  1. Thanks for this IMS. I ask a question elsewhere as i did not find any answers.Thanks for the info. No defence as such. I have three options to take with papers. 1.Acknowledgement of papers to form a defence. 2.Agree with claim 3.Agree with part of claim. It is my intention to proceed with only agreeing to a part of the claim.In other words are balances are of difference.I wish to argue this point on the fact that charges were levied even after sending letters to MBNA informing them of my difficulties and my inability to pay. It is interesting to note that you say i have to send claim to DLC. This seems to be conflicting information as provided previously.If this is not a problem & does not matter then i will put it into process with DLC if this is correct.I thought that my agreement was with MBNA & not DLC.I have never had an agreement with DLC.   2. Thanks. I have received a court claim for a certain amount but i do not agree as the balance it is made up of charges & also interest on those charges. I mean to fight the charges/interest if i can acquire the information needed. Anymore info required i will supply. Thanks again
  3. Hi Dont know where to ask this. I am in the throws of reclaiming charges from MBNA & need advice on the APR on the Spreadsheet. Have put all dates but i cant seem to locate any info on APRS,even on statements. This is forms part of a court case of which i have i have 10 days left. So time is of the essence.Any help appreciated. Cheers

  5. Ok Spoke to DLC. Did not really want to know my offer. They are quite prepared for it to go to court, get judgement then go back for Charging order when they refuse any payment plan although they could discuss a payment plan but it wouldn't stop the matter going to court. i am offer a defence that i do not agree with the amount they are claiming because it consists of charges & interest on these charges. So i need to send of claim letter to MBNA but i need some help on the spreadsheet regarding APR. Also another quick question regarding Charging Orders & the Land Registry. I have 3 other loans attached to this property, firstly Mortgage second & third are both secured loans which i think more or less sees it to the value of my house. Can i ask if the land registry can allow charges to be added & does it also require the consent of the Mortgage lender? Any enlightenment appreciated
  6. Hi cb I have been a bit lax of late mainly to do with work. court papers came through the other day along with a default charge from DLC which is to cover their solicitors costs. I have just filled out spreadsheet for charges which total £156.00. Could you tell me where i would find the interest rate APR. I can not find any info on original statements. I am planning a different form of attack at the moment. Its called a damage limitation exercise. I am in a fortunate position that a relative will make a payment as long as it is a greatly reduced payment, that it is in full & final settlement & that the matter is kept from court or charging orders. It is worth a try but if it is not accepted then so be it. I still want to reclaim the charges as this forms part of my offer. Hope this makes sense. Cheers
  7. Hi Thanks for your replies. So my creditors cannot re instigate the history/reporting unless they start something new before the end of the 6 year period like say a CCJ? So for example wait for 5 yrs plus then go for a CCJ & i end up with another 6 yr period? Sorry for the questions but i just trying to sus out one of my creditors moves. Cheers
  8. Hi Just a quick question. I defaulted on a number a credit cards some years ago & i am interested on how the credit file system works on this. For example i defaulted in September 2009 on an MBNA account it has since been in the hands of a debt collector for the last 2+ years.The balance will not be paid off come a six year period.Does this account keep being reported on after the six year period or if i arrange a deal with said debt collector & pay of the debt in 2 years does the six year period start after the 2 years? Hope this makes sense! Cheers

The debt is in my wife's name name.I can see what you are saying with the forcing of sale.I have an interest too.Also if they have said it is not what they are going to do ,they wont do it? I will get a reclaim letter off & see what happens & will post back when i have some response. Do i make DLC aware of what i am doing?I was going to respond to the letter in post 1 with my usual letter that my circumstances have not improved & therefore cannot increase my payments.Therefore i will continue to make my £15 payments per month. Thanks
  10. Hi Again CB So reclaiming charges would be sent to MBNA.If they agree would they instruct DLC as the account balance would not be the same or have MBNA totally disowned the account? Would any interest apply? Have you links for any letters i can send as i have got rid of all my bank reclaiming equipment.Not being lazy about going into templates just want to make sure i get the right one. Is my memory correct that you send a prelim with 14 days to respond? Back to my original post though some questions still stand. If DLC were to take us to court for payment & then seek a charging order would this open more doors for them as in forcing a sale on my house.It seems that they may send out this letter every year to keep an agreement broken so to speak & at some point may make good on there threat. Also in respect of affecting other creditors.This is the largest of the 7 we have.It is closely followed by cap1 &ppal. I will go through file to find anything with an acceptance of an agreement but i know they only commit themselves for a year at a time. Cheers

Thanks for the letter cb It would all appear to hinge on a written agreement though or an agreement.I could give you all the letter by letter date by date of the whole account as i have received & sent.I would like to know about the charge reclaim.I had done this quite a few years back regarding bank charges.Dont know if same terms still apply. Hi cb I cannot confirm that any payment arrangement was in place with MBNA ,as by a confirmation letter, other than the fact that i offered it & they deducted my £1 payments from my statements.I was not in a position to offer anymore to reach a written agreement. Am i making sense? As regards to later with DLC, they are the only creditor to keep providing trouble/hassle. If you need more letters please ask. Cheers
  13. Hi A few more Doc`s Optima Legal? Default notice MBNA Getting rid.This went to a company i think that at that time was called DTL which i presume has become DLC.I cannot find any documentation of this transfer.I will have to go into DLC folder to see if this is the case.There are a lot of other letters in between all of these especially on behalf so does not give the true history of this account.What has come to light though is the continued application of charges after notification of my circumstances,i know it does not amount to a great deal given the outstanding balance but to be charged an overlimit fee when it was mbna that was going to put me in this situation nowing full well my circumstances,begs belief. Thanks

  19. Sorry didnt see other questions. Been paying since September 2009.£1 then £5 then £10 now at £15 in an effort to get my finances under control.PPI as far as i know no good.How do you mean all paperwork.Everytime it changes we only get a notificatuion letter & who to pay.
  20. Well debt is legal in my terms!I havnt done the CCA request for some time & i think it has changed hands a few times.Its originally MBNA then is it Hillesden Securities now at DLC.

It is a set of circumstances that is worth noting for people in my situation.If it works then people are going to be had & some sort of defence needs to be approached or its a case of lump it or like it or bankruptcy? May i say that i have never disputed the debt or my efforts to try pay it,Only a way in which it is handled & the time scales. Cheers
