Claim No: 6QZ29511 Claim Value £408.38 plus £50 court costs Claim issued 09/05/06 Halifax acknowledged claim to defend in full 16/05/06 Settled in full 24/05/06 "however, on a purely commercial basis, it will cost Halifax money to defend your claim in terms of legal costs that ... blah blah blah etc ... If you incur any further charges Halifax reserves the right to withdraw your banking facilities ... blah blah blah ..." no admission of liability and threats to close the account. just let em try! good luck to all and many thanks to the bank action group court summons goes off to capital one next week
  4. received two replies to LBA within days of each other offering £168 in full and final One of them mentioned the "under no statutory obligation to record manual intervention" blurb which is good! Claim will be lodged this Friday 5th May 06 Will update when i hear anything
  5. basically the bank's argument for charging so much is that someone has to personally go into your account whenever a dd or cheque bounces or you go over your od limit and write you a letter etc etc which is obviously crap. when they confirm little or no manual intervention has occurred they basically leave their argument in tatters... manual intervention are any notes, comments or decisions made about you and your account. refunds of a few charges as a goodwill gesture (which is classed as manual intervention ) makes no difference to your claim - although obviously you can't claim them twice... good luck
  6. because i ordered my bank statements over the phone from Scallyfax (£10 for 6 years worth) I didn't think to ask for: "...where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you." I've just clicked how useful this info really is if it were to go to court in so far as it really proves how little actual human work gets done on your account and therefore how unjust the charges are. I realised the day after i sent my letter before action so hastily wrote another letter stating just the above and sent it to the the same person in their complaints dept. at least i know i'll get the info before the court date if it goes that far. anyway - make sure you get this info asap and don't make the same (hopefully inconsequential) mistake i did.

  8. this seems like a useful resource when deciding who else to open an account with in case of closure of the offending account. http://www.moneyfacts.co.uk/banking/charts/banking_basic_bank_accounts.htm I'm sure I read something recommending the natwest "step" as a good basic bank account. ignore that - their penalty charges are horrendous. the co-op cashfinder seems a bit cheaper on the charges front, but still too high...
  9. many thanks ended up using a tweaked version of the final demand template (using the word fiduciary in two letters would have been excessive) with an addition at start: In response to your letter offering £80 as a goodwill gesture - your offer is accepted only as partial repayment of the outstanding balance and i do not recognise it as full and final settlement of my complaint. I also do not recognise your statement that "future valid charges will stand". This is because I am aware your current charging structure is unlawful. capital one initial request for repayment went off today as well. good luck to all take care
  10. *first request for £360 unlawful charges refund issued to halifax 12th April *£80 goodwill gesture in full & final settlement offered by halifax received 20th April I've checked the FAQs and step by step's to determine how to accept the offer in writing while stating I'll still require the remaining £280 be returned within the timescale stated in my original letter (basically 14 days from today's offer receipt). I'm concerned that the FAQ's say : "3.) you will be offered a partial refund (accept this but sign nothing ..." How do I accept the £80 in writing (while alerting halifax i also require the remaining £280) without signing the letter? Is there a specific wording that's advisable to use if i'm going to respond in writing to make sure they don't take my reply as acceptance of the £80 "goodwill gesture" as full & final settlement? halifax tried to call me yesterday to discuss my request but fortunately i was out. i do not want to get into phone discussion with them if at all possible. cheers
  11. requested mine today from a halifax business centre for no charge. seems daft to pay them for info about money they've already nabbed. will add to thread once received. holteender_rob - how long did they take to get the info to you from your initial request? cheers
  12. sidog70, you mention £10 to get 6 years statements. i just called halifax bank accounts (08457 203040) and they raised a case for a letter to be sent to me with all charge details for last 6 years. No fee for this service mentioned. If at all poss i wouldn't give halifax more money ( for info about money they've taken )which you are legally entitled to under DPA regulations. will add to this if i get an invoice on the post next week....
