Hi, As we all know NatWest have paid up, just b4 court, they asked me to write to court withdrawing my claim but i went into hospital unexpectantly and as yet havent written to the court withdrawing my claim. I havent signed anything saying i would but i will but i just want to know what happens if you don't write to the court withdrawing your claim?

  6. Haha, two fingures up to Natwest Bank. Me, the little girl has beaten them, the big conglomerate. If i can do it so can you. After a long five months and many arm aches later, after sending letters and details to them and their stupid lawyers (ironically enough called Cobbetts) on numerous occasions, they have finally paid up but not before reminding me that if the case was to go to court i would most certainly not win but it makes more financial sense to pay me off then let it go to court and them pay the legal fees. Nevertheless, i have walked away with more money then i lost. For a long five months they denied doing anything wrong or immoral. They said that there was no chance me winning in court. They used legal termination and their lawyers to try and intimidate me (but if you have met my mother, you will know that she doesnt suffer fools kindly, so i learnt at a young age to tougher up) whilst they still offered me stupid and silly amounts of money, of course, all of which i rejected (funny though, if they think they are so innocent, why offer me anything!!) but i bloody won haha. My perserverance and bloody mindedness has paid off. The letter from their lawyers arrived January 1st 2007. They again stated that they believed in court that they would win but as an offer of goodwill (without admitting liability bla bla bollocks etc) they would offer me £1589.92 haha up to you Natwest. The best christmas present i could have asked for. The stress of all of this was enough to put me in hospital twice last year but now i have come through stronger in everyway and beaten the big guys. Maybe next time they won't be so quick to pick on us little people, after all without us there would be no them. I can now say i am a boanified expert of reclaiming bank charges, can walk with my head high, as me, i, yes i have between them. Good luck to everyone of you. It will be hard and it will be tough and it will be downright stressful. You will be tempted to take the measley sums they offer you but i urge you not to becuase if you stick to your guns and show them they can't bully you then you to will be able to run around your house screaming. Not because you have a bit more money but because you will know that it has all been worth it and that sometimes, just sometimes, justice is done!! Lana 1 - Natwest 0 (haha)
  7. God, I hope so. This is so much spread and I'm so in debt that even the full amount of £1,200 would only make a sneeze in my little student loan and overdrafts of just over £30,000
  8. Ive just recieved another letter from Cobbetts asking me me to confirm the amount i am wishing to claim again. They says that my claim will fail in court but offer me (another) gesture of goodwill for £700. what do i do now im getting really fed up with them.
  9. Do i need to provide them with my preivous letters and replies to natwest; all the dates that i have been wrongly charged and any laws or reasons why i think its been unfair. Also is it worth stated that i have genuinely been out of work for three weeks and in hospital due to hypertension caused by stress and shingles also caused by stress and have hopsital letters to prove it.

  11. It is a long official solicitors letter saying that a copy has also been sent to the court and that they request further information. It says if i do not respond and send the infomation within ten days then my claim will be invalid 'in accordance with CPR part 18' then the claim will be 'striking out the claim'

  13. Hi, I have fileld my court claim and now i have recieved a 15 page lette from Natwest Solictors asking me various details in jargon that i really cant understand. They want to know why i think the charges are 'unlawful at common law statue and recent consumer regulations, why the claimant contents they should not have been charged, 'please specify all of the facts relied on by the claimant in support of the contentions and identify the particular statute regulations the clamant refers to, the sections of each statute/regualtion referred to and the principles of common law relied upon by the claimant in alleging that they are unlawful' Help what do i do now.
  14. I've had another letter from Natwest. It says: "The offer of £561 was made on the basis of a full and final settlement of your complaint. However as you are not prepared to accept it on this basis i regret to inform you that this offer is therefore withdrawn..... I have alerted out lawyers and litigation department of your intentions." What do I do now? Help :o
  15. My claim is pennies compared o your (1087.87) but i am a poor ex student with lots and lots of students debts totally 40,000 but thats another issue
  16. I'm sorry to keep going on but ive read all the FAQ and been to the money claimwesite and am still stuck. I know i have to fill in a N1 form but where do i sendthis to, which court and should i send another letter to the bank before i do this.

I know i am now at the court claim stage but my question is do i accept their offer; is it worth putting in a court claim, i mean will i get all my money back if i do that or waste more time and money and how do i put in a court claim. What do i fill in, where do i send it, who to, do i send another letter to the bank. God this is so hard.

Ive jsut received my 3rd return letter from Natwest who have said that they still disagree with my argument that the charges are unfair because 'they have all been associated with a lack of covering in funds in the account at the time items were presented for payments...' but that: 'in the hope of forging a comprimise', they are prepared to 'OFFER £561.00 AS A GESTURE OF GOODWILL and WITHOUT ADMISSION OF ERROR or LIABILITY' Do i accept this or is it worth taking further as the amount ive been charged is almost double this? If i contest this how do i go about doing it? Help please, its driving me nuts.

  24. Ok so that is the letter before action but they did respond just didnt agree so should i just change the wording. Is there any fair banks out there or are they all to rob us of what we dont have?
