  1. Yes equity in properties exceeds the debts, thanks for all the advice. Rental property currently on the market but little interest up to press. Agents coming out to value my residential property next week. Will see how that goes and look at at debt management over a workable period after some conversations with some of the links you guys have posted. I'm 28, sure can start again, but difficult to get two properties on the ladder from scratch. Thanks guys
  2. I have been guided in the direction of this thread with regards to refund of bank charges due to being unfairly treated at a time when I was in financial difficulty. The charges were from May 2008 - May 2010, will I be able to pursue via the BCOB route if the majority of the charges were before the end of 2009 when I understand the BCOB's came into force? Thanks

That I had not been treated fairly during a time when I was in financial hardship due to my company going into liquidation, Natwest paid two direct debits from the account when there were insufficient funds, which then resulted in charges upon charges at a time when I was unable to fetch back in credit. Bank in 2009 I spoke to someone at Natwest who said they would look into stopping the charges but this never happened.
  4. Afternoon all, After running into difficulties in 2009 I had a DD paid when no funds were in the account and no overdraft in place. Then had charges and interest on top. Eventually resulted in CCJ by Fredrickson International, Natwests Collection agents of £884.79 + £147 charges + 1031.79 as I was not in a position to repay. I sent an SAR to Natwest who sent all of the information back to me. I sent a letter requesting the charges for unpaid DD, unauthorised OD fees on 01/04/2012, total of £902.81 + £205.38 for interest I was unfairly deprived of - total £1108.19, this being more than the CCJ amount. I received four letters dated 13/04, 11/05, 30/05 and 29/06 saying thank you for my patience, they were still looking into the matter and that they would be in touch by a set date. I then got a response on 19/07/12 saying sorry about my complaint but that the bank had acted correctly in levying the charges and that they had decided not to uphold my complaint, they enclosed a cheque for £100 for the length of time taken to respond. Then saying that was the final response to my complaint and that I have the right to refer my complaint to FOS and that I would need to do within 6 months. Is the Financial Ombuudsman Service a viable route to proceed? If so how do I go about it? Thanks
  5. Thanks for the pointers, will keep you informed to what comes back and see how far we can reduce the balance! Can anyone shed some light on if they can apply for a CCJ & charging order simultaneously as they have threatened, even though I am making payments every month?
  6. Credit file with Noodle says £13936 as of November, though I have a letter from them showing £13585 balance from the same time. First plus continued applying interest and charges at a time when I could not afford to make any payments, so im guessing this will have increased the balance? I do not have the statements to hand, I will SAR First Plus today, Thanks
  7. Morning All, I hope this post is in the right place! Here goes . . . I had a company selling cars which I started in 2006 and invested a lot of money in, expanded and took a lease on some premises in 2007, just before recession hit. in 2008 Month after month the company was spending more than it was earning, I did as I thought best at the time and continued to try and battle through. Eventually as could see no way forward I put the company into voluntary liquidation and therefore lost the capital I had invested and was left on a reduced income. After reducing payments on loans & credit cards I got some defaults and CCJ'S. I am now in a reasonably paid job and have agreements in place with my creditors. (apart from one with DLC which I have posted a separate thread about who are threatening charging order) Current Debts: CC MBNA/Idem Servicing £2510 Monument £772 Egg/Moorcroft £3616 Barclaycard 1 £4018 Barclaycard 2 £337 Capital 1 / Frederickson Int £1040 HSBC/Metropolitain £5355 Other Debts HSBC/Metropolitain £5670 (2 x Overdrafts + loan) one of the overdrafts is only for £50 and they will not let me pay this off seperate they say the debts have now merged. 1st Plus/DLC/Hillesden Securities £13585 CCJ's Natwest - Unauthorised Overdraft £964.19 Natwest - Personal Guarantee for Ltd Company £17,300 HMRC £2539 Total current outstanding £57705 plus: Loan which invested into company from family member £35,000, which I currently pay at £400 pmnth I have a rental property which is worth £200k for which I owe £95k, currently up for sale but no bites. I know its a tall ask but this was for my retirement and if possible would like to keep. I have tried to remortgage (currently with Natwest) but currently unable due to CCJ's and defaults the biggest two with Natwest. I have asked them to transfer mortgage onto interest only so that I can pay the CCJ's off quickly then remortgage, still in talks! I have a £110 mortgage against my property which is worth circa £130k. After reading about ways to increase credit score I have got a Vanquis credit card which I put petrol and food on and pay off before any interest charged to show some positivity on my credit file. I would like to remortgage the rental property but I am currently unable due to my poor credit. Whats the best way to get the debts cleared without paying over 25 years? Thanks in advance!
  8. Thanks dx! I took an unsecured loan out with first plus in 2006 for £15,000 with repayments of £195 per month. In 2009 I put the company which I had a lot of money invested in, into voluntary liquidation. (due to more costs than income hit by difficult finance times) Subsequently I had reduced income, agreed £43.96 per month reduced payments with first plus as a percentage of my disposable income split between creditors equally, all interest and charges stopped. May 2011 - Letter from DLC advising that first plus debt had been assigned to Hillseden Securities for £14376.32- I presume this means they bought the debt? DLC agreed to continue the payment plan of £43.96 until summer 2012 when they rang me numerous times saying I needed to increase to avoid charging order as this was next step, due to the debt taking 25 years to pay. 13/12/12 - Balance of £13585.04 regrettably after pressure on the phone (I know I will stick to letter from now on!) to increase payments to £74.50, they wanted to changed to DD, obviously sticking with SO. They say they will review in 6 months and want to pay debt over 10 years at £111 per month and that might still run the risk of having charging order. Can they apply for charging order if I am making regular payments? Thanks, York!

Hi Guys, I am having a similar experience with DLC telling me that they are looking at applying for a charging order against my property as the payment of £43.96 I am making against the £13409.20 balance is no longer acceptable as it will take 25 years to pay back the balance. After feeling I have no choice I have just discussed increasing the payments to £74.50 per month which is going to really eat into the money I allocate for food & general living costs. Sorry to crash another post! Where should I post to get some help?
