  4. Hi After a long wait pursuant to sending a CCA request to Intrum they finally sent a copy of an agreement and copy statements but no page showing my signature. I had been paying this anyway within my stepchange repayment plan but I have now come out of the plan and would like some guidance on what my next move should be? Thanks

  15. Hi Looking for some advice I have been paying Stepchange for over a year now. Various Credit Card + overdraft debts totalling just over £30k. I will be hopefully in a position to clear them next year if I can get F&F acceptance at around 35%. Should I also be seeking to obtain CCA's to see if the debts are enforceable and also look at unfair charges etc on the overdraft (Santander) Also possible unfair charges on original account when it was A&L The more I can reduce it down before I make any settlement offer the better really thanks

  17. Can anyone help please. RBS allowed my son to open an account online and then verified account in branch with ID proof back in August. Paying in book arrived with letter saying debit card and PIN to follow. Nothing arrived after 2 weeks. Lots of calls eventually got an answer mid October saying sorry cannot issue a debit card on that account on that particular sort code with that branch (Child & Co. London) Unable to put any money in as no way to get it out. 3 failed attempts by RBS to transfer to another Sort Code eventually our patience snapped and we have gone elsewhere. Still no proper answer to how it went wrong. Looking now for compensation because of not being able to use account for 2 months. Any idea how to calculate non-financial loss and for time spent sorting it out (many hours!) Any advice gratefully received
  18. Update on this. I made the final monthly payment on this back in March and sat patiently waiting for a letter from Santander to drop through my letterbox giving me a date that i had to make the final balloon payment by or return car etc but nothing happened until last Saturday when I received a phone call from Santander telling me that the final payment was overdue. I told them I had received nothing from them. They said they did not send out a letter when they had extended the original agreement by a further 12 months. So I am just meant to pay the lump sum with no further invoice or anything. Trouble is they now tell me that it is overdue. surely they need to send something to comply with consumer credit regulations? Does anybody know about this?
  19. I cancelled the direct debit so there is no issue there. it is just the residue of my payments that had built up in "the pot" after service costs had been taken out. My issue is not only with the fact that nearly £300 of my money is sitting there in their account and they acknowledge it shouldn't be, but getting to the bottom of whether this agreement is a financial product. I am having the agreement perused by a barrister under the Direct Access scheme to clarify this. There is no point in complaining to the FSA if it is not deemed to be within their remit. There is nothing on the document to say it is a credit agreement.
  20. Any views on this welcomed. When i bought my new car 4 years ago I took out a service plan through Essex Ford that i paid monthly. I now have a problem because i cancelled the service plan over the phone back in February but they never cancelled it their end. I am due a refund and should have had it in accordance with the terms of their contract by the end of March. They have now cancelled it and say I will get my money by the end of June. It is nearly £300. They admit their mistake and that they are in breach of their terms but wont pay up any quicker. Is this sort of agreement covered under FSA rules and can I complain to the Ombudsman?
  21. Update on this matter. had a letter from Santander saying that while they didn't feel they had done anything wrong, they were prepared to extend the agreement by a further 12 months for me. So a happy conclusion to this saga. Still don't know why someone there couldn't make the decision in the first instance to save me a few weeks of turmoil but am pleased that they came around in the end.
  22. There is a test case on in the High Court next week that might provide some clarity on the bedroom tax issue. I will try and post a link to the judgment if I can.
  23. Yes I faxed it straight over with a letter apologising for the oversight and when I spoke to them on the phone I offered to pay by debit card there and then for that months payment they refused to take it. Incidentally, I still haven't received anything in writing from them.
  24. I took out a credit agreement with Santander Finance in 2010 for a 3 year car loan with the usual balloon type payment/return car option at the end of it. However, I wanted the car for a further year and they agreed that I could extend the agreement for a further year. They sent me a form which had to be ticked and returned and a document entitled "Agreement modifying a Credit Agreement" which had to be signed and returned by 2/4/2013. Unfortunately I overlooked this and failed to return it as I had a lot of other things going on at the time and I got a call yesterday stating that they had terminated the agreement and were taking steps to repossess the car. Has anyone experienced this? I have not missed a single payment and the documents they sent me said nothing about failure to return them in time would lead to these steps being taken. I assumed the Direct Debit would continue regardless and the money was there for them to take it. I have written to them yesterday quoting the OFT Unfair Relationships Guidance stating that that the Agreement is a related and linked one to the one I have already signed in 2010 and that termination is unfair. Any advice gratefully received
