  1. Up until recently, Halifax were paying out at LBA, now it appears they are declining a refund at this stage. Anyone know when this policy change started?

  3. I understand that but it might be a lot less stressful for Lloyds and Barclays customers if they could go down this route. It might also make people more likely to claim.
  4. If all Lloyds customers employed solicitors at the final stage of their claim, do you think a judge would make a costs order to cover the claimants solicitors costs? That could get very expensive for them!
  5. I have today written to SC&M with regards to their unreasonable behavior, specifically their abuse of process and refusal to deal with authorised and regulated third parties. It would seem that SC&M are never punished for their actions, even if a Judge makes a costs order, it is ultimately their client that pays the price for their abusive conduct. I want to know if this is SC&M's policy or Lloyds. Anyway, I'm in the process of drafting a formal complaint to both the Ombudsman, in relation to Lloyds, and the Law Society in relation to SC&M.
  6. Just to confuse matters, another 7 that were issued a week later have all been issued using the same particulars of claim. My experience of Birmingham Court is very poor, they don't seem to know what they are doing and make lots of mistakes.
  7. Finally got 3 settlements to cases that were started in December. It would appear as though lloyds are settling contractual interest claims without an argument. The 3 cases were to be heard on the 8th but settled last week and included contractual interest at 28.9%. They also sent out 6 letters, 2 for each case. The first saying they were defending the claim and the second offering settlement. They are obviously all over the place and unable to professionally deal with the number of claims. SCM must be making a FORTUNE out of this. Just a word of encouragement to those making contractual claims, it does take forever but they pay out in the end.

Having quite happily accepted hundreds of N1 submissions, the court has rejected our last batch as we did not include a copy of the contract on which we are relying on for our contractual interest claim. Surely stating the rate on the N1 and including the contract in the bundle would be sufficient. It seems to be really hit and miss with the courts at the moment, one person will pass an N1 while another will reject it. It would seem that the court is quite happy to make it more difficult for people to claim, while on the other hand letting the banks get away with abuse of process. Anyway, just a heads up to those who are claiming contractual interest.
  9. You won't get in to any trouble with the claims management people, you are not operating it as a business. A letter of authority is respected by everyone other than Barclays and Lloyds.
  10. Even if you do send a letter of authority Barclays and Lloyds will ignore it :-/
  11. Also, many people are under the impression that to maintain their warranty and retain the best value for the car they need the dealer stamp. I don't mind paying a small premium but I'm not going to pay double.
  12. They all charge the same, seems pretty obvious there is a degree of price fixing going on.
  13. My car went in for a 40k mile service yesterday and I got a call from the garage telling me I needed my Haldex and DSG oil changing, new spark plugs and brake fluid. All in all the bill came to over £900, £500 odd of which was labour! Having rang around a number of specialist Audi tuning companies the average price was £550. As the sales of goods act states that the price for a service has to be reasonable, do people think I have a case for taking this to small claims? Audi main dealers are in effect operating a cartel and I wouldn't be surprised if there is some price fixing going on.
  14. This is normal, once you get a court date they will settle before that date.
  15. They might have the odd one, say if its Halifax and the client already has their statements, its possible they got their money back in 3 weeks. However, as most on here know, it takes much longer than that. We tell people to factor on a minimum of 3 months.
  16. Natwest and Halifax are the best to deal with, Barclays & Lloyds are the worst. No surprise there then
  17. Often the banks ignore these signed authorities, they do with us anyway.
  18. Slow, awkward and annoying is how I would describe them. Reached settlement nearly a month ago and still no cheque or reply to any faxes. Guess we need to go to court.
  19. As already stated, use one thats regulated http://www.claimsregulation.gov.uk and one that charges a fee that you are comfortable with. If you tell us which bank she is with I can tell you how easy/difficult the process will be and what time frame you can expect to get your money back.
  20. I was under the impression this hearing was about him getting permission to proceed with his case, he won't win today but he could lose.
  21. So lets just get this straight, don't send your statements to a regulated claims management company, send them to a person you have never met apart from on an internet forum? I'm not saying Livelylad is going to do anything bad but the double standards here are astonishing!
  22. I don't actually, I come on here from time to time to see what's happening to compare notes as it were. If we are having a delay with Clydesdale I come on to see if its a general issue or isolated to us. Would this site accept donations from us?
