  1. Court have issued the default and I have this lunchtime applied for an execution of warrant. Wont be processed until tommorow morning though.
  2. Yes thats what I thought, but I didnt want to apply if they had a certain amount of time to pay. Or do the court just tell them they have defaulted.
  3. The court have issued the default notice now, and while reading through the FAQ's on Moneyclaim it suggests that I can go for a warrant of execution straight away. Is this right ?     I think that is heis point yes. No regards for what anybody has gone through emotionaly by being dragged into this situation by the banks.
  8. While they can change the way they act in future, they cannot change the past and are open to 6 years worth of charges. As you say, they have vast legal departments, and if they thought they could defend this successfully at the moment, they would and would squash it before it esculates, there reluctance to do so can mean only 1 thing.
  9. You need to have opened an account through the branch system before you can apply for online banking. And the charges & T's&C's would be in the application.
  10. Thats what I thought they have had 10 working days, same as if it fell on a weekday.
  11. Q. I am entering judgment by default but a message comes up stating you cannot enter judgment by default at this time, why does it say this? A. This is because the defendant's time for filing a response has not yet passed. If their deadline fell on a weekend or bank holiday they are given the next working day to respond. It may also be because the defendant has filed an acknowledgement of service, which gives them an extra 14 days to respond.
  12. Tried again this morning, same page telling me I cant. Checked the court paperwork and it does save they have unitl 4th March. Will try again tommorow.

  14. Nationwide have until today to acknowledge the claim, and I just checked online and still nothing. :? Well I think nothing, it still just says "Issued"
  15. Your bank is entitles to £10 to supply you with thr DPA information. However some charge it and some dont. If you are one of the unluvky ones, they will write back asking for the £10, and therefore also getting more time. Some people like to nip it in the bud and just send the £10 straight off.
  16. Why issue a summons if you have no intention of seeing it through ? This isnt a get rich quick site, its campaigning for fairer banking, and changes in the way banks act. You will not help the cause.

  18. Nationwide have 4 days left to acknowledge the claim, and after speaking with Gary Clay they are more than likely to post it at the last minute. Just wondering whether if they do acknowlege the claim, we can get some press coverage on the back of them backing down at the last minute against Gary ? see if they will actualy get it into court this time.

  23. That even if you have a positive balance in your account, the Bank / Building Society can shut your account, but cant put any sort of default on it ?
