  6. Couldn't comment on old thread for some reason so had to do a new one, sorry. I emailed MC about a payment plan and asked to explain their charges, also, informed them I had received a debt collection letter and a letter saying they would take me to court even though I have NOT been contacted by any debt collection agency. Also, told them I had no access to the internet via a computer (using my phone) and couldn't send them the hardship application as I can't view the site on my mobile. This is the reply I received: Dear xxxxxxxxxxx, A MiniCredit Claims Department member has replied to your claim, #xxxxxxx with the following response: The Following Response is being sent to You according to the Formal Complaints Procedure. Microcredit Ltd has activated the Hardship application for You since the beginning of August 2012 but we have not received the form from You yet. Microcredit Ltd provides short term payday loans. The Customer chooses the due date him/herself and it is also possible to apply for the roll-over latest on the due date and keep the loan for another period of time if the credit check result allows You to. The Loan Agreement was signed by Yourself and sent to the e-mail address You entered on our webpage during the registration. According to the Loan Agreement You have to make all payments with a debit card and the only possibility to make payments is available on Your MiniCredit.co.uk online account. We accept all payments You make and may provide You up to 120 days from the due date to clear the balance before Legal action is started. All the overdue charges and interest have been added to the balance according to the Loan Agreement and will be added until full repayment. Payment plans with decreased balance can only be offered to Customers who suddenly face unforeseen financial difficulties after taking out the loan. For example the Customer who takes out the loan with the intention of setting up a payment plan on the due date (the cause of the financial difficulties happened before taking out the loan) does not qualify to have the balance reduced and the payment plan set up. * 1.***** Why was the repayment not made on the due date? 2.***** What happened? 3.***** When happened? * The three above questions are necessary to be answered and supported with documentation to see that the loan was originally taken out in good faith and You have the intention of making the full repayment latest on the chosen due date. According to the information provided to us at the time of applying You were having a full employment. The following information has been taken from the Loan Agreement: KEY INFORMATION If you break this Agreement, we will charge you if we unsuccessfully attempt to obtain repayment on the due date for repayment. A fee of GBP25 will be charged on the day that your missed payment was due. If we unsuccessfully attempt to obtain repayment on the due date, we will attempt to obtain repayment a second time 2 days later, and if we unsuccessfully attempt to obtain repayment on this second occasion we will charge you a further amount of GBP55. If we unsuccessfully attempt to obtain repayment we may charge up to GBP5. If we unsuccessfully attempt to obtain repayment 30 (thirty) days after the due date we may charge further GBP100 manual debt collection recovery fee. Interest on any sum in arrears will be charged at the contractual rate, both before and after judgment, until payment. Also, you must pay us all other reasonable costs and expenses we incur (including any legal costs on a full indemnity basis) in tracing you, or enforcing, or attempting to enforce, our rights under this Agreement. Repayment, Default and Recovery 8. You agree to make all payments to us under this Agreement at the proper time. We will collect payments by debiting your bank account using the debit card details you have registered with us up to three times per day. You authorise us to debit your bank account to collect payments due under this Agreement. If we are unsuccessful in collecting payment, we may try to debit your bank account again at a later stage until we have successfully collected payment. If you have provided us with details of a second debit card and we are unsuccessful in collecting payment from the first debit card, you authorise us to seek payment via the second debit card in the same way as you authorise us to seek payment via the first debit card. You must give us new valid debit card details when you cancel, lose or your debit card(s) registered with us become(s) invalid when you have unpaid loan with us. If you cancel your debit card registered with us and do not provide alternative debit card in 14 days we may add all the default charges described in the Key Information and potential attempt fees regularly charged until default date what is 120 days after the due date to your loan balance and refer your account immediately to our debt recovery partner. You may find the partly repayment possibility on Your MiniCredit.co.uk online account 24/7 and use it for payments of any amount. You accepted the Loan Agreement and therefore also the charges that have been added according to it. As You are asking for the possibility for being able to make partly payments we would like to refer You to the "Repayment" possibility on Your on-line account. Microcredit Ltd does not forward Your account to a third party collection agency within 120 days from the due date and our own Debt Recovery department will deal with the issue instead. On the 120th day overdue we will start Legal proceedings against You. Please read more about Your responsibility to make sure that the debit card details are up to date from Your Loan Agreement that is available on Your MiniCredit.co.uk account. The partly payments can also be made with Ukash vouchers. Microcredit Ltd considers that all the overdue charges and interest have been rightfully added to the outstanding balance according to the Loan Agreement You accepted. We are willing to consider the possibility of a settlement figure if it is reasonable and paid in full. Please contact our Customer Support on the number 08718903015 when You have funds available to offer as full and final settlement. If the settlement is agreed, the payment has to be made with a debit card immediately. We hope this response has sufficiently answered your questions. If not, please do not send another email. Instead, reply to this email. Kind regards, Minicredit Claims Department Any advice on what to write back/some legal info? Would be appreciated as I'm not very good at writing letters
  7. I am having some trouble on what to write in my complaint to OFT and to MC themselves. I'm not sure what to include and what wording to use. Is there any chance you could help me with a few key points to write? I now have payment plans with all my pdls except MC
  8. Sorry to be a pain, but I managed to get my wages paid in cash for 2wks, if my savings account has the same sort code but differnt card and account number to normal bank account, would bank allow MC access to savings account?
  9. What else should I do? In that one email and one letter, they have stated 3 different amounts owed, when sending email to oft should I also send my email asking for repayment plan? Also, should I reply to minicredit? Any legal info I could add when emailing them would be great. Getting stressed with it all now

  13. I am going to see about a coop basic cash account monday as I've got 12hrs between shifts this weekend (nights). I currently have these payment plans which are great for me: PaydayUK - £20/24th, £40/31st MoneyShop - £60/29th monthly I have a loan of £385 outstanding with QuickQuid as well and was wondering if you had a template letters for requesting a replayment plan and correspondence in writing? Also if possible, a template for minicredit to state I will pay original loan amount and one months interest, especially as they have taken wages (as mentioned earlier). Sorry if I'm a pain but I'm not very good at letters and have read your advice on some other posts so will be sure to CC all email correspondence I send them. I will also keep the money I'm willing to pay weekly/monthly safe incase taken court (had two debt collectors letters and heard nothing, one about court and nothing, and hardship form but going to write 'amount' to everything). However, the letter to my bank etc, it seems from various thread I'm with the worst bank for anything like this (barclays). So just want MC and QQ agree to repayment plans. I could pay the amount currently owed to QQ in 4 months at £24 a week, should I make this offer? I'm really grateful for any help people could give me as its causing sleepless days (work nights)
  14. Hi, could you help me write a similar letter to MC? I borrowed 100 and its now around 800, thank you
  15. Your very helpful, thank you. Could you help me draft a letter to barclays? I'm not very good writing letters I have been looking at other posts about asking bank to stop CPA but it doesn't seem as though anyone has much luck with it, do you know of any other banks where I will be able to get an account? I have agreements with a couple of PDLs so would have to give them new bank info
  16. Thank you, sorry if I come across as dumb but what are chargebacks? They are accessing my account every friday at around 1am so I have been going to bank and getting my wages before they do but I work nights so its quite hard. My friend said I might not be able to get an account with another bank due to minicredit, I'm with barclays so would setting up a new account with them work? also what's CPA?
  17. I got £100 loan from minicredit around 3 months ago, only received £80 and don't know why that is. I have been unable to pay my loan, however they aren't replying to any of my emails and keep ringing my workplace! It was originally £137 to pay back and is now around £800. However, they have taken my full weeks wages on two seperate occassions which totals £430. They are still sending me letters saying they will send it to a debt collectors and take me to court! What can I do to stop them taking my wages? Will reporting my bank card lost and getting a replacement prevent them from being able to take money out my account? I have asked them if they can arrange a payment plan and freeze interest as they have already taken original loan amount nearly 4 times! Please help
