Thank you for this. And the last time I complained to DWP it got me know where. Just as the police can't investigate the police...dwp would not undermine one of the own. So despite of them saying the complaints process has to be followed before going to ICE, do you think I should just write to my MP?? I just wonder if my case would even be seen as they must receive a lot of requests. Thank you

This case has turned out to be what appears to be false accounting and a major cover up by UC. As of 12/2/20 i was still waiting for the MR decision when i asked about making a complaint, i found out that the MR was never submitted. Five different case workers spoke to me trying to explain why the payment noted in my journal on 17/5/19 was legit and not false accounting or what i said may have been a payment made to someone else then using me to cover it up. For that reason i am a victim of maladministrarion by dwp so have taken my case to CAB to look at fron the start as they say i have lost £460 a month since 4/19.

My case is very confusing and I have been waiting 5 months for a decision on a mandatory reconsideration. Hopefully someone can give me a clear answer so i can take it to the correct person to handle it. On 10/4 I was put on UC while i was in receipt of SDP and PIP. This happened when my ESA stopped and i was moving to JSA. The jobcentre said i had to go to UC so i lost my SDP. 3 weeks later i was told i was not eligibal for UC so go claim JSA. Now a month had passed and once again i was told go on UC i did 10/5 and asked that it be back dated a month. 21/5 after identity check i was able to take an advance of the total payment every month. But a mistake in the rent put the new amount to almost double on 22/5 i was given another advance as my assessment period was 10/5 - 10/6 with first payment on 17/6. The change of circumstance gave me another advance on 29/5 for 50% of UC payment. These were clearly advances within assessment period and before any UC Payment was made as the rules say. But...when back dating was accepted to 10/4 someone moved my payment date and amount from 17/6 to 17/5 and clearly wrote it in my journal. I had used the advances to pay rent arrears for the past 2 months so first payment would help witb other bills and rent short fall. But now the payment on 17/5 was never made instead they said it was paid by what were the advances because rules state no advance for new claim can be given once payment is made. I had asked for MR on 28/5 stating they were advances and were my right to take. False accounting cannot change what they were and since they have written i was paid my monthly UC on 17/5 , they have admitted that i am owed so it should be paid. Can anyone help me with the answer please. I really do need the payment as bills have caught up with me

LATEST: I spoke to CAB and there is a case to answer as the person I spoke to use to be a DM for DWP. He said the lady was wrong to stay on the phone while she ordered me to the job center, she should have called me back when I got there or had them call her. I'm to seek legal advice and so I do not predudice the case should not make further comments here about it. So I will keep you informed of my progress in weeks to come.

Yes you are correct I moved all recordings to a usb, SD card and even iPad for safety. I am calling the council now as on my account still says claim active but suspended with next due date as 27/5. If not paid by then I will be 8 weeks in arrears and landlord will issue me with a notice to vacate. That DM has really destroyed my life that wasn't all that great to begin with. But before she popped up I only had to worry about dialysis. Now I have lost 20kg in weight since her first contact beginning of March. I am recovering from lung infection past 5 days and as I am 51 and alone I can't exactly just get up and go. My finances since 27/3 have been £228 that's all. And I want to thank you all for your advice and understanding and also want to say everything I say is all fact, no embellishments or non truths. Yes thank you again. As you said better I have the recording and it be illegal then have nothing and be a fool. Especially when DWP said they don't record out going calls. Could this be because they know that their DMs sometimes go out of line?? I used the app Otter (hope I'm not breaking any advertising rules if I am please delete) as it also transcribes and ACR as it saves to Drive, Dropbox or Cloud.

Yes thank you for that. I was all geared up to follow up until I received the DWP response to my complaint against the DM . When I made the complaint I stated to them that "the police can't investigate the police" so I did not expect anything to go in my favour when they said they will pass to their own complaints dept. And having one DM undermine the other would never happen and by no surprise I was correct. It's a shame I am not allowed to upload the letter because you would agree when I say there was a big cover up. Because they say she only called me twice a day after first texting and I did not answer. They say we only had one full conversation when we had more then 6. And they say she dealt with me in a fair and professional manner and was clear about the information I needed to provide! No part of my complaint about being harassed, bullied or threatened was even mentioned. Infact I was made to be the villain and liar. BUT....I never told them I have every conversation recorded and now transcribed. Or that I have my phone records showing calls and 2 texts from her. So now I ask you this question. As they have said I can write or email them and it will be passed to the director general for work and health who will then arrange a response from an appropriate officer "within the department" ( police on police again), do you think I should reveal that I have the recordings and send them one or I just stay quiet and seek advice from CAB or civil legal first? I do honestly think they are now blocking my claim for benefit as I said earlier. Thank you very much I await your reply.

You stated that you didn't think wreckless endangerment case could be brought against the DM but if you read the doctors letter, and she had it in front of her when she made me rush aylesdtit 200m to job center in 6min. I don't think I could manage it if i were 100% fit let alone very ill. And I have not mentioned that I have a fistula under my neck. This is a very serious matter that I must take to CAB.

Ok I understand. The purpose of uploading the letter was to show what has put me in the situation I am in when doctor clearly stated I was a very ill person. And missed the assessment when I was in hospital yet ESA stopped and HB stopped.

What does topic tidied mean? If it is asking what the letter refers to, it is the letter I sent to dwp for my ESA after I was admitted to hospital. The lady on the phone ignored it and made me rush to the job center putting health and life at risk.

Yes I am sure you are right because she read the letter I sent in from the hospital and still forced me to walk quickly to the job center. She asked me how long it would take me to walk to the JC, I said about 6 mins she said she would call me back. 10 mins later she called and I was out of breath so she accused me of not being me because I was breathing heavily. "Why aren't you there yet when you said 6 mins and I called in 10"!? I said it was not a straight walk I had to rest a bit she said stopping fibbing I was no where's near the job centre. It went on for the next 1 hour until she hang up from waiting for my documents to be uploaded. If posting the doctor's letter here is allowed I can do it so you can see what they said about my condition.

I called DWP to find out the progress of my complaint and after waiting 1hr 23min I got through. I lodged the complaint on 2 April 2019, my ESA got stopped on 4 April 2019. As of 2 May 2019 my complaint had not even been sent to the complaints department as I did it on the phone. On 8 April I asked for MR and on 12 April I sent in additional medical evidence showing my past and future treatment. In my MR I said my complaint is part of it because the DM took it personal and so she could have done anything with the letters i had uploaded from the jobcenter because she still stopped my claim. And my suspicions were made true when I received the outcome of the MR today and it was not reversed. It was stated that it was not changed because I had not provided any additional evidence to support my request. It was dated 23 April 2019 so nothing I sent in was looked at. Now I think this case has gone beyond what I can handle I will contact CAB to seek advice. I can apply to tribunal but I can't see how I would win when it is my word against the DWP. They already said they don't record out going calls and my argument is that I gave evidence showing why I missed the assessment and from what I was asked to provide, it should have been enough to get me another assesment. Do you think I have a case against the lady for wreckless endangerment when I was made to walk fast to the job center while she continued to threaten me on the phone?

Yes she was calling my mobile and I was recording the calls. I was unaware that only my side was recording so only I can be heard. But those who have listened to it say it is clear from my responses that I was under duress. It is just a shame that she can not be heard saying I shouldn't insult her by calling her Madam! I said as I did not know her name out of respect I call her Madame. I have told the council of a change in circumstance so I hope they will reinstate my HB. I know there is no way I can work with tubes hanging out my arm but when applying for JSA I had to agree to looking for work. I will call them now to see what is happening with my complaint.

Thank you. This forum is not long enough for me to explain what I went through with the decision maker on the phone for two weeks. As this subject is about whether I could get HB whilst being on PP SDP I won't go into to much detail about how I was harassed by the DWP DM. To give you an idea so you could say whether I was harassed, she would call and demand to know why I did not answer the phone earlier, she'd call at least 3-4 times every 1-2 days and worst of all after I had told her I had been in hospital for 5 days with low BP of 72, anaemia and blood in my urine she made me rush to the job centre while she stayed on the phone and called me a liar when I said u could not walk so fast and could hardly breathe so had to sit down. That is when she said I should go to the jobcentre to upload my evidence I complained to DWP and as they seemed to suggest that she would have stopped my ESA with a good reason but they would pass it on to their complaints department so I said "the police can't investigate the police" when they listened to the tapes they would see that I was treated very badly and my claim closed before they received the letter she put my life in danger to send her. I found it quite convenient when they said they don't record out going calls. It was then that I realized I had no chance. I have not written to my MP because it is her word against mine and it would seem as though I made the complaint because my ESA got stopped. In the MR I said that when the DM called she asked me to show why I missed the assessment or she would stop my ESA. As far as I was concerned, I did as she had asked by paying for a letter from the hospital and sent it in. As it was received by DWP and clearly shows I was in hospital that day, my ESA should be put back on and I get given a assessment date but I was asking for a home visit as I have dialysis 3 days a week. If you think writing to my MP to expose the way I was treated would help stop bullying by DWP DMs who have a power over us then i will. And if it helps, I recorded my conversations with her. My ESA got stopped because I had missed an assessment when I was in hospital with blood in urine and I got harrasted by a DM everyday for a week to provide the hospital admittance and discharge letter. (See my post harrasted by DWP Decision maker). I am starting dialysis next week due to kidney starting to fail. On a Wednesday She threatened to stop my ESA the following Friday if she did not receive it. I told her I had sent all medical evidence the day before on Tuesday but from past experience I knew it took atleast 5 days to be entered into the system so the Friday deadline was unrealistic she had made up her mind to stop it already. They received it the next Monday but ESA had been stopped. I asked for MR and I am awaiting the outcome. I was told I had to claim old style JSA which I did and appointment is far in the 7th May. In the meantime I was told by a stranger at hospital that I could continue to receive HB without claiming any other benefit. As it was late yesterday I asked for advice here but I am calling the council now.

Yes, it is a full service UC area. But I read the that anyone who received SDP currently or a month prior could not claim UC. Instead had to claim JSA or income support. I am asking if PIP with SDP would put my HB back in payment instead of waiting for JSA

My ESA got stopped but I still get PiP with severe disability premium. My housing benefit got suspended while I wait for my JSA to be processed. I have tried to contact CAB but can't get through and I've looked on line but cant understand weather I can get HB with PIP SDP. Can anyone tell me if I can use PIP to get my HB back in payment as my JSA won't be active for another 2 weeks.

I have just received my p45 in mail that esa has been stopped from 12/2/19. The last time I spoke to the lady who said I insulted her by calling Her Madamw she said she received my medical evidence uploaded by jobcenter but she wanted me to go to the hospital and get a copy with the days date and send it to her. Notice of cancellation is dated 2 April 2019 so she did not even wait to receive it. All she did was threaten to close it and harassed me almost daily calling up to 6 times from 9 am demanding to know why I did not answer as if I knew the private calls were from her. I am going to call DWP to make my complaint and ask for a MR. I really hope they will listen to the recording as they may think I'm complaining just to get it back on. I have a recording of one of our conversations but it only has my side not hers. I don't know if it is legal but it clearly shows that I asked her if she could call me when I could leave the house I was staying at because there is alot of arguing and shouting from the owner of the house and his friends who were all drunk and violent. You can hear how stressed I was even begging her to call later. Everytime I tried to ask her a question she would say shes not interested. She dismissed the letter I had sent DWP saying that I had very low BP and often felt faint as irrelevant. If uploading he recording here is allowed I would do it so maybe some one neutral can tell me if I was rude in anyway even though only I can be heard. Thank you

Ok my fault I should have explained that I could not upload the final decision letter because it was sent to me as an attachment in email. If there is anyway I could delete my personal info using android phone I would then upload it. Seriously I just can't get over how they are using a template letter to prove that they informed me before the combining of accounts. They can access everything else except the letter that would solve this case. So I also told Vanquis that I also paid them the £787 and to prove it I will send them a template of the cheque. They had no answer to that. I want to ask anyone who can answer, "since the £787 was removed from one card and the balance made £0 , can they still put the closed account as a default on my credit file and then list it as satisfied? " The 2 cards are still on my credit file the open one with Lowell and the closed one still with Vanquis. Then they refunded me the payment protection for both cards. I think a expert has to look at the case and decide. I wish that fella on TV could take a look and tell me. Thank you

Ok, as I do not have access to a scanner or pc I cannot upload the final notice letter from Vanquis. They still claim they sent me a letter saying they were going to combine two credit cards and as they could not locate it they sent me a template with out my name or date. The letter does not explain the process taken or why they kept the account with the lower credit limit open and added £787 from the other then giving a £1000 credit limit on the single account leaving me over the limit by £400. This charged me over limit fees and as I could not pay the minimum each month, £12 late fees £12 over limit fees and interest caused me to default and ruined my credit. I then asked them to send me the recording of me saying I received the letter but they say they could not convert it to be sent by email and could not mail it because I did not have a registered address. Then after they said they sent me the dsar by email I did not get it until I asked them over and over that I received it last week. But it was encrypted and on a format that could not open. And when it did it needed a password I was never given. And again, they can't send me the password until I have a registered address. I can see the hey are just buying time so I'm am complaining to the FOS today and hope they can be fair and if in my favour I will honestly say I'd want big compensation for me and any others that have been through it. I want to to first start by saying all my previous dealings with DWP and been very satisfactory. This is the first time ok am looking at making a complaint against them so I want to be sure I have cause to. Will be brief and say when I missed a esa assessment I called DWP to say I was in hospital when I was released I would send in my hospital admittance and discharge letters the following Friday as it was a Mon. I was given 14 days to do but I did it on the Fri. By 2pm the same day I got a call from DWP at 9am that I missed so text came saying I would be called at 12. I got the call and the lady said why she was calling to ask why To ask why they had not received them. Told her only sent it that day it will take a few days to get There and a few more days to be processed but she said no way it should get there by Mon. If it did not then she would cancel my esa. This had me in a panic so I said I could go into the jobcenter and ask them to upload the evidence so she would have it difinitely on Mon. She spoke to me in a very harsh aggressive tone saying if I sent it why would i want to go upload at jobcenter.? I must be telling fibs she said!! So Mon at 10am I had better answer the phone. I told her Mon, Weds and Fri I have dialysis so could she call at 2pm. She said not 10am MAKE SURE U ANSWER!! Mon 10am she called and the nurse answered saying I could not come to phone could she call in 2 hrs. She said no 10 Min he better answer!!! It rang I cud not answer, so it rang constantly for a hour. I called DWP at 2pm and asked that she call me I did not know here name. She called at 4pm and shouted asking why I did not answer in 10mins or after that? If I avoid her calls she will stop my claim. She said she waiting till weds and if letter not there she close my claim. Weds 8am I miss her call so she call at 10am and I answer saying I can't talk I'm in dialysis will call her when I'm done. She said no I will talk now and tell her why I missed assessment she don't care where I am I better tell her and stop wasting her time. Why u whispering she say speak up dont taking her for a fool. I cud not believe it so I pulled out the tubes and went out to he room leaving trials of blood from The fistula. Only the nurse got me off the phone and back in. Thurs she called 4 times and I answered when I saw it at 12 and she shouted why don't i answer when u know that her. I said it show private I was asleep from very low bp and aneimia. She said letter not there UI had better go jobcenter and upload it. Ok said had to walk it would take about 6mins can she call in 20min she said no 10!! I walked about 200m then was out of breath and had to sit as I felt faint then she called. I was struggling to breath but she said stop talking like that put the person in jobcenter on phone. I said I had. To rest there still bout 300m to go. She said walk now I'm staying on the phone so I walked. After 2min she shouted stop wasting my time you said 6 mins it's been 15 stop lying to me. I put my carer on to tell her we almost there I can not walk fast better she calls in 5 Min she said no!! If I'm not there in 2mins it mean I'm lying I'm not even where I said I was she staying on phone. Got to JC after 5 Min and handed phone to reception man who confirmed it was the JC but the person who uploads was at lunch till 2pm and handed me the phone. She said she is staying on the phone until person returned. By now I was bleeding from The fistula in neck and told her I had to go out the JC to bathroom to stop it so I gave letters and phone to my carer. 10 mins I return and he told me she calling in 30min. The. Letters were uploaded but she didn't call. Next day 2pm she called saying did not send her the correct letters yet They showed I went hospital on 11 Feb and was discharged on 12. I said Madame what else did she want. She shouted don't insult me by saying Madame. I said it not a insult it's respectful. She said call me by my name which ok did not know until she said it. She said I'm to go hospital and get aletter saying I was thete. I'm said ok did not have. £25 to pay. I then said why are you bullying , threatening and harrassing me. From day 1 she has done so and twice she had put my life in danger making me rush up and down. She said I was telling fibs and should stop. If she don't have the letter the next day she closing my claim. That was last Thurs so I assume it's closed. I'm asking if I can make a complaint to DWP because if she has closed my claim when I sent in all the evidence backed up with letter from doctor, I will not be able to get to dialysis 3 times a week and would have to wait 3-4werks for MR. I'm sure hey can listen to the recording to hear The truth.

Alot has happened since I first wrote this. I asked Vanquis for dsar and they sent it to me by email 4 weeks ago but I could not find it anywhere. After I called to say they are just buying time they did send it but in a format that I could not open and when I did it ask for password I did not get. But worst of all...they said they did inform me in writing that they would combine the accounts and I said they never did. I only found out after it was done I called them saying I am aware that they combined them as I got a statement 3 weeks after but they never told me they would and never said what process it took. they tried to use that against me by saying when I called I did say " I know you combined accounts but you did not tell me you were going to do it so I had no choice in the matter and they closed the higher limit card and kept lower one open putting me over limit by hundreds" . When I asked for them to send me the letter saying they would combine them they said they could not locate it so they sent me a template....haha!!! How ridiculous is that? I said to them ok I did pay off the card and to prove it I will send a blank cheque as it is one I would have used. It just won't say Vanquis on it. So my next step is FOS I'm done with their silly attempts to cover themselves. If u could post the letter on here I would buy don't know how to do it.

Ok, Lowell informed me that I was wrong there is no way Vanquis would have combined two separate credit card accounts into one. Only after I gave the account numbers they said I had to take it up with Vanquis. But Vanquis had told me they combined the two but had told me in writting which I disputed. Their complaints team emailed me to say they will investigate and get back to me. I said "the police can't investigate the police"! Can I ask if I can send SAR by email and exactly what do I say or ask for? Thanks.

Thank you for your reply. I only ask about financial comp because I stayed home from work on the day engineer came and I wastill very stressed as I spent 5 days talking to them on the phone which was difficult because they guaranteed me I was getting their service. I told to send a engineer and show me where it was connected. Also my pay monthly phone acceptance got reduced to sim only after they checked my cresit file. I will do as you say and let you know what happens.
