  1. I'm happy to report that an hour ago my counter offer of one years full salary was accepted. Ok I've got 35% to pay to solicitors but it's a huge bump that's hitting right before Christmas. Can't complain at that.

Well as I've instructed my reps, I'm more than happy to take less and win and then utterly destroy the companies rep by taking their actions public through various means than sign a gagging order and settling. Obviously if they make a satisfactory offer then common sense says clearly to take it but right now I haven't received what I think is fair after what they did
  3. Wesley Ahmed is an absolute first class goon. He's been done for beating his ex wife and is currently on bail for assaulting a police officer in bury. I'd gladly put my foot up his ass but I expect his pathetic weasel like victim mentality and posse of dole sponging allergic to work sycophant followers would scream like he's been murdered if some one actually put him straight in his place.
  4. Ok so an update to this case. My legal reps have taken the case. The company who dismissed me have admitted the unfair dismissal. They tried to say I was two days short of the required service but due to their failure to provide me with statutory notice it took me over the required time frame. They have denied age discrimination and haven't really mentioned anything relating to any other paternity issue etc. They made a paltry settlement offer which was refused immediately. They then increased the offer slightly and this was rejected again. They replied saying that was their final offer and no more discussions would be entered into. The certificate to take the case to the full tribunal was then obtained from acas, and obviously acas informed them of the refusal and the application to the full tribunal. Ten minutes before the end of that day the other side rang up and despite their 'absolutely final offer' offered double the increased amount to settle. Again this has been refused as it only equates to about 6 months wages. I instructed my reps to return with an offer to settle at 1 years wages, with the expectation to be knocked down a bit on that offer. So apparently this case was a lot stronger than a lot of folk on here seemed to think.

  6. I joined because I knew things were about to turn crappy. Ihad intended to sort it sooner but the only other union guy in the place took his time to get me the forms etc. I know I should have done it myself but hey, hindsights 20/20

  9. I think the age discrimination line is more likely since he actually said that. Still, I've got to get written reasons of why he's done what he's done and then go through the appeal route before acas will get involved.

I have it in writing that he's willing to sort the contract issues out, 'I feel we will be able to sort out the outstanding contract issues' that's a quote from his reply to my asking the contract to be adjusted. I also have the fact that I've been doing the job for two years under the exact conditions that he's outlined in his contract, and that the staff handbook and contracts that he's given me outline a very different procedure to the one he followed today
  11. I've been on contract since October 2012, they just didn't fill in the specifics of pay, holiday entitlement etc. They gave me a contract but I asked them to take it back and fill in the sections regarding pay, holiday etc as none of that was filled in.
  12. Except they've been using the terms on my contract that were still under discussion for everything else. I've not been a casual worker at all. I've always had a minimum of 16 hours a week which was outlined to me from the outset, they've just refused to give me a contract until I seriously kicked off over it. And when they tried to offer me lesser terms they're reasoning to me was because I was younger than everyone else and had only been there 2 years and hadn't earned those conditions. That not withstanding, my point is surely you can't just dismiss an employee without a word, or any kind of investigation as to what I'm meant to have done
  13. I still have the contracts that he signed, and emails from hi saying due to my refusal that I would be returning to part time and covering shifts.
  14. There was nothing in writing about today. No warning, nothing. They offered me a full time 40 hour contract and I refused it as it treated me less favourably than other employees doing the exact same job. So despite my doing the job full time on the contract that they offered me since April they then busted me down to just 7 shifts this month, not including 10 days of holidays that I've already booked but am pretty certain they won't honour.

  16. Sorry I should also add that last week I verbally informed him that I would be asking for paternity leave in 3 months time. He replied put it in writing closer to the date
  17. No it doesn't it outlines a disciplinary procedure along the usual lines ie investigation disciplinary then appeal if necessary excetera. Nowhere does it say anything about dismissal on the spot without actually having done anything wrong. The previous post related to the contract they offered me after already having been there for 21 months where the other 7 guys doing the same job as me were offered over time at time and a half whereas mine was to be standard rate. Obviously I refused and asked for the matter to be considered as a grievance if they were going to insist on giving me lesser terms than everyone else. Obviously this request has been completely ignored and apparently their dismissing me today on the spot is what he has been told he is able to do.
  18. Ok further to a previous post, I was sacked today. Called into the mds office and told without any preamble that as I had dared to reject a contract offer that would have paid me less than anyone else in the same place of employment that my contract was being terminated. I immediately asked why I hadn't had some kind of hearing first and was told because I had rejected the offer of a contract that they didn't need a hearing or further reason to dismiss me. My full two years service would have been up on 5/10/14. I've had no kind of disciplinary action at all in my time there, and I've had no other issues. I've spoken to acas and they're take is that he's intentionally done it to avoid the two year rule and hope I won't take it further. I've had no written notification of why I've been dismissed, no notice of any form of hearing at all, literally taken into the office and told to leave. What now.
  19. Well fortunately come the 5th October I'll have been there two years so in only have to hold out one more week. Once I hit that then I'll have a measure of protection at least. I'm thinking that they've decided I'm too much hassle because I dared to ask for equal treatment. Plus daring to point out the bullying that's going on, it's just very convenient that he pulls the contract offer the day after I raise a formal complaint of what's going on.
  20. Oh and I probably should add I got this email today after putting a complaint in about getting totally victimised, isolated and bullied by one of the long term employees whose been making my life hellfire 6 months. Convenient timing?
  21. Well I put the request for the same terms in writing. I asked for them to give me the clause I was asking for, if not then I would raise a written grievance. Today he emailed me saying as we haven't been able to reach an agreement (I didn't even think we'd had a meeting of any form to discuss it!) and as the had made the offer of a full time contract in good faith that they were now forced to withdraw the offer altogether and put me on a 'as and when needed' rota. Which has been done. And he's rotated me in on 5 shifts right over my two weeks holiday request which went in at the start of September on order to be off for the mid two weeks of October. I've emailed the boss asking why they've ignored my holidays but heard nothing back. So pretty clear they're trying to 'manage' me out now.

  23. Incorrect in it's entirety. The plain simple fact whether you like it or not is that the decision has laid down precedent in case law that a bailiff acting with lawful authority now cannot be arrested for a breach of the peace or held responsible for the reaction of others upon attendance. That's what the decision actually means.
  24. So I had a discussion with the md yesterday and it seems that he's freely admitting they're trying to get rid of the above clause in all the contracts to save money. He asked me what my position was if the company stood firm and refused to give the clause I've asked for, and he wasn't happy when I said I wasn't about to tell him what actions i would take regarding a decision that hasn't happened yet, nor could I understand why he would ask me, especially outside of a formal setting. He then went on to to imply that if they did give me the clause, then it was highly likely they'd insist on another clause where it says I can't have a second job without their consent. Seems like he's trying to say sign it as is or well kick off over your second job. Which I think is unfair because I've been doing my other job since before I started this one, course I was going to have another job when I started out as part time!
