  1. I rang MBNA today to chase up my SAR due Monday. The Customer service manager told me what they have charged me in late payment fees over the last 6 years and then made me an offer to settle. I said I'd accept the offer as partial payment and then he agreed to refund all the charges. I said I'd like to check the amount for myself but if they were correct I'd accept. I have to ring him on Monday after Ive seen my data. His name is Paul Miney on 01244 - 672628

    Wigan Warrior is right! MBNA want to settle quickly. I rang up today to remind them my S.A.R - (Subject Access Request) is due Monday. They then told me how much I'd been charged in late payment fees over the last 6 years. They offered me half the amount as a goodwill gesture......when I said I'd accept it as part payment only they offered me the full 550 to settle. I said I'd like to check the data myself first... he gave me a number to ring him on Monday to settle! I'll let you know Monday if they do!

The customer service manager said he wanted to settle my grievance today... even though I hadn't yet made a claim. He told me they'd charged me 550 in late payment fees over the last 6 years (did the work 4 me) He then offered me 216 - the difference between the 20 charge then and the 12 pound charge they make now. I suspect that was where your offer came from. I said I'd take it as part payment, check my statements and then claim the balance. He then offered me 570 to settle. I agreed provided I could check my statements first...he agreed. Have to ring him personally on Monday and he'll settle. Lets hope his numbers are right and they settle!

  5. Hi Lee, Letter looks great - good luck! As regards your old account, I would simply ring them and ask for the details. The person dealing with your request is probably blissfully unaware of matters v mbna. Jim.
  6. Wouldn't have thought you need to pursue the full subject access? Sounds like you have enough info to proceed. I would send them a rejection letter...thanking them and accepting the 540 as a partial payment and asking for the balance to be paid within the specified timeframe in the rejection template. Their first offer was quite substantial!! I'm still waiting for my response to my subject access request. I had the same reaction as you with barclaycard and I rejected their goodwill gesture asking for the full amount...waiting for next offer. Goodluck! Jim.
  7. Hi all, Sent data protection letter and £10 fee - got statements back to June 2004. They state prior to that statements are on microfiche and not "readily accessible" within the meaning of the data act. They go on to say that these documents do not fall within the class of documents to be produced, subject to an S.A.R - (Subject Access Request)....but I can request them @ £3 per statement though? Any advice? Jim.
  8. Hi Lee, Started the same action! MBNA are a bank so you can use whatever template you like. I got a letter back after 7 days saying I'd get a full written response in 28 days. Can anyone else confirm the £50 fee for using a credit card cheque...must be an illegal charge?? jim.
  9. Hi all, I have just started an action. BOS sent statements and photocopies but watch out that they dont duplicate the information. I had to write back asking for missing statements and guess what? Got more duplicates. I also asked for copy letters outlining charges to my account....didn't get any! Still I've done the maths now and they owe me £1600. They will pay! Jim.
  10. Hi gargoil, I have also started an action v BOS for 3 accounts. Beware that they may send you duplicates and photocopies of the same information rather than specifically what you ask for. I also asked for copy letters outlining any charges made and they haven't sent these. Jim
  11. Hi everyone! Just about to start an action to recover bank charges from the Bank of Scotland (3 accounts) but at the risk of appearing stupid you need to know what you are looking for when scutinising 6 years of statements. Am I only able to claim the excess charges for exceeding an overdraft limit plus any charges for returning unpaid cheques or DD's?
