  1. Hi all. I bought a TV from John Lewis online in the Black Friday sales. The TV is faulty and JL say they cannot exchange as the TV is now £150 more expensive. They can only refund my money. Is this right?
  2. I looked round a house and applied for it, giving £105 over to the Letting Agent. About 23 hours later I decided that I didnt want to move into the house. I rang up the LA and they refused to refund my money. They say it clearly states in the Terms and Conditions they gave me that the monies are non refundable. The Terms and Conditions they gave me had to be signed and handed back at a later date. As I decided so quickly I didnt want the house I never signed the documents, and thus never handed them to the LA. I have not signed anything agreeing that the £105 is non refundable, so should they be forced to give me my money back. I told the LA that they could give me a part refund, as I'm sure they mustve made some phone calls and had an employee take the house off their website. But they still insisted, 'No'. That £105 included the refencing fees. I have never been referenced so they must be able to give me at least something back. But ideally I'd like they whole lot back. Does anyone have any pointers or ideas?
  3. I belive a pair of shoes, whatever weight the user is, should last more than six months. Does anyone know a specific part of legislation I can use in this case?
  4. Sales Of Goods Act is that? Is there a particular piece of the legislation i can quote?
  5. I bought a pair of shoes in July from Clark's for £30. On sale from £60. I tried to take them back today as they have worn excessively in the heel area. I have my receipt. The manager said shoes only have a28 day guarantee and as a gesture of goodwill will only give me a£20 voucher towards a new pair of shoes. I thought everything came with a years guarantee. I also feel these shoes should not have worn so much in the heel area in only six months.
  6. Part 5a states: (1)If section 48A above applies, the buyer may require the seller— (a)to repair the goods, or (b)to replace the goods. (2)If the buyer requires the seller to repair or replace the goods, the seller must— (a)repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer; (b)bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).
  7. I purchased a system from this company in February 2012. In July 2012 a fault developed with the disc drive. I reported the fault on 12-07-12. I was asked to fit the replacement drive myself, which I agreed to. This was sent to me nearly two months later on 07-09-12. It did not work so I sent it back. After months of promising that he was going to get me a new part, the owner advised me that if he does not hear anything by the end of Feb 13 he will send me a totally new unit. By 07-03-13 I had not heard anything so I emailed to request my new unit. He emailed me back saying he was expecting a new disc drive for my unit in the next week. I advised him that he had said I could have a new unit, but he stated he was within the 'consumer code' to try and repair the unit before sending me a replacement. Over the past few weeks he has been saying that the new disc drive is comming. But it hasn't arrived yet. Where do I stand? Its been over eight months now since I reported the fault. I have already been sent a disc drive replacement that didnt work, so he has already tried a repair. Am I within my rights to ask for a replacement of the system? Is there a case to take to a small claims court? What part of the Sale of Goods Act 1979 can I quote to try and force him into giving me a replacement system? I dont know if its worth mentioning, but the way this company works is a little strange. They do not keep stock of the systems they sell. You pay them for a system, then they order on from their Chinese supplier.
  8. I have tried to re-open the case yes. But Lloyds do not reference my previous application at all in their three page response to me. To be honest I had forgot about my previous application until i was filling out the FOS PPI complaint form, and it asks if you have claimed before.

I originally said 'i did not know i had taken it out' It was for a credit card I have said to lloyds now the salesperson pushed me into buying the ppi The have replied saying that they will not give me compensation. I replied back saying i really want compensation and they sent me a letter advising to contact finacial ombudsman
  10. I applied for a PPI claim with Lloyds in 2008 but got rejected. Can I claim again now?
