  1. so, what was the point of the letters then from here - just smoke & mirrors ? the fact is they added PPI without asking, then took premiums out whilst I was self employed which is dead money, and then finally took out an order that was supposed to be a pre agreement between us, but no such thing. Looks like I am just another statistic in this. The reason for the delay between orginal posts and this one, is because it was all being done amicably, and then Optima do all this. Is there anything at all I can do to get them to bear some cost in all this, and not just me.
  2. As I sent MBNA/Optima letters from here that stated I would claim compensation of £1 million, if they take court action against me, should I try and enforce this ?
  3. What I did not add, was that payments of premuims made after the initial unemployment were taken whilst I was self employed. No I was not aware of any court action, as I had informed them the account was in dispute, and I had exchanged letters and emails with Optima about resolving this, and seemed to be going well.
  4. I have a loan with Santander, and pay a set amount per month via Direct Debit. I was out of work at the start of this year and missed the first of those payments, and was contacted by them asking what was happening. I explained I was out of work, but would pay some funds in. A month later I get a call saying a 2nd payment had failed to be collected, and the Direct Debit had been cancelled. I asked by whom, and they said they did it, and it was because I did not pay the amount. I tried to explain that the Direct Debit is an agreement between the 2 of us, but this person said, it was cancelled, as was the agreement, and could I pay the amount outstanding. I said no, and I wanted to know when, and by whom the Direct Debit, and agreement had been cancelled. They said it would take 7 days to send this out. This was in March - still not received to this date. I then received a call in Apeil saying a 3rd payment had been missed. I said obviously as the Direct Debit had been cancelled, and they said no, it was still in place, as was the agreement. I asked her to check the records on the system, and what do you know - no record from the previous person. She said when could I repay the amount. I said I would pay £500 per month to clear the amount. She said that was unacceptable, and calls will continue. Today I get a letter from Wescot stating I owe them the amount outstanding. As I have no agreement with them, and I have no asked for my details to be passed to them, what can I do ? Have dealt with Wescot in the past, and I know how devious they can be.
  5. Well, I followed everything I have been told - send letters, send this, send that. MBNA & Optima Legal ignored them all, and this week successfully placed a Tomlin order against me for the next 3 million years. They added PPI, and because I made a claim they say I am not entitled to compensation against it, even though I never asked for it, they cannot prove it was added by someone or not. I sent letters about if they take court action I will seek £1 million etc ... and still they ignored me. I am at my wits end, as I never asked for it. I have asked for proof, and they ignore me. All I want is to get them to accept they lied, and get compensation, as this order will have a huge knock on for me. Any, and all advice is welcomed.
  6. I have been in dialogue with MBNA since late last year regarding PPI. I never asked for it, but they claim I did via telephone. I have asked for dates, and times, and they just reply saying 'by telephone', and then said they would not respond any more. I have asked for a copy of the CCA, and not received it. I have told them I dispute the debt then, as the payments are calculated with insurance. In 2009, I was laid off, and when I couldn't pay the bill they said why didn't I make a claim under insurance. As I was not aware I had it, I asked how I could, and they said under my policy. I was not aware for 3 months, and was then told I couldn't claim back from the first date of unemployment. So I got some money - not much, but I was not aware I had it, or paying for it. I have asked for it to be stopped, as I am self employed now, and was assured it had been, then last week I received a letter telling me of important changes to my insurance policy ! Using information from other sites, I wrote them 3 letters at 10 day intervals stating they had 10 days in each case to provide the CCA, or a sworn afa davit saying the debt was mine. I told them if they made contact by any other means other than mobile phone they would be liable for charges, and they have emailed me, written to me, but none acknowledging my letters. I have now received a letter from Optima tghreatening legal action if I do not pay the debt in full by 14th April. What should I do ?
