Speaking of Mr Brennan , In the final part of District Judge Cooke's Approved Judgment, he states: "Mr Berwick submitted a letter prepared on his behalf by Mr Tom Brennan, a non practising barrister" I may be barking up the wrong tree, but isn’t he the lad that’s forcing NatWest to court even after they have offered him a full settlement. I’m not one for conspiracy theories but what relation is Tom Brennan to Kev’s claim or is Tom offering some sort of template letter to be included in the court bundle?
  2. Below are the Particulars of my claim, I was'nt to sure of the daily rate of interest so deleted that part. I have also noticed that some people are including a total amount which the cliam is for, however on the guide in the libary, it doesnt ask for an amount. Does any one know if this is going to be a problem? p.s Halifax have acknowledged my claim as of 04/07/06, they now have 28 days to reply. I have a contract with the defendant bank dated 1998 and which is conducted on their standard terms and conditions.I am claiming the return of money taken by the defendant in the way of charges over the last 6 years plus the interest they have levied on those charges.The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law.Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e).In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have repeatedly asked the bank to justify their charges but they have declined to do so.The claimant claims interest under section 69of the County Courts Act 1984 at the rate of 8% a year from 31/01/2002 to 28/06/06 of £134.91 interest and also interest at the same rate upto the date of judgment
  3. I stumbled across this fabulous website almost 3 months ago. After slowly building up the courage to approach Halifax. I have sent both the Preliminary Letter and LBA using the time scale advised, only to be offered a settlement of £140 for £850 worth of claims. I have completed a claim using moneyclaim online and my request has been accepted. Halifax have 14 days reply. I will keep you all informed. Fingers Crossed. :???:
