  8. The M&R arguement was always a weak one in my opinion. However there has been a few developments since the precedent against M&R was set in dad's case. Have a look at sempra for some interesting reading. Sempra Metals Ltd v Inland Revenue & Anor [2005] EWCA Civ 389 (12 April 2005) I agree it is not something that should be rushed into and is not something I would recomend a newbie either. However sempra does carry some weight for a more advanced type of claim. Regards Tanz

  10. Accurate, the charges were introduced in mid 2001. I just want to show that they were used as a penalty for breach of contract - Liquidated Damages. Hunt over now as I have got them. Thanks anyway. Tanz

  12. Hi does anyone have Barclaycard Terms & Conditions from 2001 when they introduced charges? I beleive the text is something like this: "We will charge you for any losses or costs we have to pay if you break this agreement, including if you do not make a minumum payment by the payment date, if your statement balance is over the credit limit, or if a direct debit, cheque or other item is not paid when first presented for settlement. We will also make a charge for certain additional services, the most common of which are included in teh tarriff of charges. We will advise you of any additonal charge at the time you request a service" Then in the tarriff of charges "Under conditions 16.3 of the barclaycard conditions we may charge the follow additional charges charges to compensate us for additional costs we incur if you break the barclaycard conditions. £15 if you do not make the minimum payment by the payment date £15 if your statement balance is over the credit limit" I have the T&Cs from 1999 where it simply states: "16.3.. We will charge you for any losses or costs we have to pay if you break this agreement. We will continue to charge interest on any late payments both before and after any court judgement. I want to show the change in there T&Cs from when they intorduced charges mid 2001. Please have a dig about and see if you can find these that are required by me for my claim. Regards Tanz
