  1. ok thanks have already got the template and was getting ready to send everything, a copy to cobbetts and to court, just wanted to check I wasn't missing something major out
  2. Got the aq from the court today, also got cobetts 'defence' requesting cpr part 18, that I didn't put my account number etc on. I know I have sent all account details (cause of what I have read I tried to send it so they coudn't come back with this respone), also Higley said he would forward copies of all the letters to cobetts (could I use a copy of that letter, send it to court as an example of their stalling). So I just want someone to confirm I just have to send aq back to court, sne d a letter to cobetts saying why I don't want to do the part 18, and a copy of that to court and send them another copy of my claim particulars. WHat about the rest of the stuff saying that i have to clarify chares and also '4.1 please specify the clause(s) pursuant to which the charges applied' etc wasn't this all stated in my letter asking for the charges to be repaid? Their legal mumbo jumbo confuses me! Please help-Thanks
  3. Hi I just got the same letter as you clarky about ' I can add nothing contructive to my previous letter. I have informed our litigation team please can I remind you to use the registered office address as below etc etc' from higley, filling the moneyclaim out now, how are you doing? I'm scared, what if this really goes to court, do I take my kids with me? Danielle
  4. why did you alter your moneyclaim entrance from 'You have a contract with the defendant bank dated XXXX and which is conducted on their standard terms and conditions. You are claiming the return of money taken by the defendant in the way of charges over the last xx years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. You have repeatedly asked the bank to justify their charges but they have declined to do so; (found in templates library to what you put on page 5? Thanks Danielle

  6. Hi, I'm just about to do the moneyclaim thing against natwest and have been reading everything hopefully will get it right! I was offered a settlement from my local branch of about 450, then higley, after I refused that, offered a seetlement of 250 (claim is for jus over £1000), anyone know why he would offer less? Thanks Danielle

  8. I have a default on my credit record but can't remember from which credit card company (have now cancelled all cards...) does anyone know how I find out which card this would have been through?
