  1. Got the cheque and a letter from them last Wednesday, it should clear tomorrow. I didn't see the point in going to court as they would get thier own way. I also wanted to get the allocation questionaire ASAP so I would have a bit of leveraage over them. It seemed to have worked. I sent a fax to the court explaining that I didn't object to the set aside so I didn't have to go. Apparently Abbey (or a rep) did turn up.
  2. I am on the virge of settling at the allocation questionaire stage. I don't think cahoot have ever actually turned up at court to defend, normally they settle a few days before court.

    Flexible Loan

    I too have flexible loan and a credit card with cahoot and they have never said I must pay these off and I am on the virge of getting the money paid into mu current account.
  4. Good news Abbey got the set aside so I got an allocation questionaire to be back at the court by 31st Jan. Thinking I might as well give negotiation a try I called abbey and to my surprise they were actually quite helpfull. I called on Monday to get things rolling and then again on Wednesday once they had managed to work things out. To my amazement I managed to negotiate them to refund all the charges claimed + interest+ recent charges + fees minus about 2%. I am more then happy with this as it will put the whole thing to bed and mean I can pay most of a credit card off thus reducing interest charged on it. The confirmation letter should be here tomorrow and the money should be in the bank before the allocation questionaire is due in so no need to scrape together £100 court fees. All in all it looks like another win. When I get the money I will post back here with the good news.
  5. Any body got any advice, cahoot are in court tomorrow to try and get the judgement by default overturned. Do I need to go and do I need to take any documents?
  6. Sorry, no idea about those fees. It might me an idea to phone cahoot and ask them.
  7. When cahoot first setup thier credit card you had the option to either pay interest on the balance or pay a membership fee. The membership fee assesed is just the agreed amount that cahoot charged instead of interest. With this in mind you should be putting this ammount in the credit card interest column of the spreadsheet. Hope this helps.
  8. I sent the SAR to halifax asking for info for since I opened my accounts and just before the 40 days were up I got 5 large envelopes containing statements going back to 1992. So I suppose the answer to your original question would be that Yes they can supply info going back that far.
  9. I just went on the contact us bit and asked nicley for a full list of charges and interest and they sent them for free within days.
  10. I have another question. In my original claim I didn't claim the interest charged but after going through my statements for the last year I have found that in the list of charges thay sent me they missed some off. Whilst adding in the missing charges I thought I would see how the interest added up and to my supprise it £92 in one year. Is is now possible to ammend my claim? As I am at the court stage I get that I will have to fill out an ammend claim form and pay £35 ammend charge.

I tried to buy a headboard from Argos in Leeds and when they tried to add the £4.95 delivery I asked if I could pick it up in store, they said no, it is home delivery only, I said I don't need delivering to my home, they said you have to, I said then stuff it I will go somewhere else. And I did. There should be an option to collect in store for the advertised price, this would be no extra cost to Argos and would give customers the choice. Bad customer service, thats all.
  12. This confuses me more by the day. I thought Abbey had got the judgement set aside but after a call to the court and then a letter yesterday it turns out I have a court hearing so the judge can decide on wether to grant them to the set aside. The question is, is there any point in going to court as they will get thier own way anyway. Would I be better agreeing to the set aside without going to court and then getting things moving quicker?
  13. I tried this with cahoot but to no avail, all they said was that they are unable to stop the charges. They seem to be vry bad at lying to customers.
  14. Abbey or DLA have never actually sent me a formal change of solicitors but when I called DLA they told me that they no longer acted on behalf of abbey for the bank charge issues. When Abbey wanted to get my judgment stayed they got Ashursts to send the application off to the courts. The court sent me a copy of the application through with Ashurst as the solicitor but the letter from the court still had DLA as the solicitor. I don't think the court know who is dealing this for abbey. The whole DLA/Abbey/ashurst thing is starting to become a bit of a farce. If I was you I would call Abbey and ask them who will be dealing with the case and let them know that the court still thinks it's DLA. If this does nothing else at least it might get some dialogue going so they can talk about a settlment.
  15. when DLA/abbey failed to file a defence in my case I went for default as soon as poss but then after a week I called them to ask where my money was they got were adamant that they woul get a set aside even before they looked at my claim. When they finally dug out the details they noticed that DLA had out the wrong case number on the Fax cover sheet. I tried to negotiate a settlement at the time but they were having none of it until they got the judgement set aside. They got the set aside within days and now I await the AQ from my local court. I get the feeling that if I had called them in the first place they would have found the issue got it to the court and things would be about one week ahead where they are now. It's up to you but if I was to it again I would call them.
