was all above board and set out in the terms and conditions etc. and give up in despair. They rely on that. Well not any more! Go for 'em
  10. They will take it to the point of going to court, then give in.
  11. You do not ask for interest untill you start court proceedings. Go for it!

It might have been the witty way I hit the "Enter" button:grin: I think I might have misinterpreted a reply that Caro gave on my thread:- "If it is only the 8% taking you over the £5k it is still in small claims........." and MCOL accepted the ammount and came up with £120 as the fee. Just as well they did'nt file a defence and I got judgement by default (they lost the claim details!!) otherwise I might be as sick as Bankfodder. I won't make this mistake when I have a go at IGroup, they would love that!
  13. The 5k limit is before interest, they only charged me £120 odd on my claim which was just under 5k before interest and over 6k after interest was applied

  16. Petal, I claimed the £25 back (and they paid), IMO it is a penalty charge. They will claim it is for administering an overdrawn account, ie £25 for the computer to say you are overdrawn. They will on occasion repeat the charge every three days until the charge hits a cut off maximum (£50 from memory). Go for it!
  17. Just browsing your thread, these sound like a right bunch of tissers but should you be putting "without prejudice" on a LBA. You might want to produce this in court to show that you had been reasonable in trying to find a solution.

  22. I used the Narborough address, don't forget to send two copies of your charges spreadsheet to Narborough as well. Communications between the correspondence section in Bootle and their Head Office in Narborough do not appear to be the best in the world!
