Looks fine to go. Include an updated spreadsheet. One question. The £8k charges, does that include compound interest? If not just be aware that the inclusion of interest will no doubt take the total amount to claim above the threshold of £10k for small claims, this is ok but remember that you will end up in fast or multi track which can lead to you being liabke for the defendants costs should you lose and they love to play the threat card.

My daughter received a full apology from the CEO office this morning. The CTU accepted they had failed to update the new address and that no action was taken to try to send the due bill to the forwarded address. The net result is that the CTU have taken the account back from Marstons and removed both the bailiff fees and the LO fee, leaving my daughter with a final bill of £8:31 to pay which has now been paid. Thanks fo the help guys, daughter is delighted that common sense has prevailed.

Have you looked into fee remission? You may qualify if you fit into certain criteria. See form EX160 and EX160a for more info -
If its itemised as interest on the fees yes but its easier to help if you post the statements as advised so we can be clear in the advice given.

Just the solicitor for the claimant and a copy to the court. Keep a copy for your own record. Add a short letter with each along the following lines: "Please find enclosed by way of service, completed N180 Directions Questonnaire. A copy of which has been served to court/claimants solicitor. (Delete as appropriate) Job done!

Am i correct that the loan was in just your own name and that you own your property in your sole name? Its important and your answer is a little unclear. -

That simple phone call BA resulted in confirmation that the CTU already had the new forwarding address yet my daughter was still told that they could do nothing and to contact Marstons. Sorry but that isnt good enough and warrants a complaint to the top.

If there was anything owing then rightly thats due. The issue is the CTU were given a forwarding address but did not use it, as far as i know all correspondence was sent to the address they had moved from, thats what i find underhand. CEO will be emailed/letter sent first thing with request to suspend any further bailiff action until issue resolved.

Exactly, could have easily been avoided and given they had a forwarding address, very underhand. My daughter has until 4th July to either pay or expect a visit which will generate a further £235 to be added. I doubt writing to the CEO would stop that from happening but if it remained unresolved after that date and a visit happened can that be removed from the account or do i need to take action to have a sooner resolution?

Hi, I'm not upto speed in this area so need a little advice. I'll keep it brief and bullet pointed. My daughter and her partner rented a flat from Apr 16 to Sept 16. Moved out and each moved back to parents homes. Updated with council tax online to advise of moving and re registering on electoral register. (i know this happened as i did it for them!) Forwarding addresses given at that time, proved as the CTU quoted the new address during a call today! Today my daughter received a letter from Marstons demanding £212, no other communication from anyone until this, hence the reason for calling CTU today, they say speak to Marstons. so, the question is, how can i get the CTU to take the account back given they had no idea any money was owed, no liability order received etc. Any advice much appreciated Thanks Martin

Dont think much about the tone of the letter, its not personal, they just want someone to fund this years Christmas party. Santander were not the "original creditor" though, GE money were so good luck with them getting the CCA. IF you get a claimform, we will help you deal with it, get those 2 letters sent then see what responses, if any, you get back. -
Lost all of my vinyl many years ago after cd's were introduced, had so many different types of record player over the years, the first being in its own purpose built box with only a volume and tone knob and a single mono speaker. Moved onto a music centre and then into the world of hifi separates. Theres just something very special about the sound of crackling through a diamond stylus that cd's/mp3's will never replace.

Read through the PoC and where you refer to regulations you will need to quote which part of the regulations you are using. For example: MCOB is section 12.5 from memory, this is what needs expanding a bit in your PoC including any other regs you are using in your claim. I admit its a little unusual at this stage that the judge is asking for clarification of which part of which regulations you will rely. -
From what i can see Andy the spreadsheets look fine but might be a good idea to upload pdf's as the . Txt files are difficult to read
