  1. Firstly, the eu directive is superceeded bu SOGA 1979 (AS AMMENDED). As your washing machine is under 6 month old, Argos or their nominated repair agent (indesit) are legally entitled to inspect the machine to determine the exact nature of the fault (this also rules out a non manufacturing fault-ie- objects in machine as this wouldnt be covered and does happen). If a manufacturing fault is confirmed (which it sounds it is in your case) a full refund or replacement can be requested under SOGA 'not fit for purpose'. Hope this helps!
  2. no I was stationary parked up when my car was hit. Having just spoken to the police they have said no cameras in the area so nothing on camera. They have also said not interested in the fact the other person failed to stop.....i assume it is fine to damage cars, fail to stop etc now with no fear of anything happening about it.
  3. Hi, I am after some advice or opinions if possible please. Today my car was crashed into (whilst I was in the vehicle), the person responsible stopped to check the damage for few seconds and then decided to drive off on seeing I was sat inside! Great I know, but the sort of thing you expect in todays society! I am hardworking, have served 26 years in the military, hence made a split decision to follow the person responsible.. ...during which time I ran a red light (i was cautious during this process, and the road concerned in not very busy) -this was purely due to fact the person was clearly not going to stop. Having taken all details and pictures of the damage it then dawned on me that running the red light could be caught on camera? As I am honest, I went straight to the police station to admit the red light..... and pointed out that this was purely due to the failure to stop of the person hitting my vehicle. They now say I may get a fine and 3 points!!! I feel disgusted that through no fault of my own I am now faced with points etc. Is this not an example of mitigating circumstances? Your thoughts would be much appreciated? Can they fine me purely on my say so and no evidence (assuming I was not photographed)? Thank you

    With regards to the selling store inspecting the tv,as they are not technically qualified the store are not in a position to confirm what or how the fault happened. Hence the need for a qualified engineer inspection. Legally a retailer can complete a full inspection (as in this case). On inspection if a fault is confirmed and is not as a result then a refund or exchange would and should be given. With ref to the 6 months I mentioned I was simply trying to highlight that if comet try to insist on a repair,to refuse this. In a court when an item is so new (up to 6 months) it is the retailors responsibility to prove that the said item is fit for puspose and durable when sold. Clearly in this case 12 days is not acceptable,therfore not fit for purpose or durable.

    sorry to hear of the issues your having with your tv. Companies will always look to inspect an item (legally entitled) to determine the cause of the fault. This ensures the fault isnt due to not following manufacturer guidelines or due to misuse. It doesnt suprise me with the lack of communication though with ref to visits etc. Generally under 28 days comet will confirm fault and exchnge tv,although a refund can be requested. In addition if they suggest a repair,refuse this under Sale of Goods Act 1979, as the tv clearly isnt fit for purpose or durable when sold. Also as tv is so new (under 6 months old) it is the responsibility of comet to prove it is fit for purpose-they cannot prove this in this instance
  7. no,i was part of comet up until 6 weeks ago (redundancy). Unfortunately things at comet are worse than ever (and I worked for them for 5+ years)! I sympathise with you fully,in this age you would like to think keeping a customer for life is more important than the ignorance you have most likely experienced with comet. I would say you are most likely to have a better resolution is you continue with manufacturer direct (which you are doing). Im also shocked that this post hasnt being picked up by comet as this is monitored (or should I say not shocked)!
  8. hi,i fully appreciate your circumstances,and am sorry to hear of the issues you are having. However many many companies do not provide a new manufacturers guarantee when exchanging faulty goods although this isnt nesessarily disclosed at point of sale (unless specifically asked by customer). In addition whilst im aware SOGA has being mentioned,as the purchase was made over 6 months ago it is the customers responsibility to obtain evidence that confirms the item has a knon defect or inherent fault (ie to obtain 3rd party report). This will however need to be evidence based and not just an opinion of the person responsible for completing the report. Also ignore the advice regarding the 2 year obligation,as in the UK we adopt Sale of Goods act 1979 as this superceeds the EU obligation by covering up to 6 years.
