  1. Hi all, sent 2 SARs weeks ago to the halifax, to reclaim PPI on my loan and mortgage, and to also reclaim penelty charges. Well received a letter back saying they cant process it as it has........(come to their attention that my signature does not match theirs on the database, and can I go to my local branch with ID to update and verify my signature) The SARs I sent were joint ones with my partner, we both signed the SARs but put crosses through, so it could not be copied. Yet they only need mine. The reason for that is they collared my partner while she was in bank and rushing, and told her to sign something as they needed to update and were telling all the customers to do it..........(yeah right). They were kind enough to send back both postal orders however lol So any suggestions guys what I can do...............without them getting my signature Thanks.
  2. Well got a letter back from Blemain saying they dont accept cash payments direct, and that includes postal orders. Oh and they have sent me no paperwork back that I requested with my SAR........... but they have kept my £10 for good measure it would seem!!!
  3. Hi Figaro, I am just waiting for papers back at the mo. I couldnt send them off as soon as I'd hoped, anyway I will keep you updated.
  4. Recieved a text from nintendo this morning, saying they have received the console. Now just received another text saying progress is on hold and to ring them. Apparently the console has water contamination, I'm really finding this hard to believe as my son barely played with it, and I expressed my doubt to the person I was speaking with. Anyway the cost to fix the problem is £50.50. The warranty doesn't cover accidental damage it says. Can anyone share their views if they do believe nintendo to be 1 of the decent companies left you can trust, because I really begrudge paying this as I really do find it hard to believe. thanks.
  5. Hi I bought my son a DSI from toys r us in preston on 12/11/11. This was a present for his birthday 24th dec. Anyway it worked for about 1 month if that then packed in, kept freezing and just not working. So for the past 5 months its not been used. I have FINALLY just found my receipt, so my question is..... if I return it to the store will I get a replacement?? as I don't really want to send off to a manufacture and have to wait more, I just want it kept simple. I've heard a bit about a 6 month rule, and from the day of purchase 12/11/11 to today 10/12/12, would it still be classed as in the 6 months period before the 12th of this month.???. Like I said I just want a simple swap, I dont want to trvel all the way to the store to be turned away. Any help gratefully received guys thanks.
  6. Hi Well just to let everyone know, after various e-mails, of kind of sounding like we knew what we were doing, she was offered £20, but we refused this and they then offered the 2nd £20. She wasn't really expecting to be offered anything so decided to hold out, especially as they had made 2 offers and she received a final offer for the full amount plus the deposits. )))
  7. Hi I've been speaking to my mum about PPI, and she said she has paid this in the past on both a mortgage and a credit card. (she was told on one of them it was like/or kind of a death policy, and would be very beneficial). However I think they where both applied round about 20 years ago, plus its been years since she's had these accounts...........Is it poss for her to still make a claim???. Also she doesn't think she can remember either account number on the mortgage or CC, plus she's moved twice since. She was with halifax for both, so is there a way or letter she could send to get this information?? Thanks
  8. Hi I forgot to ask, when I receive the SAR info, do I only claim to when the PPI was cancelled on the loan and the mortgage? Thanks
  9. Hi ims21, No not at the moment, I will have to send off a SAR to be sure of dates and totals. Do you think they are likely to payout as both were defaulted on and also not paid off yet?(both PPI and TMP ahve stopped on them though now because of this). Thanks
  10. BTW, When we took out our mortgage, we were also given insurance TMP- total mortgage protection. We never had a choice in this, or told we could shop around, just that we had to have it........is that correct with it being a mortgage or is that mis-sold aswell??. This also stopped about 2/3 years ago as we fell behind with payments on the mortgage,(had it for about 6 years i think), so we just got a letter 1 day saying it was cancelled. Thanks
  11. HI, Me and my partner took out a loan with the halifax a few years ago, and were sold PPI. I dont think the lady specifically said that our loan would be refused if we didnt take PPI, but it was definately implied, however she did say we were more likely to be accepted for the loan if we did.(we actually had good credit at the time). I know we had initially said no, especially not really knowing what it meant, but obviously we wanted to get accepted so agreed. I think a few years later poss 1/2 I got a call from the bank regarding the loan (well i presume it was for that loan, we had 2) asking how getting the loan went and were we happy? obviously not knowing about mis-selling back then, we just thought it was all the norm and said yes. The thing is I want to know is could we claim on this as we defaulted on the loan after a few years I think, and I think the PPI stopped when the debt got passed to a DCA. I mean it might not even be worth claiming as I said we fell behind after poss 2/3 if that, and with the loan not fully paid off not sure if its even poss. I am about to start repaying this loan when I set up a payment plan, but will probably get all my papers just to check, but i'm pretty sure the PPI stopped a long time ago. As we couldnt keep up with repayments. Thanks
  12. Hi Ford, well I was made redundant about 1.5 years ago,( thankfully not for too long) but I'm pretty sure the charges carried on. I've got a better paid job now, and slowly trying to catch up with everything, I even almost had my house repossessed, it was a very bad time, especially trying to catch up on 1 bill then missing another. I really wish I had known about that. Come to think of it with my mortgage too I dont think even when a financial advisor visited twice about my mortgage arrears that was never mentioned (unless they dont do it on a mortgage).

  15. Thanks for the reply dx100uk, I have a few statements but not all, so I will more than likely have to SAR them. Yes they did charge me for debt management, and no doubt anything else they could slap a charge on. I've also been reading up about how they charged someone for buildings insurance for them not having a note put on their own insurance policy, listing blemain as an interested party.......yet the first they heard of this was a good few years into their loan, I had exactly the same thing. I really hope I can re-claim the charges, because I know the debt would be reduced a lot, cant see blemain being very co-operative though. Worst mistake we ever made getting involved with them. Thanks again for your advice and I will keep you posted.
  16. Hi all I took out a loan with blemain finance, I think it was 20007 for £5000. (gross loan: £5700) The payback total was £10000. I was in bad debt at the time and this company was found via ocean finance. over the years, through losing my job, and just life in general I fell behind. So obviously charges and interest was applied. The thing is its now 5 years on and I still owe £10000. No matter what I seem to pay it seems to all be taken in interest. My normal monthly payments were £90, but when I got in debt I agreed to pay £200 per month, believing that was my normal payment and the rest would pay my arrears. (well at least thats what was arranged when a company rep visited...or so we thought) After about 9 months this payment started getting a bit much, so I rang the company and was told my account was up to date and could resume my normal £90 monthly payment. I have just received a statement and it shows my interest is 14.40% so when I was paying the £200 - £116 of that was just going on interest. this is now at £105.95 per month so when I am paying my regular £90, this is coming off my balance and then going back on a few days later and more as an interest charge. My account is only mainly this bad because of all the charges and charges for calls and letters, and because its a joint loan we get charged twice. The bottom of the statement says.....other information Arrears of monthly payments.........-£0.76 Balance of unpaid fees*...............£1,953.00 Balance of simple interest on fees*.....£564.94 *Included in the closing balance. I don't really understand any of this tbh, I just thought my arrears were paid like they said and thats why I was able to go back to my normal monthly payments of £90. Like I said its been 5 years and I still owe £10000, so is there anything I can do??? (maybe reclaim the charges or make them reduce the interest) because otherwise I know I will be paying this loan off till I die thanks.
  17. Hi all, I bought an electric fire and fire surround from an online store, anyway 7 months later it just stopped working. I emailed the company, who were totally fine and agreed to replace the fire as it was still under the year warranty. However the email also said that this new fire is only covered with the remaining term of my years warranty (about 3 months left now), and not a new full 1 years warranty. I just thought that was fine, but when I mentioned this to someone they told me they believe it to be wrong, as its a new (replaced) item and should have a new full warranty. So just wondering if anyone knows which is correct. thanks guys
  18. Ok will do, just read that they clamped some one, hopefully they will be to dumb to remember which car it was. Just trying to ring council now to get the liability figure. Thanks again everyone for your help so far.
  19. Hi thanks, I do have a car outside the house, the person I bought it off never sent me the log book, so its not technically registered in my name as yet, although I have paid the tax on it and mot, so dont know if they can find out that way.
  20. Also I have bad credit and only have a basic bank card and my bank wont let me upgrade even slightly.
  21. Thanks again, i'm not even sure what the amount is that I owe the council. Should I just ring the council and ask and them?. I've just recieved this years bill and usually pay on my council tax card, should i just pay extra on that alongside my normal monthly payments? because I know I cant afford to pay a lump sum for the arrears, or will they just think im paying extra on my current bill. I think the debt is around abouts £800, In the past the council wanted something like £250+ a month, but there was no way I could afford that............. just dont know what to do.
  22. Thanks for your reply i hate bailiffs, do you think the council would be willing to let me set up a new payment plan? I would much rather pay them, but I am worried they might not deal with me and just say I have to deal with bailiffs only
  23. Came home today to find a ROSSENDALES hand delivered letter behind my door. AS follows: BAILIFF REMOVAL MAGISTRATES LIABILITY ORDER/DISTRESS WARRANT DATED 23/06/10 FOR....UNPAID COUNCIL TAX BALANCE DUE IN FULL - 24 HOURS £.........TBA(wrote in pen)..............Inclusive of costs. I have attended today with the intention of removing your goods and chattels as are necessary to discharge the above debt and any additional ENFORCEMENT COSTS incurred. If payment in full is not made within 24 hours you may incur further costs. PLEASE NOTE - No further arrangements are acceptable and payment is now required in full by CLEAR FUNDS ONLY. I will re-attend at your address at my convenience and may REMOVE goods even in your absence. Should you wish to avoid this course of action, contact me immediately on the telephone number below to arrange prompt payment of your debt. NO CONTACT WILL BE TAKEN AS YOUR REFUSAL TO PAY. Your sincerely, Ms xxxxx (2 outstanding cases) ......wrote in pen. From the letter I am basically buggered is there anything I can do?. I got behind on my council tax and lots of other bills, so to pay one I would have to miss the other. I did have a payment plan with the council, but just couldn't get out of debt. It seems a long time since I last heard anything from them, but defo cant remember any previous dealings with rossendales. Have I left it to late and cowered away from this debt for to long or is there any chance I could still make a new payment plan with the council??? Or is there only a chance of jail, or them being able to just enter my property?. Not sure how or why there is two outstandig cases though or why its taken this long. PLEASE HELP IF POSS!!
  24. Well she got an email, she only told me briefly over the phone, that they said there is nothing she can legally do and they can keep her second deposit because its app in their t&c (or something along them lines), but if thats the case then they broke their t&c by letting her deposit twice. Prob not go anywhere but at least she can give them a bit of a headache.
