  2. Honestly dunno, shes worse than me for chucking stuff. She was going to ignore this as she thought they were just trying it on but i still get those "try it on" letters and they arent like this one i save every bit of paperwok now but that was after getting my fingers burned but she needs to start saving hers too
  3. ok ive printed out the CCA and the PAP letters as on those posts, ill get a postal order and get it sent off i love getting those "we dont have this information at present..." letters, lets hope this is another of them thanks

  5. Exactly what we thought, her online banking doesnt go that far back i tihnk she'll have to request statements and check herself
  6. Dunno how she forgot, shes under the impression she hasnt paid it for 6 years or so, but i know myself how easily these things get forgotten It says to send the PAP form to their solicitors - there is no mention of solicitors yet so just send it to PRA?? thank you

Has the law changed recently that debt collectors can take people to court on behalf of the creditor? i assumed that creditors only pass debts on if they cant lititgate themselves? thanks

Not sure when it was taken out, it says on the letter the agreement started in 2002 but that must have been when the card was taken out Can you email this SB instead of posting it? one more question - if we ask for SAR or is it CCA? they have to comply and cant take court action in the meantime? im assuming this is nearly up to 6 years since a payment was made and theyre trying to get to her befroe time runs out thanks for the help
  9. Hi Dont know date of default, or last payment made but its def not on her Experian file Can they just take her to court after this letter with no other warning? Can they just take her to court with no other notice?

  11. Hi all My OH has today received a letter from PRA group saying they are considering court action. Theyve sent the letter i attach here, and an income/expend form and another form with some basic questions on. She did have some debts from a while ago, but she says now that her credit file is all clean so do you think this is a serious letter or are they just trying it on? She thinks that as she hasnt paid for a few years. Shes under the impression that soon this will be over 6 years since she paid anything but i dont think its anything like that length of time. Its form an old Barclaycard debt, we thought all these were sorted/passed now but obv not! Were due to get a new mortgage deal in July so we dont want another CCJ on her file (she had one from when all these debts started but thats gone now) Should see apply for copy of CCA? thanks

  13. I think ill tell them it doesnt conform to OFT guidelines and let them take me to court, for £600 owed they have a lot to lose with solicitors fees and ive got nothing to lose
  14. This seems very fishy to me, i know how we forget things but both me and my OH have no idea of why we would take home info loan out when we werent moving then. Its addressed to me, with my first name spelled wrong, only my name on it and yet my OH sig is also on it Why would her sig be required if its only in my name? I think they know its missing required stuff, im going to make a complaint Do you know if these guys often go to court? they are not allowed to claim legal expenses for such a small amount i think - is that true? I might take it to court and fight it

  17. yes its mine and my OH sig -dont know why shes on it? but the only sig you can see is from them the original agreement was in 2009 i think where is the rest of it? thats what i was thinking, it says page x of 12 now i know all 12 pages wouldnt be t%c but ive never seen all the t&c fitted on 1 page - but is this what they mean by reconsituted?? that it doesnt have to be the exact thing as long as it has the same t&c on it somewhere? Also if you look at the scan 1 with all the black writing, it looks like near the bottom, above the last sig box there is a faint black line which looks as if there has been a sheet over the top photcopied or something. its partly obscured by the thicvk black lines ive used at the bottom

  19. Hi guys Around 2 years ago, I asked Cabot for a CCA request for a loan i had. They said at the time that they couldnt find the documentation so it was not enforceable. Ive recently had a letter form them saying they have now found this CCA agreement and that the debt is now enforceable! Theyve sent me a reconsituted copy but im wondering if this is now a debt i have to pay? If you look at the scan ive added, it looks like the document is missing something, and also surely there would have been more than 1 page of t&c's?? Is there not a time limit that they have to provide me with the CCA or its not enforceable? i ve read they committed an offence but that doesnt really help me in this situation Anyone know if this is now a debt again? i cant find anything similar to this anywhere thanks Scan 1 copy.pdf
  20. hes not got back to me about it yet, hes just moved house so hes not had much time to be fair. (ivej ust asked him to let me know) His mortgage advisor said he ll prob need to pay it so its marked as "satisfied" on his profile for when he applies for the mortgage. A waste of money im sure but i can see how it would look better to a mortgage company

  22. Hi guys My son is coming to buy a house and hes just got a copy of his credit report and there is a CCJ on it that he knows nothing about. He has moved addresses a few times in the last 5 years so the paperwork must have gone to an old address. According to the credit report (we get the full version tomo) Lowells *boo hisss* now own it. The report hsows our address as he used to live here but we def havent had nay paperwork for him. my questions are: a) how can we find out what this was for - can we contact the court and ask them for copies of the paperwork? b) as he needs to get a mortgage he wants to pay this debt off whats the best way to do it? I said that as lowells dont have his number or address the chance of them getting the money is very slim he should phone them up and offer to pay half (the debts around £230) just to get them to close the debt for the sake of his mortgage application. would they be able to send an email (we dont want to give them his address) saying that they agree to accept X in full and final settlement of the debt and if they did that are they likely to close it or still chase the remainder? i dont trust them He would have paid the bill if he knew about it before court but too late now thanks
