  1. All my £25 charges were detailed correctly so they got included as Unauthorised O/D Fees. The £5 charges I have accepted as legitimate. This seems to be a problem the generated amongst themselves as a few people have questioned it in the past IIRC. I guess it's a case of may as well confuse the peasants while we rob them :? .
  2. I have already started this approach and Barclaycard have gone into default on the CCA request today so just waiting another 30 days then I am going to hit them where it really hurts. They haven't even acknowledged the CCA request yet. Tamadus

  5. Ahhh but I have claimed reciprocal Interest, this is the smaller account of the 2 I have with them and the 2nd should be ready to file by the weekend. Unfortunately using their reciprocal rate means I cant claim the s69 rate:( so I have calculated up to today and also claimed 45p a day till settlement. This should be interesting as they offered me a paltry £175 'goodwill gesture' on this account but I have no way of checking if its been refunded yet as they stopped sending me statements, so I have claimed the entire total and will alter it if/when they give me evidence of a PAYMENT to my account. I am not accepting a sundry credit as that will have no bearing on my payment history and I have already made payments to them of this money. I also intend to push for removal of any adverse comments on my credit file Going to get the next account ready in the next couple of days and also prepare my document pack ready for court if they take it that far. The other account has also increased now due to compounded interest
  6. Ok traced them down and the company is Newman and company and they are a DCA but I have no idea who they are working for. I guess I'll find out in a couple of days.

  9. No offence taken Caro. If it is a DCA they are another one about to get a rocket where they wont like it I have an S.A.R - (Subject Access Request) outstanding with GE Money which they received on 8/8/06, on the 31/8/06 they passed my file to a DCA. The SAR time expires on the 16/9/06 so by passing it over (and having cashed my cheque on the 10th) they are definitely trying to wriggle out of their legal responsibilities. I have told the DCA by phone the situation and I am following it up with a letter pointing out my 40 day timescale still stands and that the account is very much in dispute. Either the DCA can supply the data or GE money can, I dont really care which one I fight it out with The strange thing about this call was he sounded very well spoken, and accepted immediately my request for no more phone calls, heck he even seemed to know the appropriate laws involved when I quoted them, also a DCA usually states what company the call is in connection with. This guy is either a totally new approach for a DCA or he is something more, hence my suspicion it could be a solicitor working late to try and catch up with the workload lol. whoever it was I should know in a couple of days. It was also an 0845 number which is classic DCA.
  10. Me to but the name did ring a bell somewhere and I cant find it on any of my other pending claims. Its always possible its a call centre or DCA trying to push their luck, especially as I have 2 CCA letters that go into default tomorrow
  11. Great News Rosemary and well done . waiting for my settlement now as the claim was filed and served abotu 10 days ago. I dont suppose you had a letter from their solicitors did you as I had a strange phone call earlier from what sounded like a solicitor and suspect it may be them.

  13. Ok very strange phone call today from somebody who claimed to be handling a business matter for me. I refused to give personal details and told them to write to me. The call came at about 6:30 pm and sounded like a typical solicitors name. Has anybody had dealings with the solicitors acting for A&L as I seem to recall the name from somewhere( it started Nueman blah blah). I am sure I saw the name in these threads so hopefully they are looking ot make a deal as they have acknowledged my MC on 31 August.
  14. IIRC a direct debit is a contract between you and the bank, not between you and the company its paying. Therefore it comes under the direct debit guarantee. I know when I changed banks last year A&L withheld a couple of debits and then attempted paying twice on them after the date they were told NOT to pay and more regular payments. I did get every penny of the charges back after threatening to take further action.
  15. Ok where on earth is this information coming from ? I had an account with A&L and Girobank before they took it over and A&L have always charged £25 on day one and again on day 3 for exceeding your overdraft level. The 'Monthly O/D Fee' is/was £5 and is NOT a penalty charge its an agreed charge for every month the overdraft facility is used, along with a £10 overdraft set up/ annual renewal fee. the £25 on days 1 and 3 are nothing new but they are a penalty charge for unauthorised overdraft.
  16. OK sit calmly and start trying to think rationally as your going to need to be focussed on the task at hand. First start a thread of your own and read all the FAQ's etc etc and as many threads as you can manage as each thread has a new twist somewhere in it. Then send a DPA SAR requesting the data you will need, unless you have all your statements. A sample letter will be found in the library. Then we can go to town on A&L yet again and start the process of getting your money back:razz:
  17. It was no problem at all candyfloss. Just to let you know they never even acknowledged my LBA so I issued on Monday, waiting for their acknowledgement of service now.
  18. This is nothing new. The 'Monthly O/D Charge is and always has been £5. Thats the charge they make for any month your overdraft facility is used and it's a legitimate charge and cannot be reclaimed. If you look closer they charge you £10 to set up the overdraft facility and a further £10 a year continuation fee, again legitimate. The £25 charges you mention are for excedding your overdraft level and are applied on day 1 and again on day 3 if the level hasnt been reduced to your agreed amount. Those are a penalty and should be claimed
  19. Your very correct the %APR is a very loose method of giving a comparison of various banks charges and it works GREATLY in their favour and for our purposes should NOT be used. One point I will make though is the Alliance & Leicester do charge a £10 set up fee then £5 for every month the overdraft facility is used. They also charge a £10 continuation fee annually. I believe but don't know for sure that some other banks are now starting to use this as a method for increasing their charges. Personally I am calculating interest on credit cards using the monthly rate stated on their statements multiplied by 12 to give a yearly rate, although that still leaves us 5 days short( 6 in a leap year) as it means I am working on a 30 day month and not a 30.4166 day month but it's a close enough calculation for my purposes. It also means my calculation is never going to be higher than the card companies, so they have no defence in that the figure is too high.

Very correct, the charge you 3% per month on the outstanding balance, over a year the compounding effect increases that to a yearly rate of over 40% but that is NOT the APR its just the rate they have charged you, as somebody else rightly pointed out the true APR calculation is a LOT more complex.
  21. You will get a higher year rate ( modified wording so as not to use APR) because of the effect of compounding the 3% which is what I tried to do in my earlier post.
  22. I fully agree with you and yes they do use several decimal places to get extra pennies in which soon mount up. The best way to get rich is to take a little bit off a lot of people, but banks now are taking a lot off a lot of people. The Big Five in this country declared profits of about 36 BILLION pounds last year. Thats a LOT of compounding My example was an attempt to simply explain how the 36% quoted rate doesnt work out at 3% per month. It really is a very simple example of how compound interest works and wasnt intended as anything more than that Somebody else has also pointed out that the %APR should include things like set up fees etc which again disguises how much they really charge. Nobody ever said bankers were honest lol I think we should extend the campaign to get official condemnation of the high interest rates they all charge. with base rate at 5% (example) there is no justification for any bank or credit card using underhand tricks and high interest rates. Compound rates were developed by bankers for the benefit of bankers. I would be happy for my credit card to charge me say 2% above base rate but no way can I justify 30%
  23. I got the acknowledgement of service in the mail yesterday Jovi but the acknowledged it online last Friday stating they intend to fully defend the claim so hopefully I should have the check in the next couple of weeks

Hey I just realised they paid you within days of your issuing, did they say they were going to defend it in their acknowledgement ?
  25. Oops corrected it Thanks for pointing it out Thailand. Let battle commence, I'll teach them to ignore my LBA at their peril. They did make a partial offer but I have no idea if its been credited so claimed the full amount besides any credit they do make I expect to be counted as a payment not a credit or refund as I consider I have already made payments which cover this amount.
