Yes may well do, just recieved one of those cringing emails from the Nationwide Legal dept this afternoon, with one of those backcovering slimey responses, stating that they felt it was in my best interests not to pursue the debt whilst under litigation procedures, & how they have the right to pursue it, strange how they feel I have no rights to persue them, when they told the FOS ''Nationwide has not specifically advised what the terms of the settlement will be. Nationwide has indicated that it is not disputing its liability any further,'' & I can tell you that having considered it, Nationwide has told us it is prepared to settle the complaint. Specifically, it has said that on the underlying s75 claim, it is willing to reimburse you the full amount that you paid ( my emphasis ) to the merchant. eemm

My thoughts, I've just wriiten to the Judge informing her of these events & how inappropriate they are when trying to reach a settlement, & Aktiv Kapital have just confirmed by email again that they are removing entries with the credit reference agencies!as I said I would write to the OFT & make a formal complaint against them.

Well would you beleive it, told Aktiv Kapital that I was lodging a formal complaint with FOS, & by email this morning a smarmy apology, stating they had been waiting for a response from Nationwide, who coincidently have informed them they are repurchasing the account & they have no further issues on it.

OK the debt has not been cleared it is in dispute, i am suing nationwide under section 75 cca under misrepresentation of a service purchased using their card, the originating company went bust, the ombudsman agreed that the consumer chain was proven & that nationwide were responsible for the original purchase & the consequential losses, which are considerable & vastly outweigh the original purchase, nationwide agreed in writing to settle after seeing a legal opinion from a QC & expert in the field, they stated to the ombudsman adjudicator (got it in writing) they would not contest liability further, I refused the ombudsmans decision as it never went anywhere near the loses incurred, also the ombudsman made mistakes that had I accepted would have cost me further losses, so I decided to take them (nationwide) to court who are now contesting the whole thing, however they have already made a without prejudice offer which again is less than the ombudsman offered & tied into a gagging order. Global arrow who purchased the debt, when they found out after I threatened them with defamation of character then sold the debt back to nationwide,& for the firt time in four years I managed to get a bank account again, I have repeatedly tried to contact nationwide, they will only answer via the court process, they wanted me to pay them £1500 towards an independent mediator, at the same time they sold the debt again to Kapital Aktiv, again blocking any credit pathway for me, so it has been a complete mess.
  5. I am complaining that a financial institution can damage your credit history, even after having had it put right already, they are allowed carte blanche on this & they dont seem to be regulated in these actions!!

I have in fact been in contact with Aktiv Capital sent them copies of the FOS decision the without prejudice letter, copies of Global arrow informing me they are putting the credit history correct & returning the debt to the originator, all they keep saying is the account is on hold & they are awaiting a response from Nationwide, been like this for over two months now, I don't believe them, I think nationwide are playing dirty cause the court process is moving into the final stages & I rejected their out of court initial settlement & their gagging documents.
  7. in 2009 Had a section 75 ongoing with FOS Nationwide first bullied me via KPR their internal debt collectors, then sold it to fredrikson international then onto Arrow Global, the section 75 was found in my favour by the FOS after a protracted period, the FOS made an appalling offer so I rejected it however I had it in writing that my credit file should be cleared, Global arrow returned the debt to Nationwide & cleared all of my history, then I went to court which is still ongoing, without any notice Nationwide have sold the debt again to Activ Kapital, even though they have made a without prejudice offer on the account, anybody any ideas how to challenge this, seems that Nationwide can hold me to ransom on my credit, but I can't do nothing, even though in letters to the FOS nationwide agreed to settle & said at the time they would not contest liability!!!! Vile malicious people.

Just remember as of 2010 the law on this changed & if you accept the ombudsmans decision & then try to persue the company afterwards through the courts, this is not allowed, I found this out & it would have been extremely costly had I followed the advice of one of the FOS ombudsmans managers,I found out this was wrong through a friend who was a solicitor & the independent assessor confirmed that, mind you though apart from that she, the Independent assessor, was as much use as a chocolate firegard!!!

Found these responses facinating, in 2009 I bought a section 75 to the FOS, who made a complete bodge job of it, infact it took them 2& half years to come to a decision, & that was because I got a leagl opinion that blew their arguments out of the water, it involved Nationwide Building society, who are & as I have seen on this site, too my cost the most vicious, malicious lowlifes I have ever encountered, basically twice during the claim they sold the debt onto debt collection agencies, then at the end of the FOS decision in my favour: by the way the outcome was so poor I am now in court action against the Nationwide:they were forced by the debt agency to buy the debt back, then after the initial court hearing when they told the judge they wanted to mediate, they sold the debt again without informing me, again damaging my credit, oh & in between that they sent me an out of court without prejudice offer as long as they gagged me into the bargain!!! They are evil, malicious,they try every dirty trick in the book, ignore emails ignore letters, fail to respond to phonecalls when they say they'll get back to you. Pure vindictive, nasty individuals who try to goad you & then turn the story around to make it look like you are the aggressor, The ombudsman gave me the wrong information regarding the actions I could take that the independent assessor reviewed critised them & then offered me £45 in compensation!!!! I to am looking at getting the media involved having seen the FOS CEO this morning telling sky news how they must challenge the customer approach of these financial institutions, see if she puts her money where her mouth is ??
