    Happy new year Caggers ! Andy just wondering if you could assist with that draft statement please ? Apologies for the late response , it leaves 7 days before the hearing date. Quick question if the Claimant does not get this reinstated can I claim for lost work ? As a contractor I am going to lose a days pay thanks to these imbeciles !

    Quite possibly ! But that's my thought if they have a third party who sorts mail how is that a valid reason to have the claim reinstated ? It states under exceptional circumstances that a DJ could allow this to be reinstated but for me this is no such circumstance. That's like me saying oh sorry it's late I did not get around to it , can I send in my docs a month later oh and have the CCJ removed that I received due to my non compliance !

    Well got the copy letter from court dated 14th August stating that is it ordered that : Upon the claimant having failed to comply with Paragraph 1 of the court order dated the 16th June 2018 1. The claim be struck out 2. The court having made this order of it's own initiative any party affected by it may apply to have it set aside varied or stayed within 7 days of service of this order. Dated 18th July 2018 So Lowell missed that opportunity 7 days from that date ! Instead asking for it to be reinstated at least 2 months later !

    Will do Andy and thanks for the information ! I have postal receipts and print out of proof of posting plus screen shot from Mcol to prove I submitted on time !

    Just realised why Lowell are pushing besides the £££ signs , this account will be SB by Feb 2019 ! I need to check my paperwork again to confirm last payment was Feb 2013 but this could also be a potential stopper against them . If for argument's sake they get judgement in Jan and it is allocated after Feb can I use that in defence or will it be too late ?

    OK I will be attending ! Just to confirm this is to defend against Lowells being granted approval to overturn the Struck out order ? IF the DJ finds in their favour I assume the claim will be reopened and back to square one again ?

    Excellent ! Well nothing else has changed as far as I am concerned so their request is just the same as before. Do I have to attend court or defend before this ? Only ask as I potentially have a new contract starting Dec so need to make the employer aware I need time off.

    Works for me ! Can the claim of abuse of process still be applied ? Or on the basis of lack of documentation\incorrect documentation as I previously challenged ?

    Forgive my ignorance but without hearing yet given a date/time to attend court. Is this attendance to defend the claim with issuing of paperwork ?

    Thanks ! Why would the court set a date/time first rather than give me the option to defend the claimant reapplying ? Or actually denying the request on the grounds they did not comply originally ?Seems a backwards way of doing things ?

    I did not request ! I think as part of my statement I did say the POC was vague. Why would the court request this?
