  1. My Claim was deemed as served on 18th August, they have until 1st September (this friday) to reply, and i've heard absolutely nothing, i'm starting to lose the will to live after reading so many peoples accounts of being made an offer 2 days or so after filing their claims.
  2. Card misuse, what a pain, i was charged 9 times for card misuse in one month alone at £10 a go, i know it was my fault if the funds were there, but surely they should stop you from using your card if this happens, £90 plus £72 at end of month for total charges...makes you laugh

  5. Well, i got a fob off letter to my LBA (must be because i refused the £700) so filed my claim at the court last week (10th Aug) received my notice of issue this morning, my claim will be deemed to be served on 18th Aug....am cackin it now

Well done, i'm waiting to hear about mine now as i filed my N1 at the court last Thursday, i did get a repsonse from my Prelim letter within a week of sending it saying that the charges were basically fair, and it was my fault blah blah, but they offered me £700, though i asked for £1500, so i then sent my LBA off and received a letter telling me to sod off in other words, so filed my N1.
  7. I think you need to ring the court up and let them know you've been made an offer and your willing to accept this, they may tell you to ring back once you receive the money in your account.

In may 2003 i was forced into a managed loan after being over my overdraft limit, behind on my HSBC mastercard payments and plus all the bank charges that were on my current account at the time, i also had a flexi loan of £2000 which i was repaying £80 per month back. After trying to pay my overdraft and charges for months (i was a single parent at time, working part time) i just couldn't get on top of it, i needed money to live aswell! they told me my only option would be to put my Mastercard, overdraft, charges and flexi loan into one managed loan (£3950), and because of my situation at the time, the only minimum payment i could make per month back was £60, which i've kept up with. Considering this was all done in May 2003, up on checking what i've paid so far, i've only repaid just over £1000 in 3 years! and from what i gather, working it out it will take me a futher 8 years roughly to pay the rest off (£2900) If i could i would up my repayments, but at the moment it's just not possible, and the thought of having that debt over my head for another 8 years or so is really depressing, purely because i'm paying more interest on the damn thing than actually paying some off my loan (i must pay at least £30-35 a mth interest out of £60) i worked out alone that the interest i've paid so far totals to around about £1200. I'm interested in knowing how to claim this back, as i should imagine it would end up i'd get more than what i actually owed in the first place hadn't they put so many charges on my current account at the time making me so overdrawn, i'm in the middle of claiming charges on my bank account at the moment, i filed my claim form (N1) last week in person at the county court, waiting to hear something now. Do i do the same (letter wise etc) for my managed loan?

I filed my claim this morning, went in person and handed it over...now i just have to sit tight and wait....on another note, i also did my mum and dads, they both got to the 'letter before action' stage and both got offers, about £3000 between them, took about 2 days for money to be credited into their accounts...so it can be done, just mines taking a wee bit longer but ahh well lol

I used the letter before action, sent it off yesterday morning recorded delivery, saying along the lines of 'thanks for your letter dated blah blah, i am willing to accept your offer as part settlement blah blah still claiming for full amount blah blah, if you do not reply in 14 days and settle in full i will take futher action blah blah'

Hi, i sent my first letter off last week (tues 11th july) i received a reply this morning from Colin Langdale offering me £700, £680 short of what i asked for, i don't want to accept this, i want the full amount i asked for plus i have a futher £30 to add, i just wondered, what letter do i send now? is it letter before action? Please help someone!!!!!

I'm new here As for the car misuse your talking about, when i checked my statements, one month i was charged 9 times (£90) for card misuse and another month i was charged 6 times (£60) it's a joke! Over the past 6 years i've worked out i've paid £1380.50 in charges So i've drafted my first letter, and it's all ready to be sent off :grin: Good luck with yours
