You answered your first question yourself. I listened to everything they said. What I did wrong was to email my defence to the wrong email address which meant I went over the time allowed to put in the defence. Also, you say you've looked at this stuff for 6 years. It's my first time. Not easy being confronted by 6 pages of court jargon. Especially difficult after chemotherapy, Oesophageal cancer and open heart surgery within 15 months. Also, the solutions were flying in from different sources which I found very confusing.

For the umpteenth time, the email address I sent my defence to, and the email address from which they retrieved it from earlier is... :CCBC@justice.gov.uk That's it. That's where they found my attachments. No idea how, must be magic. I can't tell you any more. It was the acknowledgement email that could not be replied to. I get that. I see that all the time. All I did was fill in the form hit the return button, attached the file and hit go! It went - they just didn't open it until this afternoon when they looked for it.

It went to the address quoted above. As far as I remember, the AOS went to CCBCAQ@justice.gov.uk.

Probably not. I asked if I could fill it in and return it via the email address that it came from. She said that would be fine. When I spoke to them, they found the attachments right away. However, theygave me the answer I passed to you - Pay up £275 and they will look into setting asside the CCJ.

I have a choice. I can pay the court £275 to have them look at the possibility of setting aside the CCJ or pay the swindlers £287. They found my defence which went to the wrong email address, although it was the return email, that I was told I could reply to. As you are aware, most emails cannot be replied to. So I just sent a return email. I may end up paying the court and then paying the swindlers. It's a lose lose situation. SPEEDJAWA

Just got an answer. The courts are in cahoots with the swindlers. I missed the date despite the fact they have now found the defence I submitted. They tell me that I sent it to the wrong email address (actually the email address I was told to send it to) and because they didn't get it on time all I can do now is to pay £270 to file another defence and hope for the best. So... Do I pay the court £270 or the swindlers £287? All this for being legally parked in a space I pay for in a block payment. SPEEDJAWA

I suppose I've blown it? The court emailed me some (what I thought were) defence forms to fill in. I filled them in, returned them by email. Sent ES Parking a request for a CPR31.14 which they ignored. Iv'e spoken to the court and they tell me I now have a CCJ against me. What really hurts is that I was parked legally in a car park that I pay for. SPEEDJAWA

Just to let you know I wrote to ES Parking to request CPR31.14. I did not receive an acknowledgement or any kind of reply. This morning I received a Judgement for Claimant (in default) letter from the County Court Business Centre. I presume they can legally ignore requests for CPR 31 and carry on regardless? SPEEDJAWA

I found and used the password. It did not get me to a form. It took me right back to the Government Gateway. So... I phoned the MCOL people and they emailed me an N9B Defence and Counterclaim (specified amount) (04.13) form. They tell me it is the form I need. However, I don't think it is the form that you are helping me with. I did the old "shut down and restart" trick with the Government Gateway. Lo and behold... I found the form you advised me to use. Filled it in with the bare basics and submitted it. I have since received confirmation that they have it. Therefore, I will post the letter to the ES Parking solicitors (who are owned by ES Parking) tomorrow. I have amended the CPR 31.14 request. I got to the claim form but find I need to enter the claim number and password to continue. Where do I get a password? When I went on to the MCOL website I was not asked to create a password yet I need a password to progress further.

I have not posted anything, nor have I emailed anything. I have done everything I've been asked to do but posted nothing.

What is MCOL? I don't have the original PCN. However, I think it would be illegal for them not to let me have a copy of the original form if it got to the court stage. GDPR was something I thought of. I work for a college, inside a prison. GDPR is a nightmare as we deal with prisoners. I have often thought it wrong that private information such as names and addresses should be given to companies like ES Parking. I would like to know how they store this information. I'm told the consequences are dire if a company makes a GDPR mistake.

Although I was declared fit to drive t wasn't in any fit state to go hunting amongst the upholstery searching for a parking permit! This is why my permit was on the dashboard in a perfectly visible position from outside and which I couldn't miss when I got into my vehicle. The low camera angle used in the claimant's photographs fail to show what was perfectly visible closer to the vehicle and from a slightly higher viewpoint. it is very upsetting that I would often see the Parking attendant when he did his afternoon patrol of the car park.. He knew me and knew which was my car and so must have seen my permit many times over the previous weeks. I find it extremely annoying that calculated slight of hand with a camera has put me in the position of having to defend myself when I have done nothing wrong. The stress this is causing is incalculable. Since my illness I now work only two and a half days per week with retirement imminent and can't afford to pay fines - that's why I pay in advance to park.
