  1. Hi. Sorry if this is posted in the wrong thread. I purchased a CCTV system from Amazon on June 10th 2014. In May of this year, it developed a fault. It would only stay online for 2 or so minutes. I have a 2nd device exactly the same which is fine. At the start of June 2015 i went onto Amazons website and clicked on the return item box. The page would then load, with instructions to print off a label. However this 'label' bit was blank. I thought this might be down to viewing the page on my tablet. However i could see a box stating please ensure the item is returned by July 10th. Middle of June i had to go away to Sunderland for my mums funeral, and wasnt in a state to do much. Ended up in hospital with slashed wrists. And several GP visits. Trying to get on top of life again, tried again to print off the label. I couldnt. Opened a chat with Amazon. They said very sorry you couldnt print out the label, but the item is out of guarantee now. I asked for a response from a manager. Today i got a response again stating the item is now out of guarantee, ignoring the fact that i clicked on the return item box at the start of June. They are prepared to offer a 'goodwill gesture' of £73. The item cost £150. I have quoted the sales of goods act, plus the EU directive 1999/44/EC about 2 year warranties. I have sent them copies of my email box which showed alerts as the camera kept going offline in May, before the guarantee ran out. I spend several thousands a year on Amazon and can only remember returning one item in 5 or so years. My question really is, say for example a product failed the day the guarantee ran out, is there something like a 2 week period in which to notify the company or 28 days etc. If so, i can quote that. They dont seem to accept that i clicked on the return button early June, even though i can go into that right now and see the instructions to print off the label. Really just after any advice. i feel i can prove my case should i have to go to the small claims court. I have recorded my PC and what happens when i click on the return item box. I can show proof the item stopped working before the guarantee ran out. And if needed i can show photos from my mums funeral and hospital letters re my admission due to my following breakdown. Im a bit staggered to be honest at Amazons response, but dont relish the prospect of going to the small claims court.. Thank you for reading my waffle, sorry ive gone on a bit..
  2. Hi Dye in Court today for non payment of council tax. Had no idea i had to pay, as i was on ESA. Have rang the council , paid the council tax due. However, the only gave me a week from receiving the summons to the court date. IS this correct? Im basically trying to dispute the court fees which make the majority of the summons. I can see from their letter, they issue the Summons on a friday, send it second class which then arrives the next Wednesday to be in court on the Thursday. Also , do they have to justify in any way the costs they are trying to claim. I used to draft small claims court summons's years ago and the fee we could claim was around £70, usually took us an hour to draft the paperwork, but seems these are all produced in bulk via computer systems. I know im leaving this late. Honestly didn't know know i had to pay anything. Had issue around April with self harm, wasn't checking post etc. Thats no excuse. But does make me angry when it seems they are doing everything they can to give people as little time as possible to respond to court requests. Seems a bit like the situation re traffic fine, council are more interested in the fines that putting up decent signs etc. Anyways, have to leave around 10 am. Was trying to get help from CAB as to what notice for court appearance is required. they didnt seem to know. Suggested it may be 14 days. Does this mean they can send the summons second class last thing on a friday? Sorry for the waffle
  3. Hi. Hoping for some advice. Mum has an ipad 1 3g model, roughly £500 cost. Bought from Currys 2 years 2 months ago. Problem when charging. If its left in charging and gets to 100% it shuts down completely. Can take up to an hour to reboot. For the parents its a lifeline. Elderly, dealing with cancer, keep in touch with skype, emails. To me this doesnt sound like a battery issue, as it holds its charge. Seems to be more hardware related. Currys simply state under sales of goods act that batteries are consumables and therefore the SOGA doesnt apply here. They also tell my parents to go to apple, as they dont deal with apple battery problems. My questions are... Firstly we dont know its a battery issue. However , if it is, Ipad 1 batteries were actually glued into the ipad. There is no way for an average consumer to open up an ipad and replace the battery. Therefore i feel this is an integral part of the ipad 1 and not a consumable. I also have a recording i made for personal use with a lady from Apple who states it is 'perfectly reasonable' to expect an ipad battery to only last 2 years. If however the battery is glued in, and made so that the consumer cannot replace it without going to an apple authorised dealer , i dont feel this is a consumable battery in the same way a laptap battery may be. They are in effect admitting its reasonable to expect an ipad to last 2 years only. If a consumer tried to replace the battery themselves the warranties would be invalidated. Does anyone have a view or advice or whether 'impossible to remove' batteries by consumers are classed still as consumables? Secondly, Currys simply refer us to Apple. Ive advised we dont know if this is a battery related issue and that our contract is with Currys, not Apple. However, no joy here, they stick to the same line. Any advice as to how to get Currys to deal with the issue? Lastly, i realise that if i was to issue small claims court proceedings, i would need an independent report done on the ipad to show the fault. Anyone know of anyone decent in the Nottingham or Manchester area. Many thanks.
