  1. Sorry guys. I find it difficult and miss stuff on my little daft phone. I did actually search in the search box but again I must just have missed it through my own fault. I will be sure to ask for advice and a read through when I do a witness statement. Hopefully then I can go into more detail regarding what they did wrong. I will upload what I sent as a defense soon. Just gotta hide my details. I found it via google search and edited bits to suit. So hopefully it isn't all hope lost.
  2. Sorry guys messed up a bit by not sending your generic defense. My own fault. I missed the standard defense. MCOL hasn't been updated with anything yet a part from the defense being received
  3. I made points about not being the driver, pofa stating they can only claim the original parking charge from a keeper. The fact they sent correspondence to the wrong address. Lack of landowners permission and inadequate signage. I also mentioned adding the 70 pound contractual costs was unreasonable. I didn't go into lots of detail or add any photos or anything like that or talk about the specifics of their NTK however I did say due to the POC being unspecific on facts and made it difficult to respond at the time of sending it.
  4. I put my defense in last week and this morning received a letter from gladstones saying they intend to proceed with the claim. They have sent a directions questionnaire.
  5. Got it, thanks. So is the keeper automatically liable? Or do they have to send you a letter saying the keeper is now liable. Because the reminder just asks for the driver
  6. Also, I have edited the reminder letter they sent so you can't see my name and I'll upload it again. In the original PCN they mention POFA but in the reminder letter they still say they want the driver. Should they have sent another letter saying the keeper is now liable or anything? edited reminder letter .pdf
  7. So out of curiosity this morning I called the number on the signs in the car park. (Not from my phone number though). I just wanted to see if it was another fail, since they've put different addresses on everything etc. It's an automated payment line for the parking fines they issue. Quite odd how they'd have that straight away on their signs I think. I thought it might have been a way to contact CPS.
  8. I will do that thank you. I've got a photo of the actual signs. I took some from the point of view of a driver too. It shows how easily missed they are due to being covered by other cars.

  10. This is what they've sent. The signs in the car park do not have that writing on them. They don't have the blue badge note on them or they don't have the note about 100pound fine at the bottom of the yellow signage Gladstone's sent .pdf
  11. Sorry guys forgot to hide my name. I have heard back from Gladstone's today. They've basically sent everything that I received in the SAR from cps. However, they have sent pictures of signs that are not in the car park, and have wording on them that is different. They also spoke about contracts by saying this "Without concession any contract entered at the time of the incident was between you and our Client and therefore the doctrine of 'privity' applies. In view of this it is irrelevant what our Client's agreement with any third party contained. In any event, we confirm that our Client did have such authority, but given that the contractual arrangement between our Client and their Client is commercially sensitive, it will only be disclosed should it be necessary for a Court to view it"
  12. I have searched their postcode for the car park and still nothing on the planning permission front.
  13. Do you think it's worth fighting @FTMDave? My main argument was I wasn't driving however they seem to have covered that in their PCN.

In the SAR I sent before joining this forum I requested, should I have asked for more? : ALL photos taken All letters/emails sent and received, including any appeal correspondence. A PDT machine record from that day, of payments made . all data held, all evidence they will rely on, and a full copy of the PCN and NTK.
  15. Still heard nothing back from Gladstone's regarding the letters I sent. Regarding planning permission. I had been searching about Spring street but according to the post code on the letter it's classed as Portland street. Will have to search that.
  16. Hi guys. So before joining this forum I had emailed the original firm for an SAR. Obviously now since joining I know NOT to email them. However they have sent me the original PCNs. I will now have no further contact with them as per advice. I have attached it. It may sound maybe like I'm grasping at straws but I'm sure the original PCN was different to this.   17. I've noticed the Hessle PO box is on the signs in the car park. However the address on the court form is a London address. Presumably the same one you tried to contact @miley_b ob. How can they have an address on a court form if the letters come back!?

  19. Ah yeah I see what you mean. Still odd how there is no planning permission. I got in touch with Hull city council this morning to see if they know hopefully they get back to me soon.
  20. Hi mate I'm still doing some research on this car park. It is local to me as well, I can't find anything. Can't find the land owner or any planning applications online. When I google the address of the car park which I believe is 8 spring street. A company named KENSINGTON DEVLOPMENTS LTD comes up? might not be the correct address though on my part. However there is literally nothing in regards to this car park
