  1. Ok that sounds promising - but how would i go about contesting this? Is there any formal letter or any procedure i should follow to enquire about it? As i now have DLC chasing again is there anything specific i should tell them?
  2. Ahh fair enough - so is there anything i can do about that? As i have now already woken up to a missed called from DLC im guessing trying to chase everything up now. Or if the paperwork is legit then theres nothing i can do?
  3. Hi guys Update: Had a response from DLC saying this is a copy of the original signed agreement How does this look? Two pages? Is this enforceable?
  4. Well at least there is someone else out there in the same boat with it just vanishing etc! Hopefully it will stay gone.. However it is still on my experian even now.. Wonder if it will disappear at some point during may.. Will update further if it does
  5. As this is mack hall deleting the entry, would i be right in assuming its either 1) they have sold it to someone else ? 2) they cannot provide the CCA so have stopped chasing it? Or could there be another reason
  6. Ok, thanks Rouge I will see if they produce anything for the CCA request and upload it when / if it arrives. So far as of yet there is still also no other entries into my credit file, by blackhorse or DLC. Would it mean anything in my favour if Blackhorse wrote the debt off as a bad debt as it says in the SRA?
  7. Update on this After hearing no reply regarding a CCA request - i had an alert from equifax saying the mack hall entry on my credit file had been deleted It is still present i believe on experian and noddle, but deleted on equifax.. odd?

Quick update: I had a letter today from im assuming a DCA which were acting on behalf of DLC, they said that i have stopped paying and are chasing again, however still nothing back from DLC regarding my CCA request.. Should i just ignore the DCA letter? Or call/write to them and update on the situation regarding the CCA? Rouge any joy finding time to have a closer look?

Apparently the legislation was something to do with being self employed but mostly working at the same place for the same person which sometimes can be classed as an employee - however no one is on a contract, they can have time off whenever they wish etc etc, so there are elements of both.. But it has come to light that we can just invoice the original company instead of going through amber pay which kind of contradicts everything again?!
  10. Its hard to word this correctly so i apologise it all sounds a bit back and forth / repeated. I work for a security firm, for the last few years its just been self employed, everyone does their own tax etc at the year end. We however dont invoice the security company who "employ" us, we are contracted to them, but we get paid from another company (Amber pay). There recently was the budget released making changes to the uk etc, and now we have been told that under new legislation, we have to sign new contracts saying amber pay are going to pay our tax and national insurance - yet we can still claim back on expenses. It seems they are trying to take the best of both worlds of PAYE and self employed - paye for tax and NI purposes, self employed for not having to pay holiday and sick pay and other benefits? Apparently people in the same industry havnt heard much about this, but to me it sounds like something isnt quite right? For example DJ's to a nightclub are contractors, they get paid as normal and are self employed, the club isnt in charge of paying their tax and national insurance, yet we are contractors for security and are being told the company paying us now has to pay our tax and ni, but we are still self employed? Sounds a bit like an umbrella company type of thing? Surely we should have the option to go either PAYE or Self employed, not a mixture of both? Its a bit of a pickle.. I fill in everyones hours worked, they get faxed off to the security office, who then pass the hours on to amber pay, who then pay us.. Any help? :/

Haha good start then Nope still no CCA, as you said they know what they have to supply i didnt send a follow up letter, but havnt had any phonecalls that i am aware of or letters from DLC since either.. And still nothing added back onto my credit file since the original disappearance of the Blackhorse entry

  15. Bump.. Any help regarding how to word a letter or at least go about making this official with explanations as to why I wouldn't owe anything? Would that not be a better option than to just not pay?
  16. It makes sense because the extra to put it up to £17000 was the finance charge which can be seen in the sar.. Are there any letters or anything I can send to try to contest against any further debt collection or anything like that? As although it would appear I don't owe anything, surely just not paying anything at all would start the ball rolling for future collections procedures or something? I have stopped paying but just wondering if there's a more official way.. I'm pretty useless with any terminology or any rules which may help me lol

SAR - Uploaded the SAR information, i have photographed and uploaded most of the things, some may be doubles of previous letters i have uploaded so whatever looks like its just a duplicate of the letter i have just left it out for example letters from the collections department. The information from the actual account of recorded phonecalls etc are all in there. I have noticed though that the reason i was not taken to court was because i started full time education again so by the looks they did not have options, but later on it also has bad debt write off.. To be honest though i have no idea by looking at this. The fact i wasnt in work also looks like the reason it would have been sold on? But i dont know.. Its frying my brain lol. The "signed agreement" that is attached, that is literally all thats there, whether thats a full agreement or not i have no idea, they were attached to sheets from the citizens advice bureau from when i went to seek advice years ago..
  19. Received the SAR now, just had a few things to do so going to get that uploaded. I had a quick read through it and i noticed that on one of the sheets it says "bad debt write off" it does have what looks like a photocopy of my signed agreement on there too, along with VT information etc. Will get that done today and uploaded
  20. Ok cool And what about the bit where they talk about enforcement and sending me a true copy of they can't find the original agreement? Does a true copy do anything for me or them?
  21. Hi i have had this letter back from DLC now after sending the CCA Request to them. Going to check the date they received the letter soon to see how long has passed, but as the rules have changed on CCA requests and how they can help, are there any up to date drafts of secondary letters to send after the 12+2 days?
  22. Looked on noddle on open and closed accounts - blackhorse not there on either side Also cannot see anything on equifax.. But from either of these i cant access historic reports as i havnt been a member of them for very long.. I joined noddle when it first launched but dont know when that was in comparison to blackhorse and i cant seem to access that report anyway..

Well looking back through my previous reports Apparently the default was added in 2012 (Much later than i got rid of the car as can be seen from previous post with the photos) On the credit file, i looked at my previous reports. The amount it was updated was quite rare - over a 12 month period it was updated by the looks 6 times.. But looking back at historic reports again, i think these roughly are the dates: On my report from 9/8/2013 Blackhorse doesnt appear to be there. (Thats as far back as i can access on experian for previous reports) Default date in 2012 16/7/2012 Next one: 11/8/2013 (first red dot entry - which i think is when my credit file took a huge drop lol) Next: 8/9/2013 Next: 6/10/2013 Next: 3/11/2013 Next: 1/12/2013 Final: 12/1/2014 And thats all there is. After that it was removed.. Also on alerts to my file: (11/8/2013) - The only alert from blackhorse on there that i can see Started: 06/08/2009 Current balance: Settled Settled on: 16/07/2012 File updated to: 11/08/2013 On my other accounts even if any of them have been defaulted before, you can see the 13-24 month status and the 25+ month status. But nothing for black horse at all
  24. Ahh ok. It was taken out I think in 2010/11.. So maybe the template I used to send them as a follow up letter is out of date
