    Hi, the machine got collected last Monday, however I have not received the refund and they have stopped responding to my emails. I paid with my card through PayPal. What should I do in order to proceed to get my refund.

    Hi I have decided I don’t want to use this company, however they say a refund takes 5-10 working day, however as we don’t have much good weather I want to buy the machine form a more reputable seller ASAP, is there anything thing I can do to remains a quicker refund. The machine cost over a grand so I don’t have any spare money to be paying for both machines.

    I have just had a reply (along with a separate email donating tracking details- even though the machine has already been delivered) which says I will be contacted by a courier to collect the machine, and that a refund will take me 5-10 days to receive, or I can wait the long for them to resend the correct machine. What would you you guys do considering the machine is cheapest by this company by about £200. Would you stick with them or pay the extra. I should also tell you that I asked to be compensated by way of some free slush cups and straws ect, however they posted their T&Cs which day they are not responsible for any losses so will not give any compensation.

    Thanks for your information. You are correct. This morning out the blue I received the machine on a pallet. Upon inspection if packing I found it was a different machine (a cheaper version, completely differ make/model). I have contacted the company who have asked for pictures. I can confirm I didn't receive tracking information either. I have sent the pictures and am waiting a reply by email as they do not have a phone. Any help would be appreciated on what I should do.

    Hi I purchased a slush machine for my dads food van, when ordering it said I will receive tracking details within 2 business day. However it has been over 4 business days and still I have not revived any details of delivery. I contacted the company (via email, as they do not have a phone number) and they said they will update me with tracking details as soon as they are available. Now I will wait a few more days as I understand it may be the courier who is taking long, but if I still do not receive any delivery details, is there anything I can do. Would CRA still apply as the machine was supposed to be used commercially in an food van, BUT I had purchased the machine for him and I am unemployed and paid from my own bank card.

    Everything has been done over email, I’m not to sure how to block their emails nd bounce them back. They also have a few different email addresses. Also they somehow know when I have seen the email, as when they last sent it as soon as I had opened it they sent an email saying “thanks you for opening your invoice”. If they do take me to court and I get a CCJ what would happen as I don’t have ANY assests other than clothes and a phone.

    Hi just a quick update, they have sent me another invoice today which has incurred a 2% penalty each day for tthe last 4 days (Saturday,Sunday,Monday and today). They have also sent a copy of this email to a solicitors firm and have instructed them that’s if payment is not received today to take “immediate Court/CCJ/Baliff action”. I have not personally been sent anything by the solicitors as they have only just instructed them this morning. My question is should the solicitors know that the contract is void as I am a minor. Also if I do receive anything from them should I make them aware that I am a minor as the auctioneer may have only gave my name and address which is on the invoice. Finally at what point do baliffs come in, is it before the court or after as I live with my parents and don’t own any assets it all belongs to my parents.

    Hi thanks for your reply, when registering via email, they asked if I was a company and if I intend to reclaim vat. My reply was exactly “ I am not a company and not vat registered, I do not intend to reclaim vat” Thank you everybody who is taking their time out to reply to this thread.

    I was just reading the T&Cs again and it says if an under 18 was to bid the parents will be liable to pay, and so court proceedings will be issued in their name. Could this still happen even if they did not know I was bidding?, how would they get my parents name and other details necessary to got to court.

    well, as expected they were not happy, they told me it was an immature thing to do. They explained to me the affect a CCJ would have in the future when I try to get a mortgage or try to get a loan. We also discussed 2 options which we need to get advice on (maybe from CAB). 1) write to them and offer to pay the cost to put the car back in auction (which I believe is £55). 2) ignore until we get a letter from a court, then explain to court I was a minor and my parents were not aware of my actions.

    Sorry for not mentioning earlier, just in case it is important, I agreed to the term and conditions via email. Also is there any template or anything specific I should write to them telling them that I want to cancel this contact and no longer agree to the terms and conditions.

    I am 18 in October As I am under 18 would it be legal for them to pass my details such as name and address on to a debt collection agency. Just in case i have not made it clear the vehicle was auctioned online. Also if anybody would like to read the terms and confirms which are online, I can send you a link if you tell me how to, I don’t want to post their name or any of their details as I don’t want anything to go against me.     Sorry if I didn’t make myself clear, I haven’t paid them anything I meant to say that the payment deadline was yesterday and that after the deadline they send me another invoice which has incurred the 2% penalty. I am telling my parents about the situation and will hopefully get advice on Monday.

    Thank you all for your advice. The actually payment was to yesterday at 5pm. At 6pm they send me an email along the lines of “since payment has not been made in the allotted time, a new invoice as been sent which has incurred a 2% charge” they then attached a link to an online invoice which I had clicked. Once I opened the invoice they sent me another email which said “thank you for opening your invoice” . Therefore the totals bill now is around £11,600. I will speak to my parents about going to citizens advice with me. I don’t know why I put in the bid however I don’t think I would win as “the reserve price” had not been met, but there was a condition which stated that even if it had not been met the vehicle MAY still be sold to the highest bidder. Please could you advise me on are debt collectors allowed to come without going to court first, also are they allowed to take my parents car and other household items. Also i have read online (form other forums) that I should tell them as I was a minor the contract is void and I no longer accept the terms of conditions. But others have said that I should make no contact. Should I tell them this or should I make no contact. Thank you all.

    Hi, thanks for your prompt reply, I understand I will have to tell my parents today. The auctioneers are insisting that my age doesn’t not matter and that’s as I am over the age of 16 I am liable. I understand it was a bit of a stupid thing for me to do and I don’t know why I did it. I’m going into second year of college and am really stressed about what is going to happen. They are saying they will go to court and get CCJ in my name and baliffs will be involved. I send the driving licence before the bid, they needed to confirm my name and address in order to create an account.

    Hi, I am posting this as I require some urgent advice regarding a minor and an agreement. I am 17 years old and I got onto an online car auction and won. The vehicle is for £7,900 + VAT + 20% commission + vat, therefore the total plaice is around £11,300. However I don’t have the money to buy the car and I did not think that I will win the auction. I contacted the auctioneer about this and they said that in there terms and condition (which I agreed to over email) they clearly state the following: 1) if a buyer wants to cancel they must pay the 20% commission+ vat. Which works out at £1580+ Vat 2) it is a trade sale so consumer right do not apply 3) there is a 2% interest each day for late payment 4) if an under 18 bids in a vehicle the parent or legal guardian is liable to pay. 5) is payment is not received within the allotted time they will use legal action. 6) If the reserve price is not met the seller may still sell the vehicle to the highest bidder. I need to cancel the bid as I have not got the money to purchase the vehicle but I don’t even have the enough money to pay for the cancellation charge. The auctioneer have got a copy of my driving licence and are saying that I have till 5pm otherwise they will go to court and most likely I will get a CCJ in my name which will be for the full amount of approx £11,300 plus 2% interest each day. I would like to know if they will still be able to take me to court even if I am under the age of 18 and classed as a minor, and I did not think this would happen. My parents are not aware of the situation and even they do not have that hind of money. Adobe is greatly appreciated. Thanks Thanks in advance.
