  1. No, did not see the point as I'd explained the situation to at least 5 different telephone operators so it is obvious their systems are inadequate.
  2. Hi all Having purchased a number of things from Very in the past without any hassles and always paying the balance owed almost immediately I've had (up to a point) very good service from them. A few months ago I ordered a number of items ( 3 or 4 in total) from Very and as usual, had them delivered to our local corner shop for later collection by myself. In order to accomplish this, Very send an email to me with a code that needs to be given to the shopkeeper in order to receive the goods from them. On this occasion the code sent by Very was incorrect and on calling them to sort it out it turns out they had my date of birth wrong and refused to discuss anything over the phone. I assume this was because of Data Protection issues. The attitude of the person on the phone really put me off and not in possession of a valid code I could not collect these goods. They eventually did send another code but by this time I was fed up and tried to cancel the order (also impossible to do because of the date of birth problem). The goods were never collected by me and eventually were returned to Very and I saw confirmation of this on their website. What subsequently happened was disgusting. I had 5 to 6 calls a day demanding payment for goods I had never received. After explaining this to at least 5 different people the calls persist. The account was eventually credited with the amounts of the returned goods but now they're chasing me for charges and interest on money I did not owe in the first place. The persistent phone calls and general crappy attitude of their callers eventually forced me to pay £25 to BT have our number changed to stop these calls. Now they have resorted to sending threatening letters of which the first has just come through the post. I need them to go away because after all, I owe them nothing.

  5. Hi All I am a nurse and often work the night shift which means me sleeping for most part of the day. Unfortuneatly my road and all surrounding roads have parking restrictions placed on them namely, between 10am and 10:30 am no parking allowed on one side of the road and then again between 1400 and 1430 the other. During the last two months I have recieved 2 parking tickets due to me not waking up before 2pm as I am normally shattered. (akin to a normal working person having to wake up at 2am to move their car in order to avoid a ticket). I have a scan of the 1st ticket (which I have not paid) and pics of the yellow line in question. The yellow line has been partially dug up due to roadworks and never repainted. My car was parked on what remains of the yellow line. My question pertains to the validity of PCN's issued on this damaged yellow line.
  6. web sites can be set up to produce a version of their page in the visitor's language based on the visitors ip address which is unique (in most cases) to a country. Quite simple to do. In other words, the website will see your ip address as a UK one and then automatically present you with an English page.
  7. That would be a yes , they did advise me they would be passing it on, onto whom exactly I'm not sure. I was then contacted by a different DCA initially and now it appears it has been passed onto this lot.
  8. Its probably high time I claimed those unfair charges which would more than negate the balance owed and then some. Would this be the appropriate route when really they've applied unfair charges and now threatening to take me to court for the same said unfair charges? It's them getting their cake and eating it. They are saying I owe them money when in fact its them that owe me.
  9. I have (had) a NatWest Credit Card with an outstanding balance of around £400. I recieved this letter in the post today and just need some advice in dealing with it. Having rummaged through what statements I do have over the last few years it appears that they (Natwest) owe me more than what theyre trying to claim from me in charges. Naturally I would like to dispute this claim. I saw a template letter drawn up by someone on CAG for someone else in a similar situation but for the life of me cant find that thread.
  10. I sold a faulty laptop on ebay almost 3 years ago with a working screen for spares or repair and this was stated in the auction. Buyer then claimed that it arrived with a broken screen (which I disputed as it was packaged really well). I offered a replacement screen(which is why the buyer bought the item in the first place) but Buyer rejected this and PayPal awarded the buyer a refund. I had already withdrawn the money from my PayPal account (£120 ). The laptop was returned to my address but I was away for two weeks and on my return noticed that the screen had been swapped. Basically the buyer had scammed me (I security marked the screen with UV ink and the buyer had no clue initially on how to dismantle the screen and had hacked at the fittings). Refund had already been awarded and I could get no joy out of paypal. I got fed up and left it. I am now being chased by Robinson Way, they call my number up to 4 times a day and I refuse to speak or acknowledge them. As a matter of principle I refuse to pay this debt. I am really angry about the whole thing and really shouldn't have to pay this. Any advice on how to approach this?
  11. I live in a road that has parking restrictions, I understand why they are there but its a bit harsh on residents. I have a train station nearby and I believe that to prevent people parking in my road and tootling off to London to the day to go and work, they have put a single yellow line on both sides of the road. The restrictions in place are: 1) on the opposite side of the road to my house no parking is allowed between 10h00 and 10h30 and then on my side no parking allowed between 14h00 and 14h30. Works great in the way that commuters don't:confused: take up all the residential parking. However, I work nights a lot and sleep during the day, so I sometimes get caught napping (literally) and don't wake up in time , or hear the alarm clock and I have had 2 tickets. The local council have refused to put in a residential permit system as the next road down enjoys. The no parking sign outside my house is attached to a lamppost above head height. It only has "No Parking 1400-1430" printed on it. There is no red line border , no enforcement or issuing authority on it. I have heard that due to this parking tickets are not enforceable. Which is in fact a double edged sword if it they aren't. Be nice to know that I don't have to worry about juggling cars all the time.

  13. I had a problem with Utility Warehouse, tried their pitiful Customer Services and eventually ended up with me cancelling my phone, broadband, electricity and gas accounts with them. As I had cancelled everything with them I cancelled the direct debit as well. The final payment (calculated by them was £106) which I argued that I did not owe them as they had previously overcharged me. As my direct debit was cancelled they then took payment using my wife's Switch card details. Now this is the thorny point, my wife paid one bill with her card as we had a tough month and there wasnt sufficient funds in my account to cover the bill. They then retained her card details without her permission and subsequently used it as outlined above. Rightly angered, I phoned my Bank who said that it wasnt fraud and they suggested changing cards. So we did. I approached Consumer Direct who said that Trading Standards would "look into it". Heard nothing. I phoned the Financial Services Authority who said that ity didnt sound right but as it was a utilities company and not a financial they could do anything. I then rang the Information Commissioner who said that I need to wright the company a letter asking for an explanation and if that as not a satisfactory one then I could lodge a complaint with the Data Protection Commissioner. I then asked what is the worst that could happen to the company - DPC said , they will recieve a warning not to do it again.........really???? As a last resort I approached my local Constabulary who informed me that as the card details where given over the phone and no paper work involved (only giving permission to use the card details "one off") we had given the company "Carte Blanche" to use the card details. Subsequently UW has credited me the £106 (they realised that they had overcharged me). Thats not the point, I am livid as to how they can blatantly use card details that they had no right to retain in the first palce and I cant do a thing about it. What if my wife and I had split and we were living apart - how would I explain that? Its out of order and how many other people are being subjected to the same treatment???? Any advice appreciated ....

That I have already done, said I would accept their offer but not the conditions , ie - accepting any future charges placed on my account: Dear Whoever Ref: Your Offer of Settlement Account: xxxxxxxx Sort Code xx-xx-xx I acknowledge receipt of your letter date xx/xx/xx and your settlement offer of £XXX. I accept your offer as full and final settlement only for this claim of bank charges made on my account between xx/xx/xx and xx/xx/xx(dates of first and last charge) However I will only accept an unconditional offer and will therefore not be signing your acceptance agreement I accept this offer without prejudice and I reserve the right to make any further claims should you apply future charges that may be considered unlawful under common law or in violation of the Unfair Terms in Consumer Contracts Regulations 1999 or Unfair Contract Terms Act 1977. I trust that you will find this arrangement acceptable. Yours Sincerely _________________________________________________________________________________ I sent this to them in reply to their original offer "of good faith" They'll pay me out in full as long as I agree to them applying illegal charges in the future. Thats like holding a gun to my head. Even if I do agree , surely they cant enforce those conditions which is why I am claiming back them in the first place? I could accept their offer and still claim back any subsequent charges much in the same way as I am doing already, basis of this being that the charges are unfair inspite of what I agree to/ what appear in terms and conditions? I feel this is another "delaying tactic " by the bank.
  16. I finally got a reply from Natwest, is as follows: Dear Mr xxxx I refer to your letter of xx June and please accept my sincere apologies for the delay in replying. I am sorry that you have declined our offer of goodwill in full and final settlement of your claim. Should you reconsider your decision please forward your signed Acceptance form to this office. Our position regarding your fees remains as stated in your offer letter. I trust this explains our position. Yours sincerely signed ________________________________________________________ Got this in the post. I suppose it really means Court now?
  17. Its been a good 3 weeks since I sent my letter in to Natwest , accepting the offer but not their conditions and have had no reply whatsoever. Do I now proceed Court Action?
  18. Well... I certainly do get around this forum. I have recently noticed rippling in my wallpaper , a double glazed window that has moisture inside it and my kitchen window that has a mysterious crack in it (inner pane). Minor cracks that I patched a year or two ago have cracked again and some wall cracks have appeared through wallpaper !!! I started peeling back wallpaper in places and have revealed cracks of up to 5mm wide. Cracks in the chimney stack (about 1cm wide running from top to bottom - from what I can see in the airing cupboard), front room and dining room are one open plan setup and this has a 5mm crack running horizontally where the ceiling joins the wall (about 5 meteres in length judging by the distortion in the wallpaper). Only lived here for almost 4 years. House is end of terrace and my neighbour has also noticed recent cracking in their house. o Oh , and the floor seems to be lifting. There is an incline towards the rear french doors from about a yard away- summing aint right here I have buildings insurance that covers subsidence, but I would like an insurance assesor to assist me in my claim. Trouble is I dont know the professionals from the Cowboys - Can anybody suggest a company or offer advice?
  19. Ok, now I havent sent in any court papers so I presume the bit regarding the Case number I would leave out and the confidentiality bit wasnt mentioned in their letter. Oh, and the letter was from Natwest not their solicitors so where "your client" appears would Ii just replace that with "you" ? or just forget about the whole confidentiality bit cos it hasnt been mentioned by them at all.   20. Incredible? Unbelievable? I and my wife both received letters form Natwest offering a full settlement (I didnt get time to submit a claim to the courts). They have sent the standard letter offering to pay every penny we claimed (except the 8% interest) plus we need to sign a document thats a bit confusing - if I understand it correctly it means I agree to any future charges they place on the account if I accept their offer. I'll post the full wording later when I'm back at home. Confused but happy.Or am I happy? Confused yes.

  22. I had a missed call on my mobile from this bunch - called em back only to get a press 1 for this and press2 for that. Stuck their name into Google and WAY HEY !!!! came up with good old CAG. Thanks chaps , this site has helped me out a few times now. I dont owe anybody anything so I await their next call with a certain level of eagerness ...........
