  1. Hi All, Excellent piece of Excel there Charges are £218.75 inc compound interest. Do I make a claim from SD or do I tell Crapquest to adjust the amount owed accordingly?
  2. Hi All, I have received the SAR and have found £192 worth of 'administration' charges on the account. Would these be something I could use to bring the value of the debt down in order to begin paying it off? Or should I just wait for a claimform and use that as a defence if and when it arrives?
  3. Report drunken phone call guy to the police immediately. This is a separate issue, you have the evidence on your mobile, it's criminal behaviour. I would imagine you are worried about the repercussions, it's understandable, they could sack you, which would really not be very wise on their part as you are entitled to take it to a tribunal (no fees anymore) and claim for unfair dismissal, and cost them a lot of money. Have you shown your director evidence of these calls? as he should be investigating said employee for gross misconduct.

  7. Hits all, I have a CCJ issued in January last year for a Capital One Credit card via Cabot / Shoosmiths. The Balance is around £1200 and I am paying it off at £50ppm. Unfortunately I hadn't found this site back then and didn't defend it. I don't have a problem paying the £50ppm I recently found some original capital one statements, it would seem that there might be some unfair charges. If I SAR Capital One and find this to be the case can I make a claim directly to Capital One for these charges, despite the balance been sold off and CCJ'd?
  8. Yes. Perhaps find a good employment law solicitor, some of them will give an initial free consultation! As for the phonecalls, I am a guy, and was stalked by my ex wife for a time, many years ago. Hundreds of phone calls, messages, trying to call my work and get me sacked. Frankly it was terrifying! Back in 2000, this was not a criminal offence, so i had to sit and take it. If this was happening to me now in 2017 I wouldn't hesitate to report it to the police.

I know this has happened at the company where I work, and it was reported to HR, the perpetrator (senior manager) was sacked. Do you have an HR person / department with a complaints procedure?   10. Hi Roy, Write to them explaining that you were in hospital with Cancer and was therefore unable to fill in the relevant forms. Get a note explaining this from your consultant or GP and send them a copy. Explain that under the Tax Credits own code of practice COP 26 you would like the over payment cancelled. For your own reference here is the extract from the COP 26 most relevant to you. I would say a cancer diagnosis is an exceptional circumstance. If you need to discuss financial hardship with us, phone us to explain this. When you phone we may ask you about any family circumstances that may lead to extra living costs. For example, if you’re looking after someone who is chronically ill or disabled.   11. Right, Email and call your local elected councillor immediately, and your elected local head of council. All Emails / mobiles should be available on a Google search. Explain the situation to them, exactly the way you have explained it here ! These are the people most likely to be able to fix this rapidly. Talking to anyone at the council Tax Call centre is utterly pointless.
  12. Hi, The DCA are totally irrelevant here, just ignore them. If there is any payment arrangement to be made here, it should be discussed with HMRC. Have you looked up the COP 26. This is the HMRC 's own code of practice, look at page 15! Just Google Tax Credits COP 26, it's on GOV.UK. On my SAR, it turned out Tax Credits had my salary as £6000 per year higher, and had lied about a phone call. Perhaps this will give you a clue as what to look for. In fact read through the whole of COP 26, there are a whole host of mitigating factors that can be used in an appeal. For example if your joint claiming partner has left, chronic illness, mental illness etc. My overpayment was massive compared with yours and the Tax Credit's were talking about me paying £50 per month, so I am sure your fears of £80 per month are just fearmongering from the powerless DCA. You can always attempt to make another claim for Tax Credits too, if that is successful they will stop trying to collect and start deducting from your award, even if it's only £20 per month!
  13. Right, So certainly don't want Bailiff fees added and the family car confiscated. Worst case scenario just keep paying monthly. Best case, lets see what unlawful and unfair charges the SAR to the OC reveals. Then perhaps go for a set aside or a reduced plan.
  14. That is interesting, We don't own a property yet, so no charging orders, my wife who the CCJ 's name is in is Self Employed, so no AOE's either. Are Bailiffs the only real option for them to recover money if we don't pay?
  15. I set up a £50 per month arrangement with Lowell to keep the bailiffs from the door. I will write to them with the proof that I have,
  16. Lowell backdoor CCJ'd me even though they knew my current address. I have written proof of this in the form of letters they were sending me regarding another debt at the time. I was intending to go for a set aside with unfair charges (if there were any) as my defence, hence the SAR. I don't have a problem paying, monthly a reasonable amount, so will make an arrangement with them.
  17. Hi I'm still waiting for my SAR to come back from Shop Direct on this. However I have now received a letter from Lowell Solicitors, that they will issue a warrant of control if I don't make a payment arrangement within 10 days. I'm assuming because this is a CCJ, I've got no choice here?
  18. Just with a view to following up what is happening with your appeal. In my experience it was delayed for weeks. Do not discuss repayments with them!

We’ll ask you about your circumstances in more detail. Those are the people you should be dealing with, if your appeal fails and you need to pay back, not some low life DCA.
  20. Nope, It means nothing of the sort. HMRC will let you know either way, and if it fails, HMRC are the people you talk to in order to make an affordable arrangement.
