  2. I hope I am right, for some reason I have that dated recorded in my excel file - I looked at my credit file and usually it states the payment history, this only now goes back to 2010. Do you think that they do try for a CCJ knowing it's SB or do you think they just act on what Hoist ask them to do?

I think a Loan When did you enter into the original agreement before or after 2007? Feb 2007 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Claim is now with a debt purchaser Were you aware the account had been assigned – did you receive a Notice of Assignment? I can not remember, if they did send then perhaps to an old address Did you receive a Default Notice from the original creditor? I can’t remember Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments? I think it was September 2008 What was the date of your last payment? 31st September 2008? Was there a dispute with the original creditor that remains unresolved? No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? No
  5. Hi Dx, Today I took receipt of a "Claim Form" In The County Court Business Centre from Hoist Portfolio (they sent to old address and was redirected here) What should I do? Hi Slick, I don't know when it was last paid, I thought best to not ask for a SAR and as Dx say's get into exchanging letters and making the account live, also I don't want them looking deeper into the other accounts they have of me, they may think I know what I am doing and take action if they can on them before the SB period.   7. Yeah - i am unsure because lowell still chase me on other debts that was take out in Scotland around the same period.
  8. Hi Dx, I had this come through earlier before I contacted the forum: Received: As you are living in England the English limitations period would apply. Most debts become statute barred if there has been a full 6 years since you defaulted on the debt and you have not made a payment towards it (anyone else liable for the debt must also not have paid it), you have not acknowledged the debt in writing and a county court judgment (CCJ) has not been made against you.   11. Sorry - would they have had to take it to court within the 5 years? or can they until the 6th year now in England?
  12. Hi Dx, That is interesting and thanks - because the other items I have on going issues with was opened in Scotland also, and they are over 5 years. I just thought now in England they could collect upto the 6 years. Cheers Flappy
  13. I am still a bit confused, they have often wrote to me so I guess that is still in contact? Are you saying that because the debt was taken out in Scotland and I have not paid for 5 years then in theory it is statue barred? I don't want to write to them incase they have made a mistake, I will just keep ignoring until the default date is passed 6 years (unless i know i not paid within the last 6 years) Cheers, Flappy

  15. This is an interesting one:- I have a letter from them today offering me a 75% discount on an alleged debt of almost £3,000. It actually states this at the bottom of the letter:- "you should be aware that the period for recovering your debt by court action has expired, so we will not be issuing court proceedings to enforce payment. However, your debt still exists and legally we are within our rights to continue to ask you for payment" Is this true? can they continue to ask for payment? can I stop them sending me begging letters? Cheers, Flappy I would like to add the alleged debt is still on my credit file with a default date of November 2009, six years are not up until November this year unless they have an actual date of last payment made? The card was taken out in Scotland which is 5 years from SB, but I assume still enforceable in England?
  16. Just had another letter saying that they understand times are difficult etc...... I can contact them and they will come up with a solution blah blah - I guess I just keep ignoring
  17. I just opened another letter from them saying that they maybe able to give me a reduction in the balance I owe and perhaps I can pay that over three months!

Today I took delivery of a letter saying the following:- This personal loan was opened on FEB 2007 - SORT CODE XX XX XX & Account Number XXXXXXXX Default Date JAN 2010 I also have to complete the financial questionnaire and return with my proposal within 14 days. Hi Dx, Yes it is now on my Credit File - "Bank Default from Hoist Portfolio Holding 2 Limited (I)" Debt Due To HPH2 LTD (EX SANTANDER UK PLC) Today they sent a letter "Your account details have been passed to us" - they have thousands of customers etc, they can help blah blah blah Should I write back saying that I know nothing of this debt?   22. ********** UPDATE ********** I have still not heard anything back since the last letter, I assume they have wrote to Capital One asking for the details etc, 18 days since the letter was signed for by them.
  23. Morning, Yesterday I received a letter from "Robinson Way Limited" the letter was for an address confirm. They must have sent some letter to my old address that was 5+ years ago, they could of easily checked the electoral role as I have been here for nearly 3. I am to get in touch with them and let them know if I do reside here. No details of what it is regarding is on the letter, however I think it relates to a Santender loan that I had with an ex a long time ago. My credit file states "Hoist Portfolio" it was recently held via someone else (can't remember who) Loan taken out early 2007 and I think last payment was August 2008 so in theory SB. Should I write back and say that I am who they are asking and get further details? For some reason the default date was early 2010 so that needs to be investigated also. Cheers, Flappy
