  1. Just got this email. There's nothing suspicious in the headers, and the email contains my correct customer ID and name. I don't have an active loan with QQ, but I have applied in the past and was declined. The email also demands you call QQ and the number given is correct. All links in the email go to the correct place. They've messed up.
  2. Thanks again mariefab, I'll go through the numbers again later. Just wanted to say I now finally have a copy of their working out, and they haven't paid my two weeks pay in lieu of notice.
  3. Hi, I should have clarified that I also got all bank holidays off and paid, but counted these as working days for simplicity. Should I be paid for the remaining bank holidays? I believe my pay covers the whole month, and that's where I'm struggling to calculate the correct pro-rated amount. I've been paid £2246.02 so far, so if my calculations are right then I'm owed £252.96
  4. Hi, I definitely do have a valid claim for unfair dismissal, but we parted on friendly terms and I was promised a good reference. Once I've got a new job, then I'll think about pursuing the UD claim. For now, I just want to make sure they've calculated my final pay properly, I don't think they have.

Holiday entitlement runs from 1st April to 31st March Holiday entitlement was 27 days, with 1 day taken this year I was paid monthly (25th) in arrears for a salary of £27,500 (gross) or £20,515.76 (net) I had been employed for over two years My employment was terminated without notice at the end of the working day on 20th May My workings (net) are: Monthly rate = £20,515.76 / 12 = £1,709.65 Weekly rate = £20,515.76 / 52 = £394.53 Daily rate = £394.53 / 5 = £78.91 3 full weeks from 25 Apr to 20 May = £1183.59 3 full days from 25 Apr to 20 May = £236.73 2 weeks PILON = £789.06 7 weeks worked between 1st April and 20 May + 2 weeks notice = 9 weeks holiday entitlement 27 days entitlement / 52 weeks = 0.519230769 days per week 9 * 0..519230769 = 4.67 days holiday - 1 already taken = 3.67 days holiday 3.67 * 78.91 = £289.60 1183.59 + 236.73 + 789.06 + 289.60 = £2,498.98 How far off am I?
  6. After reading this thread, I feel very lucky that I was able to get Motormouth to back down. I haven't heard from them since 13th May. I'm a bit confused by what dpick has said, on the one hand reconstituted agreements are allowed, on the other my account was opened in 2006 and so they must supply a copy of the original agreement. Can anyone please confirm? I need to write back to them. Today I received a "final demand" dated 12th June. Their response to my CCA request was dated 13th June. I sent an 'account in dispute' letter on 31st May as they had not complied with my CCA request in time. Am I right in thinking the final demand should not have been sent while the account was in dispute?

They appear to do in-house marketing of these trading styles, which include: CashLady (made famous on TV by Kerry Katona, and recently subject to a ruling by the ASA) PaydayLine cash-in-1-hour.co.uk KiwkPayDay FlexCredit Cashtilpayday KwikPayDay 12monthloans.co.uk C Squid / Cash Squid Cheetah Payday KwikCash paydayloans300 FastPony Payday in 1 hour Payday Bank Payday Direct / randommoney.co.uk Mypayday One of the PDLs I've had recent business with appear to have passed them my details. In the last month I've received 23 emails and 8 text messages from them, covering their various brands. I'm currently hammering them with a formal complaint whereby I'm using the DPA to force them to remove my details from their systems, and also claiming damages for lost time, intrusion into my day-to-day life, and the distress caused by the huge volume of messages I receive. I've also sent a complaint to the OFT, which is made on the basis that this type of advertising must be irresponsible. The numerous brands serve to confuse customers, and are probably designed to get vulnerable people to make multiple applications when they're desperate for credit. In my case particularly, PDB UK must know I have/had recent active PDLs as they would have been passed my details from a PDL. Despite knowing this, they're effectively pressuring me into taking on more debt. I'm also investigating whether recent texts I've received offering to set up payday loan repayment plans are from PDB UK. It would be brilliant if they are. Brokering as many payday loans as they can on one hand, and then making even more money by duping people into repayment plans.
  10. Sorry, I misworded my post. I'd like to submit my individual complaint to OFT so they can keep it on file. I know they won't deal with me individually, but they do like to collect information, and must already have a file on the DCA in question.
  11. I've looked around their website but the only form I could find was for advice agencies and "other third party organisations". How does a consumer make a complaint?
  12. Just an update for anyone following this thread. Wonga completely ignored the formal complaint I made. I then involved their trade association, the FLA, on 7th June. Two working days later (11 June) Wonga finally got in touch with me by phone. They simply talked through the repayment plan we agreed in April 2012, and they argued that all interest and charges added to my account was due to me not sticking to my repayment plan. This is wrong for two reasons: 1. The balance owing NEVER increased during the lifetime of the repayment plan; all penalties were applied to my account before it was set up; 2. They had issues collecting payment, which is true as they would attempt collection before I had been paid. I would always call them before they end of the day and make payment over the phone. The required payments were always made on the required dates. No exceptions. They concluded that they see no reason to refund any of the interest and charges. I complained some more and was told the complaint would be passed to 'senior management' and I would hear from them that day. I haven't heard from them at all yet. Finally, Wonga have still not fully complied with my SAR by providing a breakdown of all charges added to my account. The deadline for this is 18th June.
  13. Totally agree about their insane charges. I lost my job on 20th May, with a Minicredit loan due on the 27th. The loan was for £100 + £10 interest. Within two weeks they were demanding over £300. lol.
  14. Hi all, Thanks for the helpful replies so far. I don't have the exact date I opened the account, but the first transaction on my first statement was 31st March 2006, so I would have opened it a few weeks before that. None of the documents except statements have an APR. A few years ago HSBC increased the APR slightly. The statements are very recent (this year), which means they've sent nothing that states the original APR. BTW, I think HSBC's Metropolitan Collectin Services / DG Solicitors thing is ridiculous. It has me confused, and I guess that's the point. For example, I've sent letters to DG and MCS, but had replies from HSBC headed paper. I've sent letters to HSBC and had replies from MCS. I wish they'd be consistent as to which brand they want to use.

No APR. Appendix 2: Notice of Variation to Terms A printout of updated terms and conditions. Has tables detailing APRs, etc, but these are all listed as (on your agreement) - no actual numbers are given. No information to suggest this applies to me. Appendix 3: Copy of Historic Terms and Conditions Yet another printout. No information to suggest this applies to me. No APR. Appendix 4: Credit Card Agreement Form Has HSBC's address. MCS or HSBC have hand-written my previous address and DOB into this agreement. I was at a different address when I opened this credit card account in 2005/2006. APR is blank. Has a signature box which is left blank. Appendix 5: Two recent statements Shows correct personal details and correct APR.
  16. Hi, I've been getting spammed by text message and phonecall by Moorcroft. They didn't identify who they purchased the alleged debt from. They did leave a reference number in a text message, which allowed me to log into their website and submit a message along the lines of: "Your communication by text message and telephone will cease immediately, and you will contact me in writing. Failure to comply will put you in breach of the Protection from Harassment Act 1999, and s.127 of the Communications Act 2003. Any future communications will be recorded and logged to be used in evidence." They responded by letter saying: "Thank you for your recent correspondence, I write to confirm we require a monthly repayment proposal you can afford and maintain, to enable us to assist you further." This seems to imply they won't stop texting and calling until I agree to hand over money to them.
  17. Hi, The Consumer Wiki article was last updated in 2007. Before the OFT test case. This article from This is Money was written in 2012, after the OFT test case, but a cagger commented on the article and said that even it was out-of-date. Could somebody point me in the right direction? I know cases of hardship can help. I lost my job on 20th May. Can I reclaim charges for the last few years, even though I was only just made unemployed? Mainly I'm looking to reclaim fees for failed direct debits.
  18. I'm in receipt of their lousy 'Statement of Account' which lists these simply as 'Charge' and 'Fee Interest'. Charges make up £281.50 including two charges for £75. 'Fee Interest' totals £64. I guess it's time to fire off another SAR?
  19. I'm not sure what to do then, as the majority of the claim is interest and charges? More than double what I actually owe. Should I just quickly state that I think they're unfair/unlawful, move on, and hope the judge sides with me?

  21. Hi, raydetinu, it has all of those things: I keep reading on CAG that PDL agreements aren't regulated; and they can't enforce the unfair interest and charges after the fixed term.
  22. Hi, I've just read the OFT Document, "Consumer credit - regulated and exempt agreements". It states: My agreement with Safeloans is headed, "Fixed Sum Loan Agreement regulated by the Consumer Credit Act 1974". And contains: Could somebody advise? Basically I need to know whether charges and interest beyond the original capital and interest are fair and enforceable?

I drafted this earlier, which nicely gives them another chance to fully comply with my request: If I don't get what I want from them, then I will fire off one of the strongly-worded templates once the 40 days are up.
  24. Hi, Wonga have mostly complied with my SAR. They didn't pay full postage so delivery was significantly delayed. Some of the information is in a format I can't understand (below) and they haven't sent a statement of account showing all interest, charges, etc.
