  1. Hello, i have got a pre-action protocol from Howard Cohen reference an old Barclaycard debt of £3065. Agreement started in 2008, i probably defaulted in 2012, may have made token payments till 2014. What's the best thing to do with these then, should i ask them to prove i owe the debt before i pay?
  2. hypothetical situation if SLL cannot prove that i owe this debt with a CCA would they have to remove the default?

  4. sorry if im being rude i dont completely understand. Mr Lender never originally defaulted me on CRAs they just marked the account as settled, how can SLL Capital mark me for a default?
  5. how have the oc done it, it says SLL Capital on there - what has the OC done?
  6. ah right, fair enough doesnt matter to much i've got other defaults from 2016 so will be a while till my credit file is cleared up anyway Who are SLL Capital then i thought they were just a powerless debt collecter. i didnt realise powerless debt collectors could register defaults?
  7. Put what there? You are saying its taken 2 and a half years for the credit file to update - dont think that's right is it?
  8. ah yes on closer inspection Mr Lender closed the account on 15/03/2016 and marked the account as settled. I check my credit reports everyday and SLL Capital have only added this to the call credit report today, are you saying they are not allowed to do this? If so what should i say to them?
  9. Me again, So out of the blue SLL Capital have put a default on my credit file for a Mr Lender Loan from 2016 that i never repaid. Can they do that? The Mr Lender loan isn't on my credit file before this I will of course do a irresponsible lending complaint to Mr Lender, is it worth sending a prove it that i owe this debt to SLL Capital?
  10. There's no defaulted date - so i should just pay it all = that's the best thing to do?
  11. Ok so yeh they said it would only be partially settled if they accept my offer. So just wondering if it’s already showing that I haven’t ran this account well. Is it ok credit file wise if it just says partially settled rather than settled.
  12. I’ve never had a default notice from the moneyshop. The account say it’s defaulted on their statement they sent me though. Not defaulted anywhere on cars just late payment markers. I don’t know what to do I’m getting conflicting advice here
  13. Right sorry I’m just clarifying what you are saying cus it doesn’t really make sense to me. You’re advising never pay it off and just leave it on my credit report for eternity?
  14. i have, but i just feel hes gonna agree, every one of these ive done has been rejected at adjudicator level anyway. dont feel like im getting anywhere. right lets assume ombudsman agrees with adjudicator - what do i do?

  16. can you expand a bit rather than these few word sentences if thats ok? because im confused what you are telling me to do. Are you saying i should just never pay it and let it sit on my credit file forever?
  17. just looked at their statement they have sent me loan was taken out 11/07/2016 and they carried on applying interest until 28/11/2016 is that right?
  18. Yes that’s what they’ve done with me. So realistically the best thing I can do here is just pay the whole debt off rather than offering settlements if I want it to look good?
  19. it literally says everywhere pay day loans are bad for your mortgage applications. i dont want outstanding debt on my credit file, i want a clean file within the next few years. Can you tell me how partially settled on your credit file is bad?
  20. becasue one day i want to apply for a mortgage and i dont want an outstanding pay day loan thats been on there since 2016. surely thats right>?
  21. is partially settled not any good then? When you say offer of removal - are you saying remove all info from my credit report that i had the loan, or just mark the loan as settled?

FX - what do you mean they wont remove the CRA info, if they agree to accept my offer are you saying the loan wont be amended to satisfied on my CRA - what would be the point of that DX - Yeh but surely they can see i've got late payments on my loan - surely it is best to clear it off my credit file?
